by COLLIER COUNTY, a political subdivision of the State of Florida, having a mailing
address of 3299 Tamiami Trail East, c/o the Office of the County Attorney, Suite 800,
Naples, Florida 34112, hereinafter referred to as "Declarant."
WHEREAS, Declarant is the owner of certain real property situated in Collier
County, Florida, a portion of which Declarant desires to set aside and reserve in
perpetuity for drainage, access and maintenance purposes for the benefit of the public,
said portion more particularly described as follows (and hereinafter referred to as the
"Property "):
See attached Exhibit "A" which is
incorporated herein by reference.
NOW THEREFORE, Declarant does hereby set aside and specifically reserves
the Property for the purpose of constructing, operating, and maintaining drainage
structures and facilities, including but not limited to canals, ditches, swales, earthen
berms, rip -rap and retaining wall systems, underground pipes, and various types of
water control structures, and to construct and maintain a stabilized roadbed facility
capable of providing access for vehicles and equipment for perpetual maintenance of
drainage facilities thereon and adjacent thereto. This Declaration does not create any
interest, right or easement in favor of any private or public utilities.
