Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve for recording the amended final plat of Esplanade Golf and Country Club of Naples Phase 5, (Application Number PL20180002972) approval of the standard form Construction and Maintenance Agreement and approval of the amount of the performance security. OBJECTIVE: To have the Board of County Commissioners (Board) approve for recording the amended final plat of Esplanade Golf and Country Club of Naples Phase 5, a subdivision of lands located in Section 15, Township 48 South, Range 26 East, Collier County, Florida, following the alternative procedure for approval of subdivision plats pursuant to Resolution 99-199. This procedure allows for the Board to approve the amended plat and associated construction documents for construction purposes and recording purposes concurrently. CONSIDERATIONS: On June 26, 2018, the Board approved the final subdivision plat for Esplanade Golf and Country Club of Naples Phase 5, PL20180000032. The developer subsequently submitted PPL Amendment (PPLA) PL20180002201 to convert 34 of the 52-Foot lots along Tulipano Terrace into 23 76-Foot lots and modify the utility infrastructure to accommodate the larger lots, resulting in a reduction of total units from 126 to 115 single-family units. Due to the condominium units being sold prior to plat recording, PPLA PL20180002201 had to be withdrawn and replaced by PPLA PL20180002972, proposing to revise the overall plat boundary to remove the condominium area from the plat, and necessitating this additional approval by the Board. According to Section 10.02.04 B.5.c of the Land Development Code, following approval by the Board of the final subdivision plat, but prior to recordation, the Board may approve amendments to the final subdivision plat. The Development Review Division of the Growth Management Department has completed the review of the construction drawings, specifications, and amended final plat of Esplanade Golf and Country Club of Naples Phase 5. These documents are in compliance with the County Land Development Code and Chapter 177, Florida Statutes. This project is within the Esplanade Golf & Country Club of Naples RPUD, Ordinance No. 09-21, as amended. All fees have been paid. Security in the amount of 10% of the total cost of the required improvements associated with this amended final plat, and 100% of the cost of any remaining improvements, together with a Construction and Maintenance Agreement for Subdivision Improvements, shall be provided and accepted by the County Manager or his designee and the County Attorney’s office prior to the recording of the amended final plat. This procedure is in conformance with Section 10.02.04 F.2 of the Land Development Code. The Development Review Division recommends that the amended final plat of Esplanade Golf and Country Club of Naples Phase 5 be approved for recording. FISCAL IMPACT: The project cost associated with this amended final plat is $1,789,479.46 (estimated) to be borne by the developer. The cost breakdown is as follows: a) Water & Sewer $ 690,168.95 b) Drainage, Paving, Grading $1,099,310.51 The Security amount, equal to 110% of the project revision cost, is $1,968,427.41 The County will realize revenues as follows: Fund: Growth Management Fund 131 16.A.15 Packet Pg. 1114 12/11/2018 Agency: County Manager Cost Center: 138327 -- Land Development Services Revenue generated by this project: Total: $54,863.39 The Fees are based on a construction estimate of $1,789,479,46 and were paid in July 2018 and October 2018. The breakdown is as follows: a) Plat Review Fee ($1,000.00 + $5./ac) $ 1,179.00 b) Construction Drawing Review Fee Water & Sewer (.75% const. est.) $ 5,176.27 c) Drainage, Paving, Grading (.75% const. est.) $ 8,244.83 d) Construction Inspection Fee Water & Sewer (2.25% const. est.) $ 15,528.80 e) Drainage, Paving, Grading (2.25% const. est.) $ 24,734.49 GROWTH MANAGEMENT IMPACT: The developer must receive a Certificate of Adequate Public Facilities (COA) prior to the issuance of the construction plan final approval letter and plat recordation, except when the applicant elects to delay obtaining a COA for non-residential developments that are required to obtain approval of a site development plan prior to the issuance of a building permit. LEGAL CONSIDERATIONS: The applicant is requesting approval of the amended final subdivision plat and construction and maintenance agreement. The Board shall consider the County Manager or designee’s recommendation and shall take evidence and testimony in regard to the final subdivision plat requirements identified in LDC sections 10.02.04 B, 10.02.04 C, and other provisions of the LDC, as well as Chapter 177, Florida Statutes. If the Board denies or places conditions on the amended final subdivision plat, it shall state reasons for such denial or conditions. The original final subdivision plat was approved by the Board on June 26, 2018. In accordance with the LDC, the applicant is required to submit the final subdivision plat to the County Manager or designee for recording within 18 months of the date of approval of the final subdivision plat by the Board. However, following approval by the Board, but prior to recordation, the County Manager or designee may approve minor insubstantial changes to the final subdivision plat, and the Board may approve any changes that are not minor and insubstantial. The applicant’s proposed changes to the originally appro ved final subdivision plat are not considered minor and insubstantial, and therefore this amended final subdivision plat requires Board approval. This item has been approved as to form and legality, and requires a majority vote for Board approval - SAS RECOMMENDATION: To endorse staff’s recommendation to approve the amended final plat of Esplanade Golf and Country Club of Naples Phase 5 (Application Number PL20180002972) for recording with the following stipulations: 1. Approve the amount of $1,968,427.41 as the performance security for the required improvements associated with this amended plat; or such lesser amount based on work completed, and as is approved by the Growth Management Department. 2. To withhold Certificates of Occupancy until the required improvements have received preliminary acceptance. b. To delay recording of the amended plat until suitable security and an appropriate Construction and Maintenance Agreement is approved and accepted by the County Attorney’s office and the Board of County Commissioners or the County Manager or his designee on behalf of the Board pursuant to Section 10.02.04 F.2 of the Land Development Code.
