September 13, 2018 Mr. Trecker moved to approve the minutes of the September 13, 2018 as submitted. Second by Mr. Koziar. Carried unanimously 8 – 0. VIII. New Business (this item was heard before Item VII) 2. Water Quality Sub-Committee - Discussion/Update Mr. McAlpin reported:  That the Subcommittee met prior to this meeting and determined it is in the interest of the CAC to address water quality issues in the County.  A list of topics will be developed at their next meeting for consideration by the CAC and the BCC.  The County Attorney will determine if the proposals may require changes to the existing ordinance governing the CAC. Ms. Kinaszczuk presented the PowerPoint “Collier County Pollution Control Roles & Responsibilities” noting:  That the Department is responsible for Pollution Control, Water Quality Sampling, Education and Outreach, Pollution Investigation, Wellfield Protection, Laboratory Analysis, etc.  The goal is to protect County water sources, ensure a viable economy and enhance the quality of life of the residents.  The Department programs include stormwater permit compliance, the Fertilizer Ordinance, Pollution Prevention Ordinance, environmental reviews and enforcement actions, public outreach and education, etc.  In FY18, 83,730 water sample analyses were conducted in the County’s 57 WBIDs (Water Body Identification) with 19 found to be impaired for various parameters. CAC December 13, 2018 VI-1 Approval of Minutes 2 of 5 October 25, 2018 3  Additionally, the County has three WBIDs that have TMDLs, (Total Maximum Daily Load) above the amount of a specific pollutant allowed to be discharged into a water body (Lake Trafford, Cocohatchee River, and Gordon River Extension).  They are also involved in the Red Tide issue and it is important to ensure any solutions to the problem are science based as opposed to emotional. As an example, studies indicate the red tide outbreaks are greater the year following a hurricane, however the reason is undetermined at this point. VII. Staff Reports 1. Expanded Revenue Report The Committee reviewed the “Collier County Tourist Tax Revenue FY 18 TDC Revenue Report” dated through September 30, 2018. Mr. McAlpin reported that the BCC did approve the use of $250,000 Tourist Development Council funds for use in marketing to address the red tide issue. 2. USACE Feasibility Study – Update Mr. McAlpin reported:  That a planning meeting was held on October 24th with the USACE, who has approved a $3M feasibility study in Collier County for a needs assessment on coastal planning.  The study is not intended to preempt the Coastal Resiliency Plan currently being conducted by the County, but rather augment the work.  A follow up meeting will be held on November 7th to determine the ground rules for developing the plan and will be attended by various interested agencies (Florida Fish and Wildlife Conservation Commission, Florida Department of Environmental Conservation, etc.).  The plan is anticipated to be developed over 18 months and would entail issuance of a 50 year grant to the County. A Perpetual Easement will be required in order for the County to complete any necessary work on private property. Turkey Bay Dredging Mr. McAlpin reported:  The proposed dredging of 3 areas in the bay to improve navigation was approved by the BCC.  The work is anticipated to remediate the issues for approximately 2 years and be paid out of the General Fund with reimbursement due by the MSTU being formed to address the issue over the long term. VIII> New Business 1. H&M Work Order * Backup Material Mr. McAlpin presented the Executive Summary “Recommendation to approve proposal dated October 12, 2018, from Humiston & Moore Engineers to update the 2018 Aerial Image Book and complete the Wiggins and Doctors Pass monitoring reports under Contract No. 15-6382, authorize the Chairman to execute the work order for a not to exceed amount of $15,898.25, and makes a finding that this expenditure promotes tourism” dated October 25, 2018, for consideration. The aerial imaging will be used to assist the County in planning beach projects. Mr. McAlpin presented the Executive Summary “Recommendation to approve removal of dune plantings from the approved temporary construction language for the Marco Island Central Beach Regrade project and make a finding that this activity promotes Tourism” dated October 25, 2018 for consideration. He noted:  That a presentation was made to the Marco Island City Council regarding the proposed project on October 1st.  Staff is recommending the dune plantings be removed from the standard easement agreement executed with private property owners due to concerns over the planting blocking views of the ocean.  The work is to address ponding of water on the beaches, not storm surge which will be addressed in the next phase via the long term resiliency plan for the area. Mr. Brown moved to recommend the Board of County Commissioners approve removal of dune plantings from the approved temporary construction language for the Marco Island Central Beach Regrade project and finds this activity promotes tourism. Discussion and coordination of Sub-Committee input into roles and responsibilities with respect to Coastal Water Quality issues: Mr. McAlpin noted that he prepared a document for review under Item VIII.2 based on the previous Subcommittee meeting and subsequent individual input from the Members. 2. Coastal Advisory Committee Request Mr. McAlpin presented the document “The Coastal Advisory Committee is requesting that Section 2-887. - Function, Powers and Duties of Ordinance 2001-3 and amended in Ordinance 2001-14 establishing the Coastal Advisory Committee to be amended” The Subcommittee reviewed the document and recommended the following changes: #1 - Line 3 to read – “The objective of this effort is to share information on common problems,…” #2 - Line 8 to read – “… and red tide and that affect the bays, estuaries, inlets and shoreline.” #3 - Line 2 to read – “….capital and maintenance costs estimates…” #4 - Line 1 to read – “Identify concerns and propose long term situations solutions and programs that…” #5 - Bullet point 2 to read - “Determination of n Nutrient levels in recycled and reclaimed water supplies” #6 - Line 1 to read - “Organize Workshops with the Board of County Commissioners to define November 8, 2018 3 Water Quality issues and CAC responsibilities. #7 - Addition of language - The activity is intended to promote tourism. The specific expenditure must be in compliance with applicable State Statutes and Local Ordinances (or similar language). Ms. Penniman moved to approve the draft subject to the above referenced changes. Second by Mr. Roddy. Carried unanimously 3 – 0. Mr. McAlpin noted: • That he will revise the draft based on the comments provided today and disseminate it to Subcommittee Members for final individual comment and bring the item forth to the full Coastal Advisory Committee at their next