EXECUTIVE SUMMARY
Recommendation to adopt an ordinance establishing security measures for retail gas stations to
help prevent the use of credit card skimmers.
OBJECTIVE: To require gas station owners and operators to place security measures on each gas pump
designed to prevent the installation of credit card skimmers in order to protect the public against credit
and debit card fraud.
CONSIDERATIONS: Many communities in southwest Florida have had a steady increase of instances
of credit card skimmers being placed in fuel pumps. These are illegally installed devices which capture
and steal the customer’s payment card information. Although the Department of Agriculture and
Consumer Services does require some security measures to prevent fuel pump tamper ing, they have
proven insufficient. Additional protections are recommended to secure fuel pumps and protect our
residents and visitors from the theft of their personal financial information.
The proposed ordinance gives several options on the type of security device that can be used, from simple
locks to sophisticated encryption software. It also allows for advances in technology and alternative
methods of protection for our consumers. Many newer stations will have pumps that include technology
and devices that meet the requirements of this proposed ordinance. Other stations will be required to
install devices. As this will take time, it is proposed that this ordinance will become effective on January
1, 2019.
At its October 23, 2018 regular meeting, the Board of County Commissioners authorized the County
Attorney to advertise the proposed ordinance for future consideration.
FISCAL IMPACT: The cost to advertise the proposed ordinance was $336.17. If enacted the ordinance
would have minimal costs to retail gas stations.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. - JAK
RECOMMENDATION: To adopt the attached ordinance establishing security measures for retail gas
stations to help prevent the use of credit card skimmers.
