PURPOSE The purpose of this Section is to set forth the development commitments for the development of the project. 2. ENVIRONMENTAL A. A Preserve Area Management Plan shall be provided to Environmental Services Staff for approval prior to site/ construction plan approval. The Preserve Management Plan shall identify methods to address treatment of exotic species, fire management, and maintenance. B. The minimum Native Preservation requirement will be a minimum of 9:30-0.35- acres e.•. . - - . ' - - . - •. e . - . Existing Vegetation on Site(0.15-acres x 15%=0.05-acres) 0.30-acres(existing preserve)+0.05-acres(proposed)=0.35 acres C. Due to the poor quality of the native vegetation found on site, the revised master concept plan relocates the Preserve to the south at time of construction of the proposed loop road. At the time of application for development order approval for the proposed loop road labeled "Proposed Drive Access" on the master plan, a supplemental planting plan in accordance with LDC Section 3.05.07.H.1.e will be required. The planting shall be required to be completed prior to County site acceptance of the loop road. 3. TRANSPORTATION A. At the time of site development plan (SDP), the petitioner agrees to contribute a proportionate fair share cost for the planned improvements at the Pine Ridge/ Whippoorwill intersection, as well as the Whippoorwill improvements. The proportionate share will be based on the highest peak operational impacts proposed by the site, which are present during the ANFPM peak hour. The proportionate share will be calculated during the Development Order application process. B. Compensating right-of-way for the right turn lane shall be conveyed by the Owner to Collier County at no cost to the County, so that the stormwater detention along Whippoorwill Lane can be relocated when requested by the County. AVOW HOSPICE CFPUD PUDR-PL20170002501 October 24,2018 Words added are underlined and words struck-through have been deleted 12 1 7 C C. The CFPUD shall be limited to a maximum of 79 P.M. peak hour two-way trips, based on the use codes in the ITE Manual-10th Edition. 4. LANDSCAPING Preserve areas may be used to satisfy the landscape buffer requirements, after exotic vegetation removal, in accordance with LDC Sections 4.06.02 and 4.06.05 E.1. Supplemental plantings with native materials shall be in accordance with LDC Section 3.05.07. However, if the preserve after removal of exotic vegetation cannot meet the 80%opacity requirement as specified in the LDC for a Type B' Landscape Buffer(where required)after 12-months of County site acceptance of the proposed loop road, labeled "Proposed Drive Access" on the master plan, then a minimum 6-foot-wide landscape buffer area must be reserved for additional landscape material, consisting of 10-gallon plants, 5' in height, 3' feet in spread and spaced a maximum four feet on center at planting. Plantings within the 6' landscape buffer area shall be provided and designated at time of SDP permitting for the looped drive and shall be allowed within the ten-foot accessory preserve setback. (Refer to Exhibit I). 5. PUD MONITORING One entity (hereinafter the Managing Entity) shall be responsible for PUD monitoring until close-out of the PUD,and this entity shall also be responsible for satisfying all PUD commitments until close-out of the PUD. At the time of this PUD approval, the Managing Entity is AVOW Real Estate,Inc. Should the Managing Entity desire to transfer the monitoring and commitments to a successor entity, then it must provide a copy of a legally binding document that needs to be approved for legal sufficiency by the County Attorney. After such approval, the Managing Entity will be released of its obligations upon written approval of the transfer by County staff, and the successor entity shall become the Managing Entity. As Owner and Developer sell off tracts, the Managing Entity shall provide written notice to County that includes an acknowledgement of the commitments required by the PUD by the new owner and the new owner's agreement to comply with the Commitments through the Managing Entity, but the Managing Entity shall not be relieved of its responsibility under this Section. When the PUD is closed- out, then the Managing Entity is no longer responsible for the monitoring and fulfillment of PUD commitments. 