I. Introduction A. Call to Order - Commissioner Bill McDaniel Commissioner McDaniel called the meeting to order at I :00 p.m. II. Otd Business A. Review and Approval of Meeting Minutes from March 22, 2018 ludge Crown moved to approve the minutes of the March 22, 2018 meeting as presenled. Second by Mr. Russell. Carried unanimously I - 0. B. Review the draft resolution scheduled to be considered by the Board of County Commissioners (BCC) on September 11,2018 regarding a revised policy on gain time for County prisoners and make a recommendation to the BCC to approve or deny the Resolution. Ms. Bouza presented'7 Resolution of the Board of County Commissioners of Collier County, Florida pursuant to Section 95 L 2I , Florida Stalutes, Establishing a Revised Policy of Gain Time for County Prisoners and Providing an Effective Date " for consideration. Also include was a copy of the Statute relevant to gain time for inmates. She noted: o Staff worked with the County Attomey's Office in preparing the proposed Resolution, which provides for additional gain time for inmates who exhibit exemplary behavior. o The concept is to promote incentives to improve inmate's behavior and increase panicipation in their assigned work program. o Inmates currently may choose not to work, however the altemative to not participating is facing disciplinary action. o Other programs have proved successful in improving the behavior of inmates and safety for all those in the facility. The following was noted during Council discussions: . Concems that the 5 days of additional gain time may create a situation whereby an inmate serves an abbreviated amount ofjail time (i.e. 4 months off a l2 month sentence) while the sentencing was intended to fit the crime and would be reduced - Staff noted only a small percentage of the prison population will qualify for the program as indicated by data available from the program when it was previously active. r Concem beyond the one-year sentence reduction, years 3 and 4 allow even further time offof a potential total of 15 days off per month, reducing the sentence time in half, especially ifthe Sate begins transferring inmates in their system to the County. Should the proposed Ordinance be altered to address this concem? - Staff noted the vast majority of County inmates are sentenced to one year or less. The County Attorney is concerned over changes as the proposed Ordinance mitors the Statute is consist teith Attorney General determinations and an individual may have grounds to challenge the Ordinance if it is different. o The reduction only applies to sentencing terms, not those who have been granted time served while they are awaiting trial. . Gain time is not automatic; it is awarded at the discretion of the Board of County Commissioners. o The inmates are educated on the program upon entry into the system and that there is a mechanism for gain time to be revoked through a disciplinary process' 2 33.A.3 Packet Pg. 709 Attachment: Meeting Minutes PSCC August 21, 2018 (signed) (7638 : Public Safety Coordinating Council- December 18, 2018) August 21, 2018 Only a small percentage of inmates will be eligible for consideration (6 percent) who would be required to follow every rule imposed upon them during their incarceration. Thejudge could impose sentencing on individuals based on the potential participation in the program, if they were concemed a sufficient amount of time would not be served by the guilty party. There is no term limit recommended for the Resolution and it would be beneficial for Staff to develop and track measurable goals for the program to assist the BCC in evaluating the proposal. The program is another tool to help improve inmate behavior and prepare them to be reintroduced into society. Mn Burgess moved to recommend the Board of Coung Commissioners approve lhe proposed Resolulion (A Resolution of the Board of Counlt Commissioners of Collier County, Florida pursuant to Seclion 951.21, Floridu Stttutes, Establishing a Revised Policy of Gain Time for County Prisoners) as presented by Staff. Second by Jutlge Crown. Catied unanimously I - 0. C. Review and Discus Collier County 2017 Grand Theft Statistics Ms. Bouza provided the "Collier County 2017 Grand Theft Aruesls " for information purposes. The Council reviewed the report and recommended the category "< $1,000 be revised to read '$300 - $1,000" given the parameterfor grand theft iniliates at $300.00. III. New Business A. Review and Discuss the Jail Occupancy Snapshot from August 13,2018 Mr. Harmon provided the handout on the Jail Occupancy as of 8/13/2018 and the "Collier County Jail Mental Health Statistics " for information purposes. He noted Staff is addressing mental health issues for the elderly including developing plans incorporating a Rapid Response Team. The Immokalee area facility is still in use when necessary, and the Council noted it may be necessary to begin re-establishing a hearing venue in the area. The Council requested Slaff present data dl a future meeling on the number of individuals arrested multiple times in a short limeframe, which may help identify those in need of help. IV, Member Comments Mr. Burgess reported at a recent industry gatherings, discussions have been brought forth on how organizations can partner with law enforcement to help address mental health issues with Collier County ahead of the curve on the concept. One maj or issue needing to be addressed is the availability of housing, especially for those in transition. Mr. Nichols recommended an item be placed on a future agenda for a presentation on the probation system. Ms. Smith queried on any considerations being given to developing adult diversion programs with the Sheriffs Office repodng they are aware ofthe concept but have not begun initiating plans at this point in time. Sheriff Rambosk reported the Countyjail has a new Executive Leadership team in place. Commissioner McDaniel reported he has contacted Representative Rodriguez who is supportive of a amending ofthe statutes on medical marijuana dispensary locations and sales tax with the revenue being split between the local municipalities and the State. It is envisioned some ofthe funds could be utilized for educational purposes.
