COLLIER COUNTY, FLORIDA, PROVIDING FOR THE
ESTABLISHMENT OF A CONDITIONAL USE TO ADD A
GOVERNMENT FACILITY LIMITED TO A BUS TRANSFER
STATION WITHIN THE BILL GALLMAN OLDSMOBILE
DEALERSHll' PUD ZONING DISTRICT PURSUANT TO
SUBSECTION 2.01.03.G.l.e. OF THE COLLIER COUNTY LAND
DEVELOPMENT CODE FOR PROPERTY LOCATED IN SECTION
3, TOWNSHll' 50 SOUTH, RANGE 26 EAST, COLLIER COUNTY,
FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 67-1246, Laws of Florida, and
Chapter 125, Florida Statutes, has conferred on Collier County the power to establish, coordinate and
enforce zoning and such business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No.
2004-41, as amended) which includes a Comprehensive Zoning Ordinance establishing regulations for the
zoning of particular geographic divisions of the County, among which is the granting of Conditional
Uses; and
WHEREAS, the Board of Zoning Appeals (Board), being the duly appointed and constituted
planning board for the area hereby affected, has held a public hearing after notice as in said regulations
made and provided, and has considered the advisability of a Conditional Use to add a government facility
limited to a bus transfer station within the Bill Gallman Oldsmobile Dealership PUD zoning district
pursuant to Subsection 2.01.03.G.I.e. of the Collier County Land Development Code on the property
hereinafter described, and the Collier County Planning Commission has made findings that the granting
of the Conditional Use will not adversely affect the public interest and the specific requirements
governing the Conditional Use have been met and that satisfactory provision and arrangement have been
made concerning all applicable matters required by said regulations and in accordance with Subsection
10.08.00.D. of the Land Development Code; and
WHEREAS, all interested parties have been given opportunity to be heard by this Board In a
public meeting assembled and the Board having considered all matters presented.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA that:
Petition Number CU-PL2009-405 filed by Abra Horne, AICP, of Wilbur Smith Associates,
representing Collier County Alternative Transportation Modes Department, with respect to the property
hereinafter described in Exhibit "A", be and the same is hereby approved to add a Conditional Use to add
a government facility limited to a bus transfer station within the Bill Gallman Oldsmobile Dealership
PUD zoning district pursuant to Subsection 2.01.03.G.l.e. of the Collier County Land Development
Code, in accordance with the Conceptual Site Plan described in ExhIbit "B" and subject to the conditions
fOood in Exhibit "C". Exhibits "A","B", and "c" are attached hereto and incorporated herein by
reference.
BE IT FURTHER RESOLVED that this Resolution be recorded in the minutes of this
Board.

CONDITIONS OF APPROVAL
Collier County CAT Transfer Station
CD - PL2009-405
I, The CAT Transfer Station shall be limited to that which is depicted on the conceptual site plan set,
identified as the "CAT Transfer Station Conditional Use" dated August 2009, prepared by Wilbur
Smith Associates. The site plan noted is conceptual in nature for Conditional Use approval. The
final design must be in compliance with all applicable federal, state and county laws and
regulations; and
2. The Department of Zoning and Land Development Review Director may approve minor changes
in the location, siting, or height of buildings, structures, and improvements authorized by this
conditional use as well as all applicable development standards; and
3. Expansion of uses identified and approved within this Conditional Use approval, or major changes
to the approved plan, shall require the submittal of a new conditional use application, and shall
comply with all applicable County ordinances in effect at the time of submittal, including Chapter
10.02.03, of the Collier County Land Development Code, Ordinance 04-41, as amended, for Site
Development Plan (SDP) review and approval; and
4. This CAT transfer station shall be limited in scope to a secondary transfer site. Any designation
of this site as Collier County's "major" (or similar designation) is prohibited. The terms Major
and Secondary transfer stations are defined as follows:
· Major transfer facility:
. Handles most routes (between 60-75%)
. Supervised and publicly owned
. Off-road bus parking and circulation
. Park your car all day and ride transit
· Secondary transfer facility:
. Handles multiple routes (25-40%)
. Supervised and publicly owned
. Off-road bus parking and circulation
. Drop off for passengers
5. This transfer station use shall be added to the existing uses permitted on-site and shall allow the
addition of transfer activities for no more than four CAT fixed-routes.
6. No more than ten, fixed route, p.m. peak hour, two-way, bus trips per hour to Radio Road can be
generated by this transfer station use.
7. The CAT Transfer Station may utilize Davis Boulevard to the extent that the Florida Department
of Transportation design allow the necessary turning movements and operation and safety allows
or warrants.

