THIS INDENTURE made this 0 JS day of September, 2010, between COLLIER
COUNTY, a political subdivision of the State of Florida (hereinafter referred to as
"Grantor "), and the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
AS THE GOVERNING BODY OF COLLIER COUNTY AND AS THE EX- OFFICIO GOVERNING
BOARD OF THE COLLIER COUNTY WATER -SEWER DISTRICT, its successors and assigns,
(hereinafter referred to as "Grantee "), whose post office address is 3301 Tamiami Trail

That said Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and
other good and valuable consideration to said Grantor in hand paid by said Grantee,

and said Grantor does hereby fully warrant the title to said utility facilities and /or
system(s) or portion(s) thereof, be they realty, personalty, or mixed, and Grantor will
defend such title against all claims of all persons whomsoever. For the purposes of this
conveyance, the utility facilities, system(s) and /or portion(s) thereof conveyed herein
shall not be deemed to convey any of the lands described in either exhibit. Grantor
and Grantee are used for singular or plural, as context allows. A sketch or other graphic
representation showing the location of the utility facilities, etc., being conveyed is
attached as Exhibit B.
TO HAVE AND TO HOLD the same unto the Grantee and its assigns, together with
the right to enter upon said land, excavate, relocate and /or take or introduce materials
for the purpose of constructing, relocating, operating, repairing and /or otherwise
maintaining utility systems thereon. Grantor and Grantee are used for singular or plural,

GRANT OF UTILITY EASEMENT

COLLIER COUNTY, a political subdivision of the State of Florida, whose mailing address is 3301
Tamaimi Trail East, Naples, FL 34112, hereinafter referred to as GRANTOR, and EMBARQ FLORIDA,
INC., d /b /a CENTURYLINK a Florida corporation, whose mailing address is 5454 W. 110th St.
Mailstop: KSOPKJ0902 -RETA, Overland Park, KS, 66211, its successors, assigns, lessees, licensees
and agents, hereinafter referred to as GRANTEE.
WITNESSETH
That for and in consideration of the sum of Ten Dollars ($10.00) and other good and
valuable consideration, receipt of which is hereby acknowledged, the GRANTOR hereby grants
to GRANTEE, its successors or assigns, a non - exclusive easement for the installation of utility
facilities on the property more particularly described on Exhibit "A" attached hereto and made a
part hereof, hereinafter referred to as Easement Property.
TO HAVE AND TO HOLD the easement hereby granted unto said GRANTEE, its successors or
assigns, for the sole purpose to install, construct, operate, maintain, expand, replace and
remove underground cables and related facilities or structures as are reasonably necessary.
GRANTEE, by acceptance of this easement agrees for itself, its successors, assigns, lessees,
licensees and agents, to maintain said easement and in no way to interfere with or hinder at any
time access to the Easement Property or adjacent lands by GRANTOR, the general public, or
any other party requiring access to any of the property over which said easement is granted.
GRANTEE further agrees that it will at all times use extreme care to restore all grounds to as good
or better condition than found prior to any construction, installation, maintenance or repair work
performed by GRANTEE, or its contractors, successors, assigns, lessees, licensees and agents.
In the event GRANTEE, its successors, assigns, lessees, licensees and agents, shall fail to use
this easement for the purpose of providing data transmission service to the County, this Grant of
Utility Easement shall automatically terminate and the GRANTEE, its successors, assigns, lessees,
licensees and agents, shall vacate, cancel and annul said easement or relevant part thereof by
recording in the Public Records an instrument evidencing said cancellation.
GRANTOR, its successors or assigns, shall upon said vacation, have the right to require
GRANTEE, its successors, assigns, lessees, licensees and agents, to remove any structures, facilities
or improvements from Easement property.
GRANTEE hereby covenants and agrees to indemnify, save, protect and hold harmless
GRANTOR against any loss, damage, injury, debt or expense (including attorney's fees) claimed
or asserted by any person or entity, which claim relates to in any way, no matter how remote, or
arises out of GRANTEE'S installation of facilities or use of the Easement Property described above.
IN WITNESS WHEREOF, the GRANTOR has caused these presents to be executed in its name
by its Board of County Commissioners acting by the Chairman of said Board, the day and year

above in our Real Property File under BMR Records in a folder titled "Goodland Boat Park ".
Documents 1 and 2 do not appear to have been added anywhere in the Real Property File
under BMR Records and should be added to the same Goodland Boat Park folder. For
informational purposes, Goodland Boat Park is the current name for the County -owned
property previously known as Dolphin Cove, and the Agreement and Deed evidencing the
County's purchase are in a folder called "Dolphin Cove." In addition, the "Goodland Water
Main" folder has the water main easement document that reflects the water main installed on
the Goodland Boat Park property. If you think it would provide ease in future searching,
these three folders could be combined into the folder titled "Goodland Boat Park."

