EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners (Board) declare the Public Transit
Advisory Committee (PTAC) member position held by Kerru Dera, to be vacant and direct the
County Attorney to prepare a resolution confirming the declaration of vacancy and to publicize the
vacancy.
OBJECTIVE: To declare a seat to be vacant on the Public Transit Advisory Committee (PTAC).
CONSIDERATIONS: The PTAC was originally established as an ad hoc committee on February 26,
2013, by Resolution No. 2013-50, to make recommendations to the Board in matters related to transit
policies, issues, programs, and plans to provide mass transit services to the citizens of Collier County. On
March 22, 2016, the Board adopted Ordinance No. 2016-07, which converted the committee from an ad
hoc to a regular advisory committee comprised of seven (7) members. Members of this committee include
one representative designated by the District School Board of Collier County and, if possible, include
representatives from large employers, health care related services, social services and transportation,
planning professionals, and at least two (2) passengers of the system. Terms are three (3) years. A list of
the current membership is included in the backup.
Public Transit & Neighborhood Enhancement (PTNE) staff has reviewed the attendance record for the
current membership and found that one (1) member has not been attending the meetings regularly. Since
his appointment by the Board in October 2017, Mr. Kerru Dera has only attended two (2) of the ten (10)
meetings scheduled for the PTAC. All these absences have been without any contact to staff or stated
reason.
The Board’s General Advisory Board Ordinance (Ordinance 2001-055) provides in relevant part as
follows:
Any “Committee” member who is absent for more than one-half of the “Committee’s”
meetings in a given fiscal year shall be deemed to have tendered his or her resignation
from such “Committee”. The Commission shall, as soon as practicable after such
resignation, declare the position to be vacant and shall promptly fill same pursuant to the
provisions of Section Six herein. The “Committee” members shall not serve at any
meetings after his or her position is declared vacant by the Commission.
Staff is requesting that the Board find that Mr. Dera has tendered his resignation, declare the position to
be vacant, and direct staff to take the necessary steps to refill the position.
FISCAL IMPACT: There is no Fiscal impact.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact.
LEGAL CONSIDERATIONS: This Item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