A RESOLUTION OF THE BOARD OF ZONING APPEALS OF
COLLIER COUNTY, FLORIDA, PROVIDING FOR THE
ESTABLISHMENT OF A CONDITIONAL USE TO ADD A
GOVERNMENT FACILITY LIMITED TO A BUS TRANSFER
STATION WITHIN THE BILL GALLMAN OLDSMOBILE
DEALERSHIP PUD ZONING DISTRICT PURSUANT TO
SUBSECTION 2.01.03.G.l.e. OF THE COLLIER COUNTY LAND
DEVELOPMENT CODE FOR PROPERTY LOCATED IN SECTION
3, TOWNSHIP 50 SOUTH, RANGE 26 EAST, COLLIER COUNTY,
FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 67-1246, Laws of Florida, and
Chapter 125, Florida Statutes, has conferred on Collier County the power to establish, coordinate and
enforce zoning and such business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No.
2004-41, as amended) which includes a Comprehensive Zoning Ordinance establishing regulations for the
zoning of particular geographic divisions of the County, among which is the granting of Conditional
Uses; and
WHEREAS, the Board of Zoning Appeals (Board), being the duly appointed and constituted
planning board for the area hereby affected, has held a public hearing after notice as in said regulations
made and provided, and has considered the advisability of a Conditional Use to add a government facility
limited to a bus transfer station within the Bill Gallman Oldsmobile Dealership PUD zoning district
pursuant to Subsection 2.01.03.G.l.e. of the Collier County Land Development Code on the property
hereinafter described, and the Collier County Planning Commission has made findings that the granting
of the Conditional Use will not adversely affect the public interest and the specific requirements
governing the Conditional Use have been met and that satisfactory provision and arrangement have been
made concerning all applicable matters required by said regulations and in accordance with Subsection
10.08.00.D. of the Land Development Code; and
WHEREAS, all interested parties have been given opportunity to be heard by this Board in a
public meeting assembled and the Board having considered all matters presented.

CONDITIONS OF APPROVAL
Collier County CAT Transfer Station
CU- PL2009-405
I. The CAT Transfer Station shall be limited to that which is depicted on the conceptual site plan set,
identified as the "CAT Transfer Station Conditional Use" dated August 2009, prepared by Wilbur
Smith Associates. The site plan noted is conceptual in nature for Conditional Use approval. The
final design must be in compliance with all applicable federal, state and county laws and
regulations; and
2. The Department of Zoning and Land Development Review Director may approve minor changes
in the location, siting, or height of buildings, structures, and improvements authorized by this
conditional use as well as all applicable development standards; and
3. Expansion of uses identified and approved within this Conditional Use approval, or major changes
to the approved plan, shall require the submittal of a new conditional use application, and shall
comply with all applicable County ordinances in effect at the time of submittal, including Chapter
10.02.03, of the Collier County Land Development Code, Ordinance 04-41, as amended, for Site
Development Plan (SDP) review and approval; and
4. This CAT transfer station shall be limited in scope to a secondary transfer site. Any designation
of this site as Collier County's "major" (or similar designation) is prohibited. The terms Major
and Secondary transfer stations are defined as follows:
. Major transfer facility:
. Handles most routes (between 60-75%)
. Supervised and publicly owned
. Off-road bus parking and circulation
. Park your car all day and ride transit
· Secondary transfer facility:
. Handles multiple routes (25-40%)
. Supervised and publicly owned
. Off-road bus parking and circulation
. Drop offfor passengers
5. This transfer station use shall be added to the existing uses permitted on-site and shall allow the
addition of transfer activities for no more than four CAT fixed-routes.
6. No more than ten, fixed route, at a p.m. peak hour, two-way, bus trips per hour to Radio Road can
be generated by this transfer station use.
7. The CAT Transfer Station may utilize Davis Boulevard to the extent that the Florida Department
of Transportation design allows the necessary turning movements and operation and safety allows
or warrants.
8. The driveway layout on Radio Road may be two, one-way pairs rather than one driveway opening.

