EXECUTIVE SUMMARY
Recommendation to authorize a budget amendment to recognize payment in the amount of
$29,842.20 received from the City of Naples for the engineering design of potable water lines for the
West Goodlette-Frank Road Joint Stormwater-Sewer Project (Project 60142).
OBJECTIVE: For the Board of County Commissioners (Board) to authorize a budget amendment to
recognize payment received from the City of Naples (City) for a portion of the design costs for the West
Goodlette-Frank Road Joint Stormwater-Sewer Project and allocate the funds to the project.
CONSIDERATIONS: The County and City entered into an interlocal agreement (September 27, 2016,
Board Agenda Item 16.A.9, with a subsequent First Amendment on April 24, 2018, Board Agenda Item
16.A.2) for the design and construction of stormwater and sanitary sewer facilities along certain roadways
located between Goodlette-Frank Road and US-41. The interlocal agreement identified the
responsibilities of both the County and City regarding the design of the project with the County being
responsible to contract for the design of all project components and the City being responsible to
reimburse the County for the design costs associated with the utility components. Reimbursement was to
occur within specified time frames related to project construction.
During the subsequent discussions on project construction, the City Council voted not to support a
resolution establishing an assessment on project area property owners to fund the sanitary sewer porti on
of the project construction at its June 13, 2018, meeting (Agenda Item 13.A). The project construction
contract was subsequently withdrawn from City Council discussion that day.
On July 10, 2018, the Board voted to approve the project construction contract contingent upon the City
reconsidering their vote and voting approval within one hundred twenty (120) days. During the
presentation to the Board, staff identified additional funding support to be offered to the City for its
reconsideration. One of the additional funding items was for the County to assume financial
responsibility for the design costs of the sanitary sewer components and not seek reimbursement for those
costs from the City.
On August 15, 2018, the City Council discussed the reconsideration of its previous vote on June 13, 2018,
and agreed to accept the County’s offer, which included the County taking responsibility for the design
costs associated with the sanitary sewer components of the project. The City approved a vote to
reconsider its previous denial of the project, which led to subsequent City Council meeting agenda items
on September 5, 2018, and October 17, 2018, to establish a revised and reduced assessment to fund the
project and to approve the construction contract.
At the request of City Utilities Department staff the County submitted an invoice on September 20, 2018,
in the amount of $29,842.20 to the City for the reimbursement of design costs of the potable water
components of the project, which were never a point of concern to City Council since those costs were
not a part of the assessment for the sanitary sewer components. The County received payment from the
City, which became part of the FY 18 Carry Forward.
FISCAL IMPACT: A budget amendment is needed to recognize carry forward revenue in the amount of
$29,842.20 and appropriate into the project (60142) within the Stormwater Management Capital Fund
(325).
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
action.