This REVOCABLE TEMPORARY LICENSE entered into this 13 day of
2010 by and between COLLIER COUNTY, a political subdivision of the State
of Florida, whose mailing address is 3301 Tamiami Trail East, Naples, FL 34112 (hereinafter
referred to as "County "), and LEE COUNTY ELECTRIC COOPERATIVE, INC., a Florida
non - profit corporation, whose mailing address is Post Office Box 3455, North Fort Myers, FL
33918 (hereinafter referred to as "LCEC "), approving the use of County -owned property for the
purpose of constructing utility facilities.
WHEREAS, LCEC requires the use of County -owned property for the purpose of
constructing, operating, and maintaining utilities, including but not limited to, distribution lines
and other related equipment for fiber optic telecommunications and television purposes, over and
through the property described as follows, to wit;

BY THIS REFERENCE MADE A PART HEREOF
WHEREAS, the COUNTY is willing to approve the use of the Property for such
purposes;
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. The COUNTY herein approves, for Ten Dollars ($10.00) and other valuable
considerations, the use of the Property for the purpose of constructing, operating and maintaining
utilities, including but not limited to, distribution lines and other related equipment for fiber optic
telecommunications and television purposes, over and through the property as more particularly
described above, hereinafter referred to as "Property".
2. The approval of the use of the Property by LCEC shall expire upon grant of a permanent
Utility Easement.
3. Upon completion of the construction of the utility facilities on the property, a permanent
Utility Easement will be granted to LCEC for the 16 foot strip of land wherein the utility
facilities are located. The original, signed and sealed sketch and description of the easement area
shall be prepared by a licensed Florida surveyor and will be provided to LCEC at no cost to
LCEC. Upon the completion of construction, LCEC shall restore the surface of the property to
its original condition.
4. This Revocable Temporary License shall be administered on behalf of the COUNTY by
and through the Collier County Real Property Management Section.
5. LCEC, to the extent permitted by law, and as limited by Section 768.28, F.S., shall
indemnify, save, protect and hold harmless COUNTY against any damages and claims arising by
reason of LCEC's utility installations or the operation of same.
6. LCEC covenants and agrees not to assign this Revocable Temporary License or to permit
any other persons to occupy same without the written consent of COUNTY.
7. The COUNTY and LCEC specifically agree that this Agreement represents a license for
LCEC's use of the property and does not convey any estate in the Property or create any interest
whatsoever.

THIS INDENTURE made this O�SA day of September, 2010, between COLLIER
COUNTY, a political subdivision of the State of Florida (hereinafter referred to as
"Grantor"), and the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA,

GRANT OF UTILITY EASEMENT
This indenture made and executed this 00 lday of �, 2010, by and between
COLLIER COUNTY, a political subdivision of the State of Florida, whose mailing address is 3301
Tamaimi Trail East, Naples, FL 34112, hereinafter referred to as GRANTOR, and EMBARQ FLORIDA,
INC., d /b /a CENTURYLINK a Florida corporation, whose mailing address is 5454 W. 110th St.
Mailstop: KSOPKJ0902 -RETA, Overland Park, KS, 66211, its successors, assigns, lessees, licensees
and agents, hereinafter referred to as GRANTEE.
WITNESSETH
That for and in consideration of the sum of Ten Dollars ($10.00) and other good and
valuable consideration, receipt of which is hereby acknowledged, the GRANTOR hereby grants
to GRANTEE, its successors or assigns, a non - exclusive easement for the installation of utility
facilities on the property more particularly described on Exhibit "A" attached hereto and made a
part hereof, hereinafter referred to as Easement Property.
TO HAVE AND TO HOLD the easement hereby granted unto said GRANTEE, its successors or
assigns, for the sole purpose to install, construct, operate, maintain, expand, replace and
remove underground cables and related facilities or structures as are reasonably necessary.
GRANTEE, by acceptance of this easement agrees for itself, its successors, assigns, lessees,
licensees and agents, to maintain said easement and in no way to interfere with or hinder at any
time access to the Easement Property or adjacent lands by GRANTOR, the general public, or
any other party requiring access to any of the property over which said easement is granted.
GRANTEE further agrees that it will at all times use extreme care to restore all grounds to as good
or better condition than found prior to any construction, installation, maintenance or repair work
performed by GRANTEE, or its contractors, successors, assigns, lessees, licensees and agents.
In the event GRANTEE, its successors, assigns, lessees, licensees and agents, shall fail to use
this easement for the purpose of providing data transmission service to the County, this Grant of
Utility Easement shall automatically terminate and the GRANTEE, its successors, assigns, lessees,
licensees and agents, shall vacate, cancel and annul said easement or relevant part thereof by
recording in the Public Records an instrument evidencing said cancellation.
GRANTOR, its successors or assigns, shall upon said vacation, have the right to require
GRANTEE, its successors, assigns, lessees, licensees and agents, to remove any structures, facilities
or improvements from Easement property.
GRANTEE hereby covenants and agrees to indemnify, save, protect and hold harmless
GRANTOR against any loss, damage, injury, debt or expense (including attorney's fees) claimed
or asserted by any person or entity, which claim relates to in any way, no matter how remote, or
arises out of GRANTEE'S installation of facilities or use of the Easement Property described above.
