Council in and for the County of Collier, having conducted business herein,
met on this date at 9:00 AM in SPECIAL SESSION in Building "F" of the
Government Complex, East Naples, Florida, with the following members

I. Meeting was called to order at 9:03 AM by Acting Chair Hushon.
II. Roll Call
Roll call was taken with a quorum was established.
III. Approval of Agenda
Mr. Penniman moved to approve the agenda. Second by Mr. Hill. Carried
unanimously 6-0.

A. Continuation of Review of EAR amendments
Ray Smith, Director of Pollution Control & Prevention Department
gave a power point presentation (see attached) including the following
points:
. Review of tests and responsibilities.
. Clarifying questions addressed.
. The purpose of the study to be implemented every five years is
to determine the best of increase of urban and agricultural land
use on anthropogenic loading on Southwest Florida estuaries.
. Introduction of staff.
Dr. Hushon suggested April and October to take samples. She also noted,
that there are a number of other pesticides to be addressed, that are used
by lawn care and farming. Mr. Smith replied that they have been
evaluating the list that she had supplied, and evaluating the cost. Dr.
Bushon also made the recommendation to look into the surface water
program with the same list of chemicals for one year along with broad
passes every five years. Pesticide lists should be updated according to
pesticides being used.

Mr. Penniman owns an independent testing laboratory in Baltimore
which operates in a very competitive market, an individual test would cost
$150-$250 for a single sample, $3,000 for a panel of sixteen pesticides and
$2,000 for agricultural with a 48 hour turnaround. If more turnaround
time was aloud and tests performed at the same time the price would go
down significantly; approximately $1,300 a panel.
Dr. Hushon would like to see sediment data and water quality taken at the
same time. She also expressed concerns with design models for PUDs and
such and would like to have them checked.
Mr. Penniman brought out the possibility of not all programs for
pollution check having good enforcement with proper sanctions.
Mr. Lorenz addressed policy 2.3.6 (b). Overhead demonstration of
"Evaluation of Alternative Storm water Regulations for Southwest
Florida". He suggested having the County in partnership with other water
quality agencies develop a monitoring program to evaluate performance of
stormwater systems permitted by the South Florida Water Management
District. Based upon that kind of study, recommendations on the
regulatory structure could be changed. A noncompliance condition of the
stormwater system will then have to be established and a manner of
compliance set up. Mr. Penniman suggested building the cost into the
developments and specify the time frame on the studies with a specific
department to report to.
Dr. Hushon suggested the language "require Collier County by 2009 to
undertake an analysis of the current model used to evaluate stormwater
management structure designs. This will include sampling pre and two
year post construction at at least ten PUD outfalls. Based on this an
assessment of the models should be made and presented to the Board of
County Commissioners". Also adding "in addition to nutrients and heavy
metals in the stormwater model, lawn care pesticide and nutrient effluence
should be evaluated". She volunteered to meet with Mr. Smith and
suggested having TruGreen or Lusco give a presentation.
It was noted that low grassy or older retention areas should be tested
Mr. Hughes would like a bi-annual report from Pollution Control and
Prevention Departments.
Public Speakers-
Jim Kramer, Citizen of Collier County an opponent of Frank Halas at
the last election, read from the newspaper that asked how polluted is the
water that comes off of driveways, yard ways, streets, and fairways. He
asked how much of the pollution is being caused by the neighbor, South

Water Reclamation Plant, and commercial vehicles that speed at 55 miles
an hour. He has already sent notification to Jim Mudd, John Prat, the
Commissioner and the Sheriffs Department on the speed of commercial
vehicles.
The meeting recessed at 10:30 AM reconvening at 10:45 AM.
Mr. Dolan noted that he is on the Estero Bay Agency for Bay
Management where a presentation was given updating the progress of the
Special Basin Rule dealing with best management practices for water
quality purposes. It will probably be put back for hearing and public
comment in late spring.
GOAL 8:
Policy 8.1.3: 1. - Mr. Griffin suggested a language change of "The Collier
County Sheriff s Office will continue to stop vehicles with visible exhaust
emission".
GOAL 9:
Policy 9.4.3:- Mr. Griffin suggested adding "62-761 or 62-762, F.A.C. as
applicable"
GOAL 10:
Policy 10.1.5:- Deleted due to Policy 7.2.3: redundancy.
Policy 10.1.14:- Changing the word "is" to "are".
Policy 10.4.7:- Name changes that will have to be further evaluated.
Policy 1 0.6.1: - The removal of Tigertail will need to be researched.
GOAL 11:
No suggested changes
GOAL 12:
Policy 12.3.4:- Items #1 and #2 need to be deleted. Rick Zyvoloski,
Emergency Management Coordinator relayed that the 2001 Regional
Planning Council Hurricane Evacuation Study is the most recent; there is a
contract out for revision. He added that FGCU is recognized as the States
LP 1. They have emergency satellite radios and telephones in order to
have dedicated communication so that they can initiate emergency
broadcasting. He also noted that native trees are better at surviving

Florida weather. Mr. Penniman feels that the emergency management
was excellent.
Policy 10.3.14:- Delete "which will maintain any changes to levels
determined acceptable" adding "compatible with these resources and
natural systems".
GOAL 13:
No suggested changes
VIII. Public Comments
Brad Cornell, Collier County Audubon Society supports all of the changes
except Objective 2.1. He feels that 2018 is too late, proposing 2010 adding
"individual watersheds shall be prioritized for rolling completion and
implementation prior to the deadline for completion of all the plans". He
suggested establishing a subcommittee to motivate the process.
Jean Jourdan mentioned that there are different State agencies working on the
project. 2018 would be the date the watershed management plan could be
completed. There will be further discussion of this subject.
Dr. Hushon suggested having the first plan completed by 2008 and all
watersheds completed by 2012 with the individual watersheds prioritized by the
intensity of ongoing development.
The Committee agreed that the new proposed language for Policy 6.1.1 :(2) is
optimal. The committee also agreed to suggested language changes for Policy
6.1.1 :(4).
Mr. Griffin mentioned that "Conservation Mechanism" is not a legal term. It
would need to be developed ifused. Policy 6.1.1:(10) b. should read "equal or
greater than". Policy 6.1.2: would need the criteria corrected.
Mr. Hill noted that Policy 6.1.1 :(3) should read "On-site and off-site".
Mr. Lorenz will have additional analysis on .5 acres under 6.1.1 :(1 0) b.

Mr. Hughes commented that the Sheriffs department needs to police dump
trucks.
