UTILITY EASEMENT
THIS EASEMENT, made and entered into this j:3JJ1 day of .5'pP/ft ~ ,
2002, by PELICAN MARSH COMMUNITY DEVELOPMENT DISTRICT, a local unit of
special purpose government organized and existing in accordance with Chapter 190,
Florida Statutes, as amended, whose mailing address is c/o Woodward, Pires &
Lombardo, 3200 Tamiami Trail North, Suite 200, Naples, FL 34103-4108,
as Grantor to the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS
EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY
WATER-SEWER DISTRICT, its successors and assigns, whose mailing address is
3301 Tamiami Trail East, Naples, Florida 34112, its successors and assigns, as
Grantee.
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to
this instrument and their respective heirs, legal representatives, successors and
assigns.)
WIT N E SSE T H:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its
successors and assigns, a perpetual, non-exclusive easement, license, and privilege for
utility purposes for the installation, maintenance, repair and operation of a reclaimed
water distribution line on the following described lands located in Collier County, Florida,
to wit:
See attached Exhibit "A" which is
incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
THIS PROPERTY IS NOT HOMESTEAD.
TO HAVE AND TO HOLD the same unto the Grantee, together with the right to enter
upon said land, excavate, and place or remove materials for installation and
maintenance of a reclaimed water distribution line thereon. Grantor and Grantee are
used for singular or plural, as the context requires. The easement granted herein shall
constitute an easement running with the land and shall burden the lands described
above.

more particularly described as follows:
Commence at the southeast corner of Section 36, Township 48 South, Range 25 East, Collier County,
Florida; thence run North 02°05'57" West, along the east line of said section 36, 0 distance of 150.14
feet, to Its intersection with the northerly right-of-way line of Vanderbilt Beach Rood Extension (150 foot
right-of-way); thence run North 89°39'40'" West, along said north right-of-way line of Vanderbilt Beach
Road Extension, a distance of 275.25 feet, to its intersection with the easterly line of the 125 foot Florida
Power and Light Company Easement, as described In O.R. Book 432, Page 720, said point being the POINT
OF BEGINNING of the herein described parcel; thence run North 02'05'57" West, a distance of 24.02 feet;
thence run North 89°39'40" West, a distance of 235.21 feet to a point on the westerly line of the Florida
Power and Light Company Easement, os described In O.R. Book 160, Page 270; thence run South
02°05'57'" East, a distance of 24.02 feet along the said westerly line of the Florida Power and Light
Company Easement Its Intersection with the Northerly Right-of-Way of Vanderbilt Beach Road Extension;
