EXECUTIVE SUMMARY
Recommendation to approve Petition VAC-PI-2010-1595, Marsilea Villas, to disclaim,
renounce and vacate the County and the Public interest in that portion of a 60 -foot wide
easement for roadway as originally recorded in Official Record Book 218, page 274 of the
Public Records Collier County, Florida being located in the southwest quarter of the
northeast quarter of the southwest quarter of Section 13, Township 48 South, Range 25
East, Collier County Florida being more specifically shown in Exhibit A.
OBJECTIVE:
To adopt a Resolution to vacate the County and the Public interest in that portion of a 60 -foot
wide easement for roadway as originally recorded in Official Record Book 218, page 274 of the
Public Records Collier County, Florida being located in the southwest quarter of the northeast
quarter of the southwest quarter of Section 13, Township 48 South, Range 25 East, Collier
County Florida being more specifically shown in Exhibit A.
CONSIDERATIONS:
Petition VAC- PL2010 -1595 has been received by the Engineering Services, Growth
Management Division, Planning and Regulation from Keisha Westbrooke, P.E. of Davidson
Engineering, Inc. as agent for the Petitioner, Jeffery Henning, as Managing Member of CYFL,
LLC, Managing Member of The Emergent Group, LLC as Managing Member for Marsilea Villas
II, LLC. This vacation request is intended to vacate a portion of a 60 -foot wide easement for
roadway not being used at this time and not intended to be used in the future. Letter of no
objection from abutting property owners have been received from all who responded, those who
elected to not respond have been verified of delivery with certified mail receipts from the US
postal service.
FISCAL IMPACT:
Growth Management Division, Planning and Regulation staff has collected a $2,000 'Petition to
Vacate" fee from the petitioner which covers the County's cost of recording and processing the
Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.
ENVIRONMENTAL ISSUES:
There are no outstanding environmental issues.
HISTORICAL ARCHAEOLOG[CAL IMPACT:
There are no historical or archaeological impacts.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved this item for legal sufficiency. This
item is ready for Board consideration and approval. (RNZ)
RECOMMENDATIONS:

RELATING TO PETITION VAC- PL2010 -1595, MARSILEA
VILLIS, TO DISCLAIM, RENOUNCE AND VACATE THE
COUNTY AND THE PUBLIC INTEREST IN THAT PORTION

ORIGINALLY RECORDED IN OFFICIAL RECORD BOOK
218, PAGE 734, OF THE PUBLIC RECORDS OF COLLIER
COUNTY, LOCATED IN THE SOUTHWEST QUARTER OF
THE NORTHEAST QUARTER OF THE SOUTHWEST
QUARTER OF SECTION 13, TOWNSHIP 48 SOUTH, RANGE
25 EAST, COLLIER COUNTY, FLORIDA, AND BEING MORE
SPECIFICALLY DEPICTED ON EXHIBIT "A ".
WHEREAS, pursuant to Sections 336.09 and 336.10, Florida Statutes,
Petitioner, Jeffery Henning, has requested the vacation of the County and the
Public interest in that portion of a 60 -foot wide easement for roadway as
originally recorded in Official Record Book 218, page 274 of the Public Records
Collier County, Florida being located in the southwest quarter of the northeast
quarter of the southwest quarter of Section 13, Township 48 South, Range 25
East, Collier County Florida being more specifically shown in Exhibit A.
WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in the portion of the 60 -foot wide easement for roadway as specifically depicted
in Exhibit 'A' is hereby vacated, extinguished, renounced and disclaimed, and
this action is declared to be in the Public interest and for the Public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of the Resolution in the Public
Records.
This Resolution adopted after motion, second and majority vote favoring
same, this day of 2010.

Hi Stephen,
I found a tiny typo in the Resolution title of the Marsilea Villas VAC (see attached) and I also wanted to confirm
the OR Book and Page No in the body of the Resolution.
In the title of the Resolution there is reference to Official Record Book 218 Page 734, but in the body of the
Resolution, Book 218 Page 274 is referenced. The survey /legal description done by Rhodes has a page number of
734?
If you could confirm the page number so it's advertised correctly that would be fantastic.
I guess one of them may need to be changed.
I tried looking it up in Official Records, but the Recording Dept. told me Book 218 is so old all of the documents
from that book are on microfilm.
If you could let me know when you get a chance I'll send this on its' way :)

Hi Stephen,
I found a tiny typo in the Resolution title of the Marsilea Villas VAC (see attached) and I also wanted to confirm
the OR Book and Page No in the body of the Resolution.
In the title of the Resolution there is reference to Official Record Book 218 Page 734, but in the body of the
Resolution, Book 218 Page 274 is referenced. The survey /legal description done by Rhodes has a page number of
734?
If you could confirm the page number so it's advertised correctly that would be fantastic.
I guess one of them may need to be changed.
I tried looking it up in Official Records, but the Recording Dept. told me Book 218 is so old all of the documents
from that book are on microfilm.
If you could let me know when you get a chance I'll send this on its'
way :)

East, Collier County Florida being more specifically shown in Exhibit A.
WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in the portion of the 30 -foot wide easement for roadway as specifically depicted
in Exhibit `A' is hereby vacated, extinguished, renounced and disclaimed, and
this action is declared to be in the Public interest and for the Public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of the Resolution in the Public
Records.

signed by the Chairman, with the exception of most letters, must be reviewed and signed
by the Office of the County Attorney. This includes signature pages from ordinances,
resolutions, etc. signed by the County Attorney's Office and signature pages from
contracts, agreements, etc. that have been fully executed by all parties except the BCC
Chairman and Clerk to the Board and possibly State Officials.)