6. LIGHTING Site lighting, along the loop drive, shall be Dark Skies compliant and installed to protect neighboring properties from direct glare by directing all light sources away from adjacent residential properties. Site lighting shall be provided with full cutoff shielding and not exceeding 0.2 foot-candles at the shared property line(s). Pole mounted lighting shall be a maximum of 15-feet in height, within 50-feet of adjacent shared residentially developed property lines. DEVELOPMENT PHASING The intent of this phasing schedule is to limit the future development of the Avow PUD to at least a five-year period from the effective date of this PUD Ordinance, to minimize impacts on the County's road network. Phase One (no earlier than November 1, 2018) is limited to a maximum of 2,997 SF and associated site improvements (Refer to SDPA-PL20180000562). Deviation #1 seeks relief from LDC Section 5.03.02 H.1.a "Wall Requirements Between Residential and Non-Residential Developments—Height and Location,"which requires a wall if located on a contiguous property, then height shall be 6 feet to 8 feet and placement shall be no less than 6 feet from the residentially zoned district, to instead remove the requirement to place a wall along the southern boundary to allow for an enhanced Type B buffer in lieu of said wall along the south property line, for a distance of±873 linear feet (from the Whippoorwill Lane right-of-way easement to the preserve boundary), at the time of site development plan approval. The enhanced buffer, in addition to the required planting material as prescribed by the LDC,shall consist of an additional row of 10-foot high, 10-gallon trees at 25-feet on center, and an additional 6-foot high hedge planted at 4-feet on center(Refer to Exhibit G). 2. Deviation #2 seeks relief from LDC Section 5.03.02 H.1.b "Wall Requirements Between Residential and Non-Residential Developments—Height and Location,"which requires a wall if located on a property opposite a residentially zoned district but fronting on a local street or roadway, ... then height shall be 4 feet and placement shall be a minimum of 3 feet from the rear of the right-of-way landscape buffer line, to instead remove the requirement to place a wall along Whippoorwill Lane and allow for an enhanced Type D buffer in lieu of said wall. The enhanced buffer, in addition to the required planting material as prescribed by the LDC,shall consist of an additional 5-foot high hedge. (Refer to Exhibit G). 3. Deviation #3 seeks relief from LDC Section 6.06.02 A.2 "Sidewalks, Bike Lane and Pathway Requirements," which requires 5-foot sidewalks to be constructed on both sides of internal streets/access ways, to instead allow a 6-foot sidewalk on one side of the internal street/ access way. 4. Deviation#4 seeks relief from LDC Section 3.05.07 H.1.b "Preserve Standards,"that requires an average width of 50-feet in width but not less than 20-feet for properties twenty acres or greater,to instead allow an average preserve width of 29.6-feet. 5. Deviation #5 seeks relief from LDC Section 4.06.02 D. 4 "Standards for Retention and Detention Areas in Buffers," which prohibits impervious areas within landscape buffers, to instead allow up to 5-feet of the drive aisle to be installed within the 10' Type "A" buffer, located along the western property line for a distance of ±90 linear feet. The 5-feet of landscape buffer area shall be relocated along the same property boundary. Should existing Live Oaks be removed, they shall be replaced with Sabal Palms, along the property line in the encroachment area, not to exceed 30%of the buffer(Refer to Exhibits G and H). AVOW HOSPICE CFPUD PUDR-PL20170002501 October 24,2018 Words added are underlined and words truck-t#eag+have been deleted 15 6. Deviation#6 seeks relief from LDC section 3.05.10 C.2.b"Littoral Shelf Planting Area (LSPA)," which requires that any lake shoreline modification, greater than 20% of a previously approved lake shoreline, to comply with LDC section 3.05.10 A, which will result in a 7% littoral shelf planting area requirement of the existing lake's surface area,to instead allow a 3% littoral shelf planting area of the total lake surface area. This equates to an overall 0.25- acre littoral shelf planting area for the lake. 7, Deviation #7 seeks relief from LDC Section 4.05.02 F which requires that parking areas be arranged so that no vehicle shall be forced onto any street to gain access from one aisle to another aisle, to instead allow access to the ±4.89-acre expansion parcel via an existing driveway along Whippoorwill Lane. An interconnect between the existing Avow development and the±4.89-acre property will be provided at time of SDP permitting for the proposed loop drive. B. The minimum Native Preservation requirement will be a minimum of 0,38-0.35- acres{0.88 acres of native vegetation x 15%-0.30-acres) Existing Vegetation on Site(0.15-acres x 15%=0.05-acres) 0.30-acres (existing preserve) +0.05-acres(proposed) =0.35 