I just found out that the Collier County Planning Commission approved the addition of an Alcohol and Drug Rehab service to the church use. As you may know the neighborhood is against the conditional church use in the residential neighbor hood. This rehab use was not on the proposal presented to the neighborhood information meeting a few months back and there were many limitations and changes shown on that proposal. The limits set didn't help to make the project wanted by the area and that was supposed to go as it was to the CCPC. They made changes that were not made known and the CCPC approved it to pass on to your meeting on the 13th of this month. I don't see how the rehab condition can be added at the last minute. There must be certification requirements needed as well as state and federal requirements. I don't know if those questions were even brought up. Churches usually don't have in house rehab. Just a list of people to send troubled souls to where they can seek help. Most didn't go to the meeting as the thought was the proposal shown at the neighborhood meeting was what was to be voted on at the 1 CCPC meeting on the 20th of Sept. Its as tho the CCPC just wanted to be shed of the problem and pass it on to you. Even the county Attorney recommended not to approve the conditional use. I am sure that you know that this is not the first time a conditional use has been attempted. I know it has been tried at least twice before and voted down. Please do the right thing and do not allow this conditional use to pass. I just found out that the planning commission had approved additional changes to the use the Grace Romanian Baptist Church wants for the proposed church. I was told the planning commission allowed an Alcohol and drug rehab use to the site. How can they think to allow that when the church use isn't even wanted in the residential neighborhood? I am sure there are special license and state and federal requirements needed as well. This use wasn't even mentioned at the neighborhood information meeting about the second revision before the planning commission met. I don't know if that question even came up at their meeting. They seem to be adding anything they can to make this go thru. And the planning commission obviously doesn't care one way or the other to allow that use to be added to the original proposal and just wanted to be shed of it. Please do not allow this or any conditional use for this residential area. I know you all are aware the neighborhood is totally against it as was for the previous times conditional uses were proposed. Again please don't allow this. Would you like drug rehabilitation center next to your home? 1 Do you think its in your neighborhoods best interests to have drug rehabilitation and traffic associated with a church? We have seen no plans of the actual building,just plotted land and parking, septic drain field. There was an environmental study completed? How did they forget the land purchased for a supply well by Collier County off 1st Ave SW less than 100 feet away from proposed church drain field. A seating capacity of 300 on septic system is not acceptable for anyone in the vacinity using well water for drinking supply that would be everyone. Is there room for a sewer water treatment plant on the subject property? No sewer available, should not be allowed. Grace Romanian Baptist Church had another piece of land rezoned conditional use, they sold it. I appose anything other than residential estates, keep it residential estates. This is the gateway to the Golden Gate Estates. My husband and I have owned our home on 1st Avenue SW since January of 2004. In that period of time we have seen the expansion of the Estates Naples Kingdom Hall Church at 3480 Golden Gate Blvd West, the closure of the access road from Golden Gate Blvd to Webber, and now the new Church that is slated to be constructed on the SE corner of Webber and Golden Gate Blvd. 1 We already have the following on our street: Cypress Wood Presbyterian Church Estates Naples Kingdown Hall Church Max A. Hasse Jr. Community Park Big Cypress Elementary School All of these are within 1/2 a mile of the site where the new Church is being built. We are already subjected to morning and afternoon traffic, and cars parked on our street (to the point that our home cannot be accessed from 2:45pm until 3:15pm) due to the school. There is also traffic all day long due to the park and the 2 Churches. The Estates Naples Kingdom Hall Church has services during the week as well as the weekend. In addition, due to the closure of the left hand turn on to Webber from Golden Gate Estates when heading east, now our street has become a cut through to get to Webber. In the morning at 7:00am there are cars driving 50 miles an hour down our street. This happens from 7:00am to about 9:00am as people are heading to work and then later in the afternoon for either picking up children at Max Hasse or cutting through to Golden Gate Blvd. Once a month on Saturday the Park has a yard sale that last from about 8:00 until 2:00pm. I walk every morning from my home at 3530 1st Avenue SW to 5th Avenue SW, and it has become extremely frightening as the traffic on 1st Avenue SW and the traffic on Webber is excessive, and for the most part everyone is speeding and none of these individuals live on either Webber or any street off Webber. You are now letting another Church be built on an already congested 1/2 a mile radius and honestly do we need another Church so close to the other two? If people are coming from the East to attend the new Church on the corner of Webber and the Blvd, and if there is an entrance on 1st Avenue, then they will be coming down 1st Avenue SW to access the Church. More traffic on our street and more traffic on Webber. We did not move out to Golden Gate Estates to live next to a drug and rehab center, that I am assuming will have 24 hour access, or 3 Churches within a 1/2 mile radius. 