The conditional use being sought today would allow the addition of a transfer station
to this property and would provide transfer opportunities for existing CAT bus routes.

Bus passenger transfer facilities are places where a person can get off of one bus and
onto another - typically multiple routes use the site at the same time so that
passengers are waiting for only a few minutes on-site, Having more than one bus
circulating at the same time requires special planning to reduce the potential for
conflicts between cars, buses, and pedestrians, On-site circulation is reviewed and
areas are set aside for passengers to wait safely and to cross driveways in a
predictable manner. Parking areas are designed to provide wide aisles for buses and
separate lanes for cars.
Reasons for making a transfer might include that the person's home is on one bus
route and their office is on another. In addition to arriving at the bus transfer facility
from using another bus, some passengers are dropped off at these transfer facilities
by family members and friends.

The requested conditional use represents is a very small change. An incremental
change,
The staff report states that the "The site is used by CAT for their administration and
operations office; vehicle storage, parking, repairs, maintenance and fueling; vehicle
washing and cleaning." To understand the nature of the request more fully, we
believe that the existing transit activities that occur here each day need to be
described more fully,
Each day the bus operators drive their personal cars to this site, They turn the engines
on the CAT buses early in the morning and inspect the vehicles before leaving to run
their route. Many routes operate longer than a single drivers' shift so a second driver
would arrive later in the day and be driven be a supervisor to a stop to relieve the
earlier bus driver. The fleet maintenance staff also arrives here each day so that they
may conduct regular scheduled service, fueling, and emergency repairs when needed.
All buses are stored here including spare vehicles to replace any vehicles that break
down or are taken out of service, At the end of the day, employees arrive to clean
and wash the vehicles.
In addition to CAT buses, there are paratransit vehic~es._?()_m,E!i3rE!_owned by the _,
----- County ana someare operated-bycontractors. All come to this site on a regular basis
and they do not all look like standard passenger vehicles, County-owned paratransit
and supervisor vehicles are also cleaned and maintained at this site, The paratransit

3A, 3B, 5, and 6 pass by this site already. Based on today's schedule, Routes 3A and
3B stop in front of the CAT facility on Radio Road 20 times each weekday. Routes 5
and 6 stop 34 times each day along Davis Boulevard near this site.
Before considering the requested conditional use, it is important to understand that
43 vehicles (23 CAT buses) are maintained and stored at the CAT facility each night.
The buses and other vehicles depart in the morning and return in the evening. There
are also 6 support vehicles and several county landscaping vehicles that park
overnight at the facility.

use requests that the buses enter the CAT Ops Center and circulate another 200 feet
or so as indicated by the red line.
If the conditional use were approved, these bus routes that already pass by the
facility today would simply enter the site from Radio Road. Having these buses enter
the site would improve passenger and vehicular safety. It would also improve
passenger travel, improve efficiency, and allow CAT staff on-site to monitor passenger

The County needed to relocate both the CAT maintenance facility and bus passenger
transfer facility at the same time. Several studies were conducted to identify a range
of suitable sites for maintenance and bus passenger transfer facilities. The County
conducted a search for a site location that would meet all of CAT's needs and
considered more than 25 sites over a three year period before identifying Radio Road
as the optimal location for the CAT site.

