Florida, located In Sections 13, 14, 23 and 24, Township 60 South, Range 26 East, Collier
County Florida being more specifically shown In Exhibits "A-1 through A-12".

To adopt a Resolution to vacate the County and the Public interest in all or part of the 10, 15
and 30-foot wide Roadway Easements as originally recorded in the Public Records of Collier
County, Florida, located in Sections 13, 14, 23 and 24, Township 50 South, Range 26 East,
Collier County Florida being more specifically shown in Exhibits "A-1 through A-1 2".
CONSIDERATIONS
Petition VAC-PL2011-1021 has been received by the Engineering Services, Growth
Management Division, Planning and Regulation from David E. Torres as Managing Member of
Hacienda Lakes of Naples, LLC. This vacation request is intended to vacate all or part of the 10,
15 and 30-foot wide Roadway Easements not being used at this time and not intended to be
used in the future. Letters of no objection from abutting property owners have been received
from all who responded. Certified mail receipts exist for those who elected not to respond.
FISCAL IMPACT:
Growth Management Division, Planning and Regulation staff has collected a $10,000 "Petition
to Vacate" fee from the petitioner which covers the County's cost of recording and processing
the Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.
ENVIRONMENTAL ISSUES:
There are no outstanding environmental issues.
HIS TORICALIARCHAEOLOGICAL IMPACT:
There are no historical or archaeological impacts,
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved this item for legal sufficiency. This
item is ready for Board consideration and approval. A majority vote is required for approval. -5-�
RECOMMENDATIONS:
Adopt the Resolution for Petition VAC- PI-2011-1021 to vacate the County and the Public
interest in all or part of the 10, 15 and 30-foot wide Roadway Easements as originally recorded
in the Public Records of Collier County, Florida, located in Sections 13, 14, 23 and 24, Township
50 South, Range 26 East, Collier County Florida being more specifically shown in Exhibits "A-1
through A-12".
Authorize the Chairman to execute the Resolution and direct the Clerk to the Board to record a

COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
RELATING TO PETITION VAC- PL2011 -1021, TO DISCLAIM,
RENOUNCE AND VACATE THE COUNTY AND THE PUBLIC
INTEREST IN ALL OR PART OF THE 10, 15 AND 30 -FOOT
WIDE ROADWAY EASEMENTS AS ORIGINALLY
RECORDED IN THE PUBLIC RECORDS OF COLLIER
COUNTY, FLORIDA, LOCATED IN SECTIONS 13, 14, 23,
AND 24, TOWNSHIP 50 SOUTH, RANGE 26 EAST, COLLIER
COUNTY FLORIDA BEING MORE SPECIFICALLY SHOWN
IN EXHIBITS "A -1 THROUGH A -12 ".
WHEREAS, pursuant to Sections 336.09 and 336.10, Florida Statutes,
Petitioner, David E. Torres as Managing Member of Hacienda Lakes of Naples,
LLC, has requested the vacation of the County and the Public interest in all or
part of the 10, 15 and 30 -foot wide Roadway Easements as originally recorded in
the Public Records of Collier County, Florida, located in Sections 13, 14, 23, and
24, Township 50 South, Range 26 East, Collier County Florida being more
specifically shown in Exhibits'A -1 through A -12'.
WHEREAS, the Board has this day held a public hearing to consider
Petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in all or part of the 10, 15 and 30 -foot wide Roadway Easements as specifically
depicted in Exhibits 'A -1 through A -12' is hereby vacated, extinguished,
renounced and disclaimed, and this action is declared to be in the Public interest
and for the Public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of the Resolution in the Public
Records.

WHEREAS, pursuant to Sections 336.09 and 336.10, Florida Statutes,
Petitioner, David E. Torres, Manager of Hacienda Lakes of Naples, LLC, has
requested the vacation of the County and the Public interest in all or part of the
10, 15 and 30-foot wide Roadway Easements as originally recorded in the Public
Records of Collier County, Florida, located in Sections 13, 14, 23, and 24,
Township 50 South, Range 26 East, Collier County Florida being more
specifically shown in Exhibits 'A-1 through A-12'.
WHEREAS, the Board has this day held a public hearing to consider
Petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in all or part of the 10, 15 and 30-foot wide Roadway Easements as specifically
depicted in Exhibits 'A-1 through A-12' is hereby vacated, extinguished,
renounced and disclaimed, and this action is declared to be in the Public interest
and for the Public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board
is hereby directed to record a certified copy of the Resolution in the Public
Records.
