OBJECTIVE:
The petitioner is requesting approval of a 4 foot variance
from the minimum required flood elevation of 13 feet to 9
teet for a public bath house within the Pelican Bay PUD
adjacent to the Vanderbilt Beach public beach access.

Looationl The subject project is located on the south west
corner of Vanderbilt Beach Road and Gulf Shore Drive within
the Pelican Bay PUD, immediately to the north of the Ritz-
Carlton Hotel, and east of the Gulf of Mexico, within the
parcel known as County Parking, in Section 32, TownShip 48
South Range 25 East, Collier County, Florida
Phyaioal Description of Lots The subject parcel is
located in the northwest section of the Pelican Bay PUD,
containing approximately 5 acres. A public parking lot is
occupying the east portion of this parcel. There are
mangroves and other protected vegetation on the west portion
of the site. This parcel also contains a lake. The bath
house facility will be located within the western portion of
the parcel.

surrounded on the east and south by Ritz-carlton Hotel, on
the west by the Gulf of Mexico, on the north, acrolls the

9OHSIDERATIONS:
The Flood Damage Prevention Ordinance allows enclosed space
below the flood elevation level to be used for the parking of
vehicles, building access, or storage. A variance may be
granted for other uses, only if: the request is determined to
be the minimum necessary to afford relief; the request shows
good and sufficient cause; that failure to grant the request
would result in exceptional hardship and the granting of the
variance will not result in increased flood heights,
additional threats to public safety, extraordinary public
expense, create nuisances, cause fraud on or victimization of
the public, or conflict with existing local laws or
ordinances.

~LYSISI The staff has forwarded this petition to all
necessary review agencies and their comments have been
incorporated into the analysis and recommendation.
In reviewing a variance, the Board of Zoning Appeals shall
consider all technical evaluations, all relevant factors, and
standards specified within the Flood Damage Prevention
Ordinance and criteria Ita II through "1" listed below. The
Planning staff's analysis follows each requirement or review
criteria.

The danqer that materials may be swept onto other lands
to the injury of others;
Since this property is not within the Coastal High
Hazard area, the actual danger that materials may be
swept onto other land should be minimal. If that were
to happen, due to the small size and nature of the
structure, this danger should be negligible.

In the coastal areas of southern Florida, there is
always danger of flood damage, however since this amall
wooden structure is not intended for habitation it
should not present any danger to life.

As a practical matter the beach bathrooms should be
within a reasonable walking distance from the beach,
therefore there are no alternative locations not subject
to flooding or erosion damage,

The granting of this variance will allow the County to
build a public bathroom facility which is not only
compatible but necessary for a public beach,
The relationship of the proposed' use to the plan and
flood plain management program for the area;

Appeals approve Petition FDPO-93-2 subject to all staff
stipulations.

FDPO Variance Petition Application
RE:
Attached is an application for a variance petition to the
Flood Damage Prevention Ordinance for construction of the
vanderbilt Beach Bath House,
After several alternates were investigated, we have the
agreement with Florida Department of Natural Reaources
Beaches and Shores Di vi 5i on to proceed wi th the design of
this bath house at the location indicated on the attached
drawing, The BBC previously has approved by Resolution
93-194 the construction of the bath house seaward of the
Collier County Coastal Construction control Line,
This' application requelts that approval be given to
constructing the building at elevation 9' NGVD rather than
the 13' NGVD for ZONE AE as specified in the present zoning
ordinance. This variance is requested to reduce the distance
o! ramp required to meet ADA Handicapped standards.
We understand that the review of this variance will include
technical evaluations, relevant factors, and the FDPO
standards and criteria.

1. Technical considerations for this project have been
thoroughly reviewed.
Several site considerations by this office and by the Florida
Department of Natural Resources , Division of Beaches and
Shores have resulted in agreement that this.site is feasible
and considers the back dune area and site vegetation as
reducing the hazards of on the beach construction. The
analysis of building type will consider the sub-surface soil
for pile requi rements and the use of wood construction to
reduce the mass of material subject to flooding hazards.
These considerations may also result in reduced construction
costs.

2. Relevant factors consider the need for this structure
which will include a men's and a women'. bath room both
suitable for the handicapped rating. Today there is no
bathroom facility on this beach which is used by people of
the County and tourist visitors, Because there are no toilet
facilities, the woods are used for a toilet and this causes
an odor in the area. The need for a bathroom is evident from
a health and safety aspect.
3, In consideration of the standard criteria as published
for the FOPC variance, we note the following:
. The danger of material swept to other lands 1s minimal
because of the si ze of the proposed structure and the
distance from adjoining buildings.
. The proposed structure is not intended for habitation
and should present no danger to life.
. The structure could flood under extreme high water
condi tions, However, the pile foundation design will
reduce any damage from flood or erosion.
. The site is within the FEMA ZONE AE (Ele. 13).
We would be pleased to provide any additional information.

