EXECUTIVE SUMMARY
Recommendation to accept or reject bids received for County-owned surplus lands advertised
pursuant to the provisions of Section 125.379, Florida Statutes and direct staff to take appropriate
actions based on Board direction.
OBJECTIVE: The Board of County Commissioners (Board) to accept or reject bids received for
County-owned surplus lands.
CONSIDERATIONS: On June 27, 2017, Agenda Item #16D12, the Board approved Resolution 2017-
112, that reaffirmed the designation of five (5) County-owned real properties as surplus lands in
accordance with Section 125.379, Florida Statutes. Section 125.379 (2) states as follows:
The properties identified as appropriate for use as affordable housing on the inventory
list adopted by the county may be offered for sale and the proceeds used to purchase land
for the development of affordable housing or to increase the local government fund
earmarked for affordable housing, or may be sold with a restriction that requires the
development of the property as permanent affordable housing, or may be donated to a
nonprofit housing organization for the construction of permanent affordable housing.
Alternatively, the county may otherwise make the property available for use for the
production and preservation of permanent affordable housing.
Pursuant to Section 125.35(c), Florida Statutes, no sale of any real property shall be made unless notice
thereof is published once a week for at least two (2) weeks in some newspaper of general circulation
published in the County. The legal notice was published on July 30, 2018 and August 6, 2018 and a copy
of the Affidavit of Publication is attached for reference. The notice solicited for bids under three (3)
scenarios:
(1) For sale at the minimum listed price or higher, which allows the County to utilize the
proceeds to purchase land for affordable housing;
(2) For sale at a lesser sales price with a restriction that requires the development of the property
as permanent affordable housing; or
(3) Donation to a non-profit housing organization for the construction of permanent affordable
housing.
A total of eleven (11) sealed bids were received; 1 bid was received for Scenario #1 and 10 bids were
received for Scenario #2 as outlined below.
One bid was received utilizing Scenario #1 (1200 Mingo Dr.- $140,000) that provides for the unrestricted
sale at a minimum or higher sales price, which allows the County to utilize any excess proceeds for
affordable housing. The appraised value of the Mingo Drive site was $95,000. Property shown on Exhibit
A.
Ten (10) bids were received utilizing Scenario #2 that provides for the sale at a lesser sales price with a
restriction that requires the development of the property as permanent affordable housing. Nine (9) of
these were later withdrawn at the bidder’s request, leaving one (1) bid (Livingston Woods - $152,000).
The appraised value of the Livingston Woods site was $300,000. Property shown on Exhibit B.
A copy of the bid tabulation is attached as Exhibit C, which includes property address, acreage, zoning,
minimum sales price, bid amount, bidder names and under what scenario.

FISCAL IMPACT: If the surplus lands are sold, appropriate County departments would be reimbursed,
and any remaining funds will reside in the Affordable Housing Trust Fund, Fund (116), Cost Center
138711, Program 50137.
GROWTH MANAGEMENT IMPACT: Use of County-owned parcels, or excess revenue generated
from the sale of them, for the development of housing that is affordable furthers the Goals, Objectives,
and Policies of the Growth Management Plan and specifically the Housing Element.
LEGAL CONSIDERATIONS: Section 125.379, F.S., provides flexibility in analyzing the best deal for
the County as it relates to providing affordable housing. The County is under no o bligation to accept any
bids. If a bid is accepted here under Scenario #2, a purchase agreement with restrictions will be brought
back to the Board for final approval. This item is approved as to form and legality and requires majority
vote for Board action. - ERP
RECOMMENDATION: To either accept or reject one or more bids received and, if any are accepted,
authorize the Chairman to execute a standard Purchase Agreement for Sale and Purchase and Statutory
Deed once prepared and approved by the County Attorney’s Office for any bids accepted under Scenario
#1, deposit funds received from the sales in the appropriate accounts, direct the County Manager or his
designee to follow all appropriate closing procedures, and record the Statutory Deed in the Collier Co unty
Public Records; and/or direct staff to prepare, negotiate, and bring back a Purchase Agreement with
restrictions for any bids accepted under Scenario #2.

EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign a resolution reaffirming the
attached inventory list of County-owned real property as surplus land in accordance with Section
125.379, Florida Statutes, for the benefit of affordable housing; and take action with respect to
parcels previously identified.
OBJECTIVE: To provide housing that is affordable in Collier County and to further the goals set
forth in the Housing Element of the Growth Management Plan.
CONSIDERATIONS: In 2006, the Florida Legislature enacted Section 125.379, Florida Statutes,
wherein each county is tasked to triennially prepare an inventory list of all real property within its
jurisdiction to which the county holds fee simple title that may be declared appropriate for use or sale for
the benefit of affordable housing. The Board of County Commissioners must review the inventory list at a
public hearing and revise it as they choose. Following the public hearing, the governing body must adopt
a resolution that includes an inventory list of such property.
The Statute provides possible options for appropriate usage of this property to benefit affordable housing.
The property may be offered for sale and the proceeds, above any amounts reimbursed to County funds ,
are available for eligible uses. The land, or the proceeds from sale, may be used for one of the following
activities:
1. Purchase land for the development of affordable housing.
2. Increase the Affordable-Workforce Housing Trust Fund earmarked for affordable housing.
3. Sell with the restriction that requires the purchaser to develop affordable housing.
4. Donate to a nonprofit housing organization for construction of permanent affordable housing.
5. Make the property available for use for the production and preservation of permanent affordable
housing.
According to Section 125.38, Florida Statutes, all County departments and Constitutional offices have
been notified of the below-listed surplus properties, and no county purpose has been identified for the
below listed current inventory. No new parcels have been added to the listing since 2010. The Board of
County Commissioners may fix a price that is nominal or the actual value of the property and set such
price in a resolution. No advertisement is required.
The Board of County Commissioners also has the option to dispose of said inventory and return the
monies to the General Fund after appropriate department funds are reimbursed, or to maintain the
attached listed inventory as County assets.
The subcommittee of the Community Housing Plan Stakeholders Committee that is working on location
of currently owned parcels that may be suitable for housing reviewed the County’s existing surplus
properties list appropriate for affordable housing and make the recommendations noted in the following
table.

Currently, staff and the committee find no additional parcels to add to the existing surplus properties
list appropriate for affordable housing.
FISCAL IMPACT: The sale of surplus land would reimburse all the County funds.
LEGAL CONSIDERATIONS: Section 125.379, Florida Statutes, requires that the County prepare,
and this Board review, an inventory list of all property within Collier County -owned by Collier County
that is appropriate for affordable housing. The list is to be updated every three years. The Board is free
to revise the inventory list and eliminate any parcels it does not wish designated for use as affordable
housing. For those parcels, which are on the inventory list, the Board can elect the way such parcels
will be utilized for affordable housing. As the statute provides, the Board may (1) sell the parcel and
use the proceeds to purchase land for the development of affordable housing or to increase the local
government fund earmarked for affordable housing; (2) sell the parcel with a restriction that requires
the development of the property as permanent affordable housing; (3) donate the parcel to a nonprofit
housing organization for the construction of permanent affordable housing; or (4) otherwise make the
property available for use for the production and preservation of permanent affordable housing.
The attached Resolution, which is required by the statute, is approved for form and legality and
requires a majority vote for Board action. - JAB