2 Please put yourselves in our shoes and think "would you like to have this much congestion in your neighborhood"? I am writing to you because I will be unable to attend the meeting November 13th referencing the RBC meeting. I live at 3521 1st Ave SW, Naples FL, immediately to the west of the Jehovah Witness Church. I appeared before the CCC office years ago to fight the expansion of this church. I needed a super majority to stop the expansion and got it 4- 1! But,The Jehovah Church threw their money and attorneys at you, threatened to sue and you collapsed like a tent. Mind you, none of you were on the CCC at the time. Point, you didn't stand for your constituents. 1 A few years have gone by,the expansion happened and so have the lies by the JWC.The nightly traffic on 1st Ave Sw is horrific between 7 p.m.-10 p.m from church traffic,then you throw in Max Haase Park traffic, we need speed bumps to control it! It will be a major MISTAKE for you to allow this to happen. The traffic,the lies of what they say they will do and what they really do,won't happen. Since no CCC will be there to watch these rules being broken,the will continue as they do at the Jehovah church. We will have two churches in one block in the estates,this is totally unacceptable and cannot be allowed. I am a Christian and attend Centerpoint Community Church, so it's not religious for me, it's about actual experience with noise, cars, car alarms and cars utilizing a gate that is supposed to be locked on 1st Ave SW. Etc, etc. I will also mention the school traffic everyday in the morning and afternoon, backed up to Weber Blvd most days where we can't even drive on our own street to get home. I implore you to stop this, i tried to fight and won but lost in the end because the CCC didn't stand up for their constituents, my neighbors expanded their church and attend six night a week until 10 p.m. feel free to come sit in my driveway to experience what we deal with every night! Now add another church at the other end of the street? This will only get worse with the addition of another church within our neighborhood. Please do not allow,you didn't listen once to us with the Jehovah, it's time to listen now for our neighborhood sake! Based on regulations, the County could not support the installation of stop signs at the locations suggested. This is based on requirements of the Manual on Uniform Traffic Control Devices (MUTCD). The MUTCD is incorporated by reference in the Code of Federal Regulations and shall be recognized as the national standard for all traffic control devices installed on any street, highway, bikeway, or private road open to the public travel. Below, you will find a snipped portion from the manual as it relates to multi-way stops: If I may suggest the Standing Oaks PUD, Ordinance 08-30. In that PUD,the developer was required to build lane deflections. I will caution that the language within the PUD is very specific regarding design requirements, which unfortunately standards have changed since its original adoption. Also, we have run into some issues with the requirements of landscaping, who will maintain, how it will be watered, etc. The ROW width on Oakes is larger than Weber which could be a limiting factor, but I think this is an option for your consideration. Additionally, I'd indicated the inclusion of the 'gap' segment did not appear to have an unambiguous statutory basis in Florida law. It was asserted by Staff that the University of Florida Shimberg Center was the subject matter expert in this regard so I reached out to a Ms Anne Ray at the Shimberg Center. Subsequently, she referred me to the the Florida Housing Coalition for additional clarification to these important issues. Attached below is a response from Ms Pamela Jo Hatley from the Florida Housing Coalition. I believe the questions I'd posed and her responses are self-explanatory. In sum, I conclude the following from her email reply: -There appears to be no statutory basis for the inclusion of HOA fees in the determination of housing burden. That said, as Ms. Hatley clarified, counties are free under their 'home rule' authority to include these costs in the determination of housing burden should they determine it is in their economic self-interest to do so. 1 -The inclusion of the 'gap segment' referenced in FL380 pertains to developments of regional impact(DRIs). This particular statute appears to be a development specific element and does not appear to convey an obligation on any county to include the entire 'gap' income segment as part of their Community Housing Plan. I did not ask Ms Hatley if counties are able to include such an income segment in their housing plan based on their 'home