AMENDMENT TO AGREEMENT
McDONALD TRANSIT ASSOCIATES, INC.
THIS AMENDMENT TO AGREEMENT ( "Amendment ") is made and entered into this
/3 ;�-- day of i 1 , 2010, by and between McDonald Transit Associates, Inc.,
whose address is 3806 Sandshell Drive, Suite 75, Fort Worth, Texas 76137 ( "Contractor ") and
The Board of County Commissioners of Collier County, Florida, as the governing body of
Collier County ( "County ").
RECITALS:
WHEREAS, the parties entered into an Agreement dated September 15, 2009
( "Agreement "), wherein the Contractor agreed to provide Transit System Service and Support to
Collier County for the Collier County Fixed Route and Paratransit Systems route operated as
Collier Area Transit ( "CAT "); and
WHEREAS, the sole qualified subcontractor providing stretcher Medicaid trips for the
paratransit services for the Contractor has provided notice of its intent to terminate providing
non - emergency stretcher trips due to escalating costs; and
WHEREAS, an evaluation of industry rates for non - emergency stretcher service revealed
that the rates for providing such services in the current contract are more than 60 % less than that
being charged in the surrounding service areas; and
WHEREAS, the parties wish to modify Attachment 3 the Agreement to reflect a desired
increase to the Boarding Rate for Paratransit stretcher services under the Agreement; and
WHEREAS, upon recommendation by the Transportation Administrator and after
reasoned consideration by the Board of Commissioners, the Board finds that this Amendment
enhances the County's transportation system and is in the public interest.
WITNESSETH:
NOW, THEREFORE, in consideration of Ten Dollars ($10.00) and other good and
valuable consideration exchanged amongst the parties, and in consideration of the covenants
contained above and herein, and the fact that all of the above recitals are true and correct and
shall be fully incorporated herein and form part of the basis for this Amendment, the parties
agree as follows:
1. The Boarding Rate for In County and Out of County Vendor Rates currently set forth
in the Agreement as $27.56 is hereby amended and increased to $80.00 per boarding. The rate
per mile of $1.59 shall remain the same.
2. There are no other amendments to this Agreement except those set forth herein. This
Amendment shall only be amended or cancelled by mutual written consent of the parties hereto
or by their successors in interest.
