EXECUTIVE SUMMARY
Recommendation to approve an Agreement Authorizing Affordable Housing Density Bonus and
Imposing Covenants and Restrictions on Real Property as a companion Item to the Regal Acres
Parcel B PUDZ-PL20170001733. (This is a companion to Agenda Item 9.A)
OBJECTIVE: To support the affordability of housing in Collier County through the Collier County
Affordable Housing Density Bonus Program.
CONSIDERATIONS: The Collier County Affordable Housing Density Bonus Ordinance No. 90-89,
codified by Ordinance 04-41, as amended, as Land Development Code 2.06, authorizes the Board of
County Commissioners (Board) to enter into an Affordable Housing Density Bonus Agreement with an
owner or developer to encourage the development of additional rental or home ownership housing that is
affordable for Collier residents. The Affordable Housing Density Bonus Agreement shall be a lien on the
property.
On June 28, 2005 via Ordinance No. 2005-36, the County and Habitat for Humanity entered into an
Affordable Housing Density Bonus Agreement for a maximum of 184 residential units at the density of
five (5) units per gross acre on 36.75 gross acres, known as Regal Acres Parcel A.
Habitat for Humanity of Collier County, Inc. owns 23.15 acres known as Regal Acres Parcel B. The
23.15 acres is proposed to be added to the existing Regal Acres Residential Planned Unit Development,
through a PUD Rezone amendment to Ordinance Number 2005-36, increasing the permissible number of
dwelling units from 184 existing residential units on Parcel A to 300 total units on both Parcels A and B
combined allowing for 116 residential units on Parcel B. The owners of Parcel B have requested to enter
into an Affordable Housing Density Bonus Agreement with the Board that will require a minimum of 46
bonus units of affordable homeownership for income qualified families on Parcel B. This request for an
Affordable Housing Density Bonus Agreement will provide a maximum of 116 residential units on the
23.15 acres for a gross density of five (5) units per gross acre on Parcel B. The base density of this parcel
is three (3) units per acre. The owner is eligible for eight (8) additional units per acre but is only
requesting two (2) additional units per acre for a gross density of five (5) units per acre. T he developer
has further committed that one hundred percent (100%) of the homes will be affordable.
The Affordable Housing Density Bonus Agreement is a companion Item to Agenda Item 9.A Regal Acres
RPUD, PUDZ PL20170001733. This matter was heard at the Collier County Planning Commission
(CCPC) meeting on September 6, 2018. The CCPC recommended approval of the Affordable Housing
Density Bonus Agreement on Sept. 6, 2018. The item was brought back as a Consent item on the
September 20, 2018 CCPC meeting to finalize the relocation of a play area and potential basketball court.
The item was approved 6-0 on September 20, 2018.
FISCAL IMPACT: There is no Fiscal impact involved in the approval of the Affordable Housing
Density Bonus Agreement.
GROWTH MANAGEMENT IMPACT: The Affordable Housing Density Bonus Program assists the
County in meeting the goals and objectives of the Housing Element of the Growth Management Plan.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and requires a majority vot e
for Board approval. -JAB