rule' authority as they are able to assert for the inclusion of the HOA fees in housing burden determination. I assume that to be the case. I offer these additional insights for your consideration as the Board of County Commissioners moves forward with the details of the Community Housing Plan. Should the County leadership conclude both elements are in the County's economic self-interest, it would be my opinion the rationale for such decisions should not be positioned as required by state-level statutory obligations. A.: I am not sure what the legislative intent was in defining "affordable" differently. Section 420.0004 is part of the State Housing Strategy Act, and defines affordable as "monthly rents or monthly mortgage payments including taxes, insurance, and utilities do not exceed 30 percent of that amount which represents the percentage of the median adjusted gross annual income" for households defined as extremely-low-, low-, moderate, or very-low-income households as defined in that act. Section 420.9071 is part of the State Housing Initiatives Partnership Act, and defines affordable as "monthly rents or monthly mortgage payments including taxes and insurance do not exceed 30 percent of that amount which represents the percentage of the median annual gross income" for low-, moderate-, or very-low-income households as defined in that act. So the definitions differ not only in that one includes utilities and the other does not, but also in that the State Housing Strategy Act definition is based on "median adjusted gross annual income" for four household income categories as defined in that act, and the SHIP definition is based on "median annual gross income" for three household income categories as defined in that act. To determine cost burden, the county would apply the definition that applies to the program. So if you are talking about the SHIP program,the definition at s. 420.9071 would be applied. Q.: "Additionally, I'm wondering if other costs such as HOA fees are included in the cost burdened methodology and, if these costs are used, where in the Florida statutes there is justification for such costs to be included." 2 A.: The statutory definitions do not include HOA and condo assessments; hence those costs are not required to be included. Nevertheless, local governments in Florida might have discretion under their home rule authority to include those costs if the governing body finds it in the public interest to do so. Q.: " FL 380.0651 (h) there is a reference to county obligations to support workforce housing up to 140% of the area's median income if located in a county in which the median purchase price of a single family existing home exceeds the statewide median purchase price of an existing single family home. I'd like to know which counties in Florida would meet this threshold and if all these counties are compliant with this obligation to include this income segment in their housing plans for their respective county. In reading the statute it's not clear, at least to me,how this statute conveys an unambiguous obligation on a particular county for an entire income class of residents, e.g., 121-140% of the county's AMI, should their respective county's median single-family home price of an existing single-family home exceed the state median sales price for an existing single-family home. Perhaps you can help clear up the legal basis for such an inclusion." A.: The statute is s. 380.0651(3)(h). This statute applies to Developments of Regional Impact. Essentially, if a developer dedicates at least 15 percent of residential dwelling units authorized by the DRI to affordable housing (workforce housing as defined in the statute),the number of residential units allowed is increased. Your question appears to be "what is the legal basis for such an inclusion?" The state legislature, under its constitutional authority, has adopted legislation setting out statewide guidelines and standards, with applicable fixed thresholds,that all local governments must apply to DRIs within their respective jurisdictions. Dear Sir/Madam Golden Gate Estates Area Civic Association (GGEACA) has received your request to hold a community meeting with regarding the proposed project of Grace Romanian Church. GGEACA understands this project to be applying for a Zoning Change, Growth Management Plan Amendment and a Golden Gate Master Plan Amendment. We appreciate being included in the proposed changes that may affect the Estates community. We have taken the information you have provided and evaluated it with our group. Concerns for traffic and the need for comprehensive planning in the community are the purpose for the Golden Gate Area Master Plan Restudy. Amending the Growth Management Plan through amendments like this is counter to the comprehensive planning being undertaken. As well, there are serious concerns with this project's traffic circulation, traffic impacts to the area, and the impacts to the gateway to Golden gate Estates At this time we have come to the conclusion that it is inappropriate to meet with your group concerning this project. The reason we have come to this conclusion is that the Golden Gate Master Plan is currently undergoing a comprehensive update and we feel it is inappropriate for this project to be considered during the update process.