meeting. • The Executive Summary accompanying the request will provide language indicating the intention is for the Coastal Advisory Committee responsibilities include water quality. Announcements Mr. McAlpin reported: • That a meeting was held with the US Army Corps of Engineers on November 7th where the scope of the plan they are funding was discussed. • The goal of the plan is to provide solutions to protect upland structures from sea level rise and storm surge and may include structural options. • A conceptual plan is anticipated to be ready in 90 days with the final plan completed in one year. • There will be a public meeting held on December 6th to garner public input on the plan. EXECUTIVE SUMMARY Recommendation to approve a professional services Work Order with APTIM Environmental and Infrastructure, Inc. for a not to exceed cost of $73,889.80 under Contract 15-6382 to support Collier County during the preparation of the Feasibility Study performed by the United States Army Corps of Engineers for the Collier County Hurricane and Storm damage Reduction (HSDR) project, approve all Budget Amendments and make a finding that this item promotes tourism (Project 80366). OBJECTIVE: To provide technical support to allow the U.S. Army Corps of Engineers (USACE) and Collier County to cooperatively investigate long term federal shoreline protection within Collier County, Florida. CONSIDERATION: An April 30, 1992 resolution adopted by the Committee on Public Works and Transportation, United States House of Representatives, in accordance with Section 110 of the River and Harbor Act of 1962, Public Law 87-874, authorized a survey of the shores of Collier County, Florida and adjacent shorelines, in the interest of hurricane protection, storm damage reduction, beach erosion control, and other related purposes. The Bipartisan Budget Act of 2018 (BBA), Public Law 115 -123, enacted February 9, 2018, authorized the Federal Government to conduct the study at full Federal expense to the extent that appropriations provided under the Investigations heading of the BBA 2018 are available and use for such purpose. On September 11, 2018 the Board approved (Item 16A26) the submittal of an agreement between the Department of the Army, US Army Corps of Engineers and Collier County for the Feasibility Shoreline Protection Study. On October 9, 2018 an agreement was executed between the County and the USACE to execute this study. This agreement will target the completion of the feasibility study within 3 years at a total cost of no more than $3 million. After execution of the agreement, a Project Management Plan will be developed and agreed upon by Collier County, FL and USACE. APTIM Environmental and Infrastructure, Inc. along with Collier County staff will provide the professional services for technical support, conceptual plan development and agency coordination to assure that Collier County’s resiliency program, shoreline protection and storm surge reduction goals are incorporated throughout this study and incorporated into the USACE preferred plan for agency approval. This activity is anticipated to continue through the submittal of the USACE preferred plan which is anticipated to occur in September 2019. FISCAL IMPACT: Funding is available in TDC Fund 195 Project No 80366 to accomplish this project. Grant Funding for this activity may be solicited through the Florida Department of Environmental Protection. ADVISORY COMMITTEE RECOMMENDATIONS: At the November 26, 2018 Tourist Development Council meeting this item was recommendation for approval by a unanimous vote of 9 to 0. The Coastal Advisory Committee (CAC) will review this item for recommendation for approval at their December 13, 2018 meeting. Aptim Environmental & Infrastructure, Inc. (APTIM) will provide the professional services described below as required by Collier County during the first 12 months of the Feasibility Process, through the Scoping phase and Alternative Evaluation Analysis phase, until the Tentatively Selected Plan is identified. SCOPE OF SERVICES Task 1. Technical Support and Assistance APTIM will provide historic Collier County beach nourishment reports and data to the Corps to assist them in development of the Feasibility Study. It is assumed that this information will be readily available from APTIM’s and the County’s files, as they are already being compiled for the County’s Coastal Program History project. In addition to addressing the Corps’ data needs, APTIM will familiarize Corps planning, engineering, and environmental staff on the Collier County beach program since the 1990’s and the unique environmental setting that influences the coastal protection approach. APTIM has technical experience in all aspects of the Corps planning process, which we will use to advise the County on technical matters including: planning, design and optimization criteria, parking, access, cost apportionment, project partnership agreements, easements and other technical matters. Task 2. Agency Coordination & Meetings In support of the Feasibility Study process, APTIM will help coordinate, prepare for, and attend planning meetings (also referred to as “charettes”) with County and Corps staff and stakeholders. One APTIM representative will participate in these meetings, which are anticipated to be held within Collier County at locations and on dates to be determined by County and Corps staff. APTIM will also participate in regular Project Delivery Team (PDT) meetings via conference call, as well as any other conference calls requested by the County and Corps. APTIM engineers and biologists will assist the County and Corps with any coordination with local, state, and federal agencies during the Feasibility Study process. This task may include one in person meeting in Tallahassee with FDEP staff. Task 3. Conceptual Plan Development APTIM will support the County in meeting their coastal resiliency goals by contributing to the conceptual plan development with the Corps. Our engineers, geologist and biologists will provide technical analyses, plan formulation, engineering and scientific services to supplement the Corps effort and technical review of Corps documents. This support will be directed towards assisting in the development of a federal project that maximizes the County’s resiliency goals, identifies and develops any components of their preferred resiliency program beyond that covered by the Corps’ recommended project, and maximizes the cost effectiveness in implementing a combined project. The monument locations will be overlaid along with the names of existing structures as noted in the 2018 book. The rectified images will be the latest available from the County Appraiser's Office. The ECL, latest MHWL, and vegetation line will be shown along with the distance from each to the 2003 Baseline. A CD/DVD will be supplied containing the pdf file for the book and a total of three hardcopies will be supplied. Task Option B1.
