EXECUTIVE SUMMARY
Recommendation to approve three (3) State Housing Initiative Partnership (SHIP) Sponsor
Agreements with FL Star Construction, LLC in the amount of $300,000, JLH Sustainable Housing,
LLC in the amount of $150,000, and Habitat for Humanity of Collier County, Inc. in the amount of
$400,000, for the Construction Assistance strategy and allow the Chairman to release the Sponsor’s
note and mortgage upon sale to a homebuyer.
OBJECTIVE: To continue to promote affordable housing strategies for very-low, low, and moderate-
income persons through the SHIP Program.
CONSIDERATIONS: The William E. Sadowski Affordable Housing Act provides funding to local
communities to promote and advance affordable housing initiatives. Funds are generated through
documentary stamp tax on real estate transactions. Under the SHIP Program, Collier County and the City
of Naples receive funds from the State of Florida through the Florida Housing Finance Corporation to
undertake eligible activities.
On September 26, 2017, Agenda Item #11A, the Board of County Commissioners (Board) approved the
amendment to the FY2016-2019 LHAP to include the new Construction Assistance Strategy. On October
10, 2017, Agenda Item 11E, the Board approved a new Construction Assistance Strat egy to benefit
victims of Hurricane Irma. The strategy allows the County to use SHIP funds for the construction of new
affordable housing for very-low, low, and moderate-income households. Each Sponsor will receive
$50,000 per completed housing unit upon receipt of a Certificate of Occupancy. The Sponsor will sell
each housing unit to a Collier County referred applicant. Priority will be given to those persons displaced
by Hurricane Irma who had their homes destroyed or substantially damaged. In additio n, priority will also
be given to those who meet the Special Needs criteria.
Community and Human Services (CHS) staff advertised an application cycle to secure for -profit or non-
profit organizations to implement the new Construction Assistance strategy. CHS staff received four (4)
applications in response, from FL Star Construction, LLC, JLH Sustainable Housing, LLC, Right Built
USA, and Habitat for Humanity of Collier County, Inc. A review panel recommended funding be
awarded to all four (4) applicants. On August 21, 2018, Right Built USA provided notification to CHS
that they would be unable to move forward with the agreement and declined the award.
The following is a summary of each of the recommended awards:
FL Star Construction, LLC operates as a for-profit builder in Southwest Florida. The Sponsor
Agreement provides FL Star with $300,000 to construct six (6) single family homes to provide
affordable housing for all income categories up to and including Moderate (120% AMI) with
priority given to those families displaced by Hurricane Irma.
JLH Sustainable Housing, LLC operates as a for-profit builder in Southwest Florida. The
Sponsor Agreement provides JLH Sustainable Housing, LLC with $150,000 to construct three (3)
single family homes to provide affordable housing for all income categories up to and including
Moderate (120% AMI) with priority given to those families displaced by Hurricane Irma.
Habitat for Humanity of Collier County, Inc. operates as a non-profit in Southwest Florida
serving low income families. The Sponsor Agreement provides Habitat with $400,000 to
construct eight (8) single family homes to provide affordable housing with priority given to those
families displaced by Hurricane Irma.

Once a site is selected, the funds will be secured against the property/Sponsor with a $50,000 note and
mortgage in favor of Collier County. Staff is requesting that upon eventual sale to a homeowner, the
Board allow the Chairman to release the note and mortgage against the Sponsor, without full Board
approval, to allow a new note and mortgage to be recorded against the new homeowner and be executed at
the time of closing. The note and mortgage will be for a period of fifteen (15) years in the amount of
$50,000.
FISCAL IMPACT: The funds are available in SHIP Grant Fund (791), Project 33525. The proposed
action does not have any impact on the General Fund.
LEGAL CONSIDERATIONS: This Item has been approved for form and legality and requires a
majority vote for Board approval. - JAB
GROWTH MANAGEMENT IMPACT: Acceptance of these agreements will allow the County to
expand affordable housing opportunities for its citizens and further the goals of the Housing Element of
the Collier County Growth Management Plan.
RECOMMENDATION: To approve and authorize the Chairman to sign three (3) State Housing
Initiative Partnership Sponsor Agreements with FL Star Construction, LLC in the amount of $300,000,
JLH Sustainable Housing, LLC, in the amount of $150,000, and Habitat for Humanity of Collier County,
Inc. in the amount of $400,000, for the Construction Assistance strategy and allow the Chairman to
release the Sponsor’s note and mortgage upon sale to a homebuyer.

THIS AGREEMENT is made and entered into this [ I day of I,
�018;, by and between Collier County, a political subdivision of the State of Florida, ("COUNTY"
or Grantee") having its principal address as 3339 E. Tamiami Trail, Suite 21 1, Naples FL 34112,
and Habitat for Humanity of Collier County, Iuc., hereinafter referred to as "SPONSOR", a
!private for-profit corporation !existing under the laws of the State of Florida, having its principal
office at 111145 Tamiami Trail East, Naples, FL 34113!.
WHEREAS, the William E. Sadowski Affordable Housing Act adopted by the State of
Florida in 1992 provided a dedicated revenue source for affordable housing in Florida and created
the State Housing Initiatives Pattnership (SHIP) Program; and
WHEREAS, the State Housing Initiative Program is established in accordance with
Section 420.907-9079, Florida Statutes and Chapter 67-37, Florida Administrative Code; and
WHEREAS, the COUNTY is a paiticipant in the State Housing Initiatives Pattnership
Program; and
WHEREAS, pursuant to the State Housing Initiatives Partnership Program, the COUNTY
is undettaking cettain activities to primarily benefit persons or households earning not greater than
120% of median annual income adjusted for family size; and
WHEREAS, the Fiscal Year �016-2019 lr,ocal Housing Assistance Plan, as amended, was
adopted by the Board of County Commissioners on (April 26, 2016, Resolution No. 2016-751; and
WHEREAS, the COUNTY and the SPONSOR desire to provide new construction, in
accordm1ce with this Agreement and the aforementioned Local Housing Assistance Plans; and
