EXECUTIVE SUMMARY
Recommendation to approve Petition VAC- PL2011 -1271, 1665 Mainsail Drive, to disclaim,
renounce and vacate the County and the Public interest in that portion of a 200 -foot wide
easement for roadway as originally recorded in Official Record Book 1089, pages 1257-
1263 of the Public Records of Collier County, Florida, and that portion of a 100 -foot +/-
wide easement for ingress /egress as originally recorded in Plat Book 14, pages 33
through 38 of the Public Records of Collier County, Florida, also being located in part of
Section 26, Township 51 South, Range 26 East, Collier County Florida being more
specifically shown in Exhibit A.
OBJECTIVE:
To adopt a Resolution to vacate the County and the Public interest in that portion of a 200 -foot
wide easement for roadway as originally recorded in Official Record Book 1089, pages 1257-
1263 of the Public Records Collier County, Florida, and that portion of a 100 -foot +/- wide
easement for ingress /egress as originally recorded in Plat Book 14, pages 33 through 38 of the
Public Records of Collier County, Florida, also being located in part of Section 26, Township 51
South, Range 26 East, Collier County Florida being more specifically shown in Exhibit A.
CONSIDERATIONS:
Petition VAC- PL2011 -1271 has been received by the Engineering Services, Growth
Management Division, Planning and Regulation from Richard D. Yovanovich, of Coleman,
Yovanovich & Koester, P.A., as agent for the Petitioner, Albert F. Moscato, Jr., as Managing
Member of NM Marco Shores, LLC, A Florida Limited Liability Company. This vacation request
is intended to vacate a portion of a 200 -foot wide easement for roadway and that portion of a
100 -foot +/- wide easement for ingress /egress, not being used at this time and not intended to
be used in the future. Letter of no objection from abutting property owners have been received
from all who responded, those who elected to not respond have been verified of delivery with
certified mail receipts from the US postal service.
FISCAL IMPACT:
Growth Management Division, Planning and Regulation staff has collected a $2,000 "Petition to
Vacate" fee from the petitioner which covers the County's cost of recording and processing the
Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.
ENVIRONMENTAL ISSUES:
There are no outstanding environmental issues.

There are no historical or archaeological impacts.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved this item for legal sufficiency. This

WHEREAS, pursuant to Sections 125.01 and 125.37, Florida Statutes,
Petitioner, Richard D. Yovanovich has requested the vacation of the County and
the Public interest in that portion of a 200-foot wide easement for roadway as
originally recorded in Official Record Book 1089, pages 1257-1263 of the Public
Records Collier County, Florida, and that portion of a 100-foot +/- wide easement
for ingress/egress as originally recorded in Plat Book 14, pages 33 through 38 of
the Public Records of Collier County, Florida, also being located in part of
Section 26, Township 51 South, Range 26 East, Collier County Florida being
more specifically shown in Exhibit A.
WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in the portion of the 200-foot wide easement for roadway and that portion of a
100-foot +/- wide easement for ingress/egress as specifically depicted in Exhibit
'A' is hereby vacated, extinguished, renounced and disclaimed, and this action is
declared to be in the Public interest and for the Public benefit.

BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of the Resolution in the Public

OBJECTIVE:

CONSIDERATIONS:
Petition VAC-PL20110001271 has been received by the Engineering Services, Growth
Management Division, Planning and Regulation from Richard D. Yovanovich, of Coleman,
Yovanovich & Koester, P.A., as agent for the Petitioner, Albert F. Moscato, Jr., as Managing
Member of NM Marco Shores, LLC, A Florida Limited Liability Company. This vacation request
is intended to vacate a portion of a 200-foot wide easement for roadway and that portion of a
100-foot +/- wide easement for ingress/egress, not being used at this time and not intended to
be used in the future. Letter of no objection from abutting property owners have been received
from all who responded, those who elected to not respond have been verified of delivery with
certified mail receipts from the US postal service.
FISCAL IMPACT:
Growth Management Division, Planning and Regulation staff has collected a $2,000 "Petition to
Vacate" fee from the petitioner which covers the County's cost of recording and processing the
Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.
ENVIRONMENTAL ISSUES:
There are no outstanding environmental issues.