Why was the CAT bus maintenance and storage facility on Radio Road originally
identified for purchase by the county?
Shortly after the conclusion of these studies, the Gallman Oldsmobile site became
available for sale and the seller was willing to meet the county's pressing schedule
and price considerations,
The facility on the Radio Road was deemed a viable proposed site due to its:
Size - the site was potentially large enough for CAT to provide maintenance and bus
passenger transfers at one site thereby saving money and time;
Developed - the site was already cleared and "improved" with buildings suitable for
maintenance and offices; and
Bus Operations - the proposed site is located in the eastern portion of the service
area and could reduce the need for buses to divert considerable distances from
existing routes to transfer passengers,
Criteria for determining the site location included: availability, proximity and quick
access to arterial roadways, cost, proximity and centrality in relation to current
routes, accessibility so that buses can easily and safely turn in and out of the site with
good visi6ility, a6TIity to operate within zoning requirements, and a location that
would accommodate CAT in terms of size over the next 15-20 years (given the rapid
growth of the bus system), The site was chosen because of its existing buildings, fleet
bays, centrally located, uniquely suited,

The primary reasons for considering the Collier Area Transit (CAT) Facility located at Radio
Road facility as a location for CAT passenger transfers include the following:
the bus passenger transfer facility at Collier County Government Center is currently operating
at maximum capacity as it handles the majority of bus transfers - it will continue to serve as
the primary transfer location;
the Radio Road facility is located in the eastern portion of the fixed-route bus service area
adjacent to existing population concentrations and close to future population growth areas;
three existing routes (3, 5, and 6) could operate more efficiently and enable CAT to provide
more reliable on,time performance;
Secondary reasons for considering the CAT Facility on Radio Road include the following
considerations:
the site was purchased for use as a passenger transfer location;
CAT staff on'site creates a more secure and supervised facility;
a covered waiting area is available for inclement weather and summer heat;
there is additional undeveloped land on,site;
passengers without access to cars could reach the CAT offices to get their certifications and

will be from Radio Road where buses will enter and exit the site; and
the Radio Road facility is proximate to the 1,75 interchange and provides easy access for

(Page 10) "The Future Land Use Map depicts the desired extent and geographical
distribution of land uses in the County. Mixed-use categories are used to generally
describe the character of allowed development. Within each of these categories, a
range of uses is permitted based upon specific standards as described in the
Designation Description Section of this Element. These uses include residential,
commercial, industrial, agricultural, recreational, conservation, educational,
community, facility, and public facilities."
There is a gap of about 25,000 dwelling units and 100,000 population identified in the
Future Land Use Element between the County's plans for land use and transportation.
As funding constraints increase, this gap will widen reducing economic opportunities
for Collier County. This gap is particularly significant if the "Hometown Democracy
Initiative" is approved by voters.
TOP: Questions 2 and 4 asked customers to indicate how they got to the bus stop,
and how they traveled to their final destinations from the bus stop. The majority of
customers indicated that they walked (over 60 percent) in both cases. Along with the
demographic information on households without access to a vehicle presented
previously (see page 16), this finding further illustrates the need to continually
coordinate transit planning activities with pathways planning activities, Nine percent
25 percent indicated they transfer to get to their final destination.

To move forward with these plans for the bus passenger transfer facility on Radio
Road, a conditional use approval is being sought. In the Land Development Code,
Collier County has identified specific criteria for reviewing a proposed conditional use
permit. These include findings of consistency with the zoning code and growth
management plan as well as determining that the proposed project is compatible
with the neighborhood and not detrimental to the public welfare.
The existing uses have been at this location for almost two years now and have been
functioning as a good neighbor to the community. Further, the proposed transfer
facility is consistent with the county's growth management plan, The proposed
addition of transfer activity will continue to be compatible with the area and not
introduce any adverse affects on the public welfare.

In addition, the Land Development Code requires that the Planning Commission
determine that all specific requirements for the condition use are met, including
making sure that there are not any outstanding issues concerning vehicular access
and traffic control; the effect the proposed conditional use is expected to have on
neighboring properties in relation to noise, glare, economic, or odor effects; and
compatibility with adjacent properties and other properties in the district.