acres C. The proportionate share will be based on the highest peak operational impacts proposed by the site, which are present during the AMM peak hour. The proportionate share will be calculated during the Development Order application process. B. Compensating right-of-way for the right turn lane shall be conveyed by the Owner to Collier County at no cost to the County, so that the stormwater detention along Whippoorwill Lane can be relocated when requested by the County. AVOW HOSPICE CFPUD PUDR-PL20170002501 October 24,2018 Words added are underlined and words struck through have been deleted 12 0 1 7 C C. The CFPUD shall be limited to a maximum of 79 P.M. peak hour two-way trips, based on the use codes in the ITE Manual-10`h Edition. However, if the preserve after removal of exotic vegetation cannot meet the 80% opacity requirement as specified in the LDC for a Type 'B' Landscape Buffer (where required) after 12- months of County site acceptance of the proposed loop road, labeled "Proposed Drive Access" on the master plan, then a minimum 6-foot-wide landscape buffer area must be reserved for additional landscape material, consisting of 10-gallon plants, 5' in height, 3' feet in spread and spaced a maximum four feet on center at planting. Plantings within the 6' landscape buffer area shall be provided and designated at time of SDP permitting for the looped drive and shall be allowed within the ten-foot accessory preserve setback. (Refer to Exhibit I). 5. PUD MONITORING One entity (hereinafter the Managing Entity) shall be responsible for PUD monitoring until close-out of the PUD, and this entity shall also be responsible for satisfying all PUD commitments until close-out of the PUD. At the time of this PUD approval, the Managing Entity is AVOW Real Estate, Inc. Deviation #1 seeks relief from LDC Section 5.03.02 H.1.a "Wall Requirements Between Residential and Non-Residential Developments—Height and Location,"which requires a wall if located on a contiguous property, then height shall be 6 feet to 8 feet and placement shall be no less than 6 feet from the residentially zoned district, to instead remove the requirement to place a wall along the southern boundary to allow for an enhanced Type B buffer in lieu of said wall along the south property line, for a distance of ±873 linear feet (from the Whippoorwill Lane right-of-way easement to the preserve boundary), at the time of site development plan approval. The enhanced buffer, in addition to the required planting material as prescribed by the LDC, shall consist of an additional row of 10-foot high, 10-gallon trees at 25-feet on center, and an additional 6-foot high hedge planted at 4-feet on center(Refer to Exhibit G). 2. Deviation #2 seeks relief from LDC Section 5.03.02 H.1.b "Wall Requirements Between Residential and Non-Residential Developments—Height and Location,"which requires a wall if located on a property opposite a residentially zoned district but fronting on a local street or roadway__ then height shall be 4 feet and placement shall be a minimum of 3 feet from the rear of the right-of-way landscape buffer line, to instead remove the requirement to place a wall along Whippoorwill Lane and allow for an enhanced Type D buffer in lieu of said wall. The enhanced buffer, in addition to the required planting material as prescribed by the LDC, shall consist of an additional 5-foot high hedge. (Refer to Exhibit G). 3. Deviation #3 seeks relief from LDC Section 6.06.02 A.2 "Sidewalks, Bike Lane and Pathway Requirements," which requires 5-foot sidewalks to be constructed on both sides of internal streets / access ways, to instead allow a 6-foot sidewalk on one side of the internal street/ access way. Deviation #6 seeks relief from LDC section 3.05.10 C.2.b "Littoral Shelf Planting Area (LSPA)," which requires that any lake shoreline modification, greater than 20% of a previously approved lake shoreline, to comply with LDC section 3.05.10 A, which will result in a 7% littoral shelf planting area requirement of the existing lake's surface area, to instead allow a 3% littoral shelf planting area of the total lake surface area. This equates to an overall 0.25- acre littoral shelf planting area for the lake. 7. Deviation #7 seeks relief from LDC Section 4.05.02 F which requires that parking areas be arranged so that no vehicle shall be forced onto any street to gain access from one aisle to another aisle, to instead allow access to the ±4.89-acre expansion parcel via an existing driveway along Whippoorwill Lane. An interconnect between the existing Avow development and the±4.89-acre property will be provided at time of SDP permitting for the proposed loop drive.