WHEREAS, pursuant to Sections 125.01 and 125.37, Florida Statutes,
Petitioner, Richard D. Yovanovich has requested the vacation of the County and
the Public interest in that roadway easement as originally recorded in Official
Record Book 1089, pages 1257-1263 of the Public Records Collier County,
Florida, and that easement for ingress/egress as originally recorded in Plat Book
14, pages 33 through 38 of the Public Records of Collier County, Florida, also
being located in part of Section 26, Township 51 South, Range 26 East, Collier
County Florida being more specifically shown in Exhibits "A-1" and "A-2".
WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in the portion of the roadway easement and that portion of an easement for
ingress/egress as specifically depicted in Exhibits "A-1" and "A-2" is hereby
vacated, extinguished, renounced and disclaimed, and this action is declared to
be in the Public interest and for the Public benefit.

BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of the Resolution in the Public
Records.
This Resolution adopted after motion, second and majority vote favoring

EXECUTIVE SUMMARY
Recommendation to approve Petition VAC-PL2011-1271, to disclaim, renounce and
vacate the County and the Public interest in that roadway easement as originally
recorded in Official Record Book 1089, pages 1257-1263 of the Public Records of Collier
County, Florida, and an easement for ingress/egress as originally recorded in Plat Book
14, pages 33 through 38 of the Public Records of Collier County, Florida, also being
located in part of Section 26, Township 51 South, Range 26 East, Collier County Florida
being more specifically shown in Exhibits "A-1" and "A-2".
OBJECTIVE:
To adopt a Resolution to vacate the County and the Public interest in that roadway easement as
originally recorded in Official Record Book 1089, pages 1257-1263 of the Public Records Collier
County, Florida, and that easement for ingress/egress as originally recorded in Plat Book 14,
pages 33 through 38 of the Public Records of Collier County, Florida, also being located in part
of Section 26, Township 51 South, Range 26 East, Collier County Florida being more
specifically shown in Exhibits "A-1" and "A-2".
CONSIDERATIONS:
Petition VAC-PL2011-1271 has been received by the Engineering Services, Growth
Management Division, Planning and Regulation from Richard D. Yovanovich, of Coleman,
Yovanovich & Koester, P.A., as agent for the Petitioner, Albert F. Moscato, Jr., as Managing
Member of NM Marco Shores, LLC, A Florida Limited Liability Company. This vacation request
is intended to vacate an ingress-egress easement, which goes from Mainsail Drive to preserve
lands owned by the State of Florida and Rookery Bay. Letters of no objection from abutting
property owners have been received from all who responded. Certified mail receipts exist for
those who elected not to respond.
FISCAL IMPACT:
Growth Management Division, Planning and Regulation staff has collected a $2,000 "Petition to
Vacate" fee from the petitioner which covers the County's cost of recording and processing the
Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.
ENVIRONMENTAL ISSUES:
There are no outstanding environmental issues.
HISTORICAL/ARCHAEOLOGICAL IMPACT: 1 7A
There are no historical or archaeological impacts.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved this item for legal sufficiency. This
item is ready for Board consideration and approval. A majority vote is required for approval.

Notice is hereby given that the Board of County Commissioners of
Collier County will hold a public hearing on Tuesday, November 8,
2011 in the Boardroom, 3rd Floor, Administration Building, Collier
County Government Center, 3299 Tamiami Trail East, Naples,
Florida. The meeting will begin at 9 : 00 A.M. The title of the
proposed Resolution is as follows :

NOTE: All Persons wishing to speak on any agenda item must
register with the County Administrator prior to presentation of
the agenda item to be addressed. Individual speakers will be
limited to 3 minutes on any item. The selection of an individual
to speak on behalf of an organization or group is encouraged. If
recognized by the Chair, a spokesperson for a group or
organization may be allotted 10 minutes to speak on an item.
Persons wishing to have written or graphic materials included in
the Board agenda packets must submit said material a minimum of 3
weeks prior to the respective public hearing. In any case,
written materials intended to be considered by the Board shall be
submitted to the appropriate County staff a minimum of seven days
prior to the public hearing. All material used in presentations
before the Board will become a permanent part of the record.
Any person who decides to appeal a decision of the Board will need
a record of the proceedings pertaining thereto and therefore, may
need to ensure that a verbatim record of the proceedings is made,
which record includes the testimony and evidence upon which the
appeal is based.

WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in the portion of the roadway easement and that portion of an easement for
ingress/egress as specifically depicted in Exhibits "A-1" and "A-2" is hereby
vacated, extinguished, renounced and disclaimed, and this action is declared to