WHEREAS, the Petitioner, Collier county Board of County

Legal notice having been published in the Naples Daily News on
September 26, 1993, as evidenced by Affidavit of Publication filed
with the Clerk, public hearing was opened.
Planner Chahram Badamtchian presented Petition FDPO-93-2
requesting a four foot variance from the minimum base flood elevation
of 13 feet to nine feet for a public bath house to be located at the
west end of Vanderbilt Beach Road. He explained the variance is
needed because a handicapped ramp is required and if not approved, the
ramp would be close to 100 feet in length. He concluded with Staff's
recommendation for approval.
Commissioner Saunders closed the public hearing.

WHEREAS, the Petitioner, Collier County Board of County
Commissioners, desires to build a public bath house located
at North Gulf Shore Drive and Vanderbilt Beach Road upon
property more particularly described as set forth in Exhibit
. "A" which is attached hereto and incorporated by reference
herein.
WHEREAS, s,aid bath house is to be constructed at an
elevation of 9 feet (NGVD), thus necessitating a request for
a variance from the minimum base flood elevation of 13 feet
(NGVD) required by Ordinance Number 87-80, as incorporated by
reference into the Collier County Land Development Code
(Ordinance No. 91-102); and
WHEREAS, the Board of Zoning Appeals has held a public
hearing as required by law; has reviewed Petition FDPO-93-2
in accordance with Subsections 18(5), (6) and (7), Ordinance
Humber 87-80" as incorporated by reference into the Collier
County Land Development Code (Ordinance No. 91-102) and has
made a finding that the granting of this petition complies
with the intent and purpose of Ordinance Number 87-80 as
follows: '

I'm here today to ask you to stop delaying and move forward with the beach 1 0 F
facility as designed. n\

For 20 years, I've lived in Naples Park. For the record, the~ples Park Area
Association does not represent the thousands of peop~iving in Naples Park.
It's a social club with about 240 members, mostly r.eyfees, and about 40
percent of them live outside of Naples Park. It's sicrning to think that this
group has been used as a tool by Georgia Hiller to..s-a-y that Naples Park afe \ S
against this facility, which is exactly what she did at the March 8th meeting.
Nothing could be further from the truth. Naples Park is filled with working
families that enjoy the beach on their days off. Their children and
grandchildren grow up spending time on that beach.
We want a food concession. Families on the beach want to be able to keep
their eyes on their children, and they do not want to pack up chairs and
towels and go looking for food. Nobody wants children running around in that
congested street. It's only a matter of time before a pedestrian accident
occurs while we're waiting for this project to get started.
Along Vanderbilt Beach and within walking distance of the beach, it's I've Got
Mine and the Heck with the Rest of You. These are the people who say that
you need to preserve the pristine condition of the beach. That sounds nice,
but it's wall-to-wall high-rises and people there and you cannot just bury your
head in the sand and pretend that some toilets are a solution.
The argument that an attractive beach facility will detract from real estate
values certainly does not hold true in the City of Naples, where some of the
priciest and stable real estate in Southwest Florida sits close to Naples Pier
and Lowdermilk Park. ~

One thing that we're all concerned about ~ the.iblatant political pandering
Jfhat is stalling this project. Call it cronyism if you like, but Georgia Hiller did

take a good deal of money from the condominium next to the public beach,
the Ritz-Carlton, and many of the businesses and people associated with the
Turtle Club. While she should be looking out for the entire community, the
appearance is that she's falling all over herself to please a few.
Commissioner Henning, who has taken campaign donations from the same
folks, maintains that the county should not be involved in this privately-run
food concession. Why not? The county is not up on u.s. 41 telling new
businesses to go away. This isn't even a new business. What about the private
businesses running concessions all over the county? The city of Naples enjoys
the 20 percent share of sales earned by Russell's Clam Bake, the private
business running the Lowdermilk Park and Naples Pier concessions. These
businesses offset the cost of the facilities.
This nonsense about a food concession being anti-free market is just that. A
private business in a beach facility would create the opportunity for a business
person to hire employees.
We've heard that local businesses will be harmed by a food concession, but
this is not a new business. jot.'s aft existing b6lsiness. It will replace the business
on the beach, and hopefully it will be Cabana Dan's in a new location. Right
now a few of the eateries across the street are promoting delivery services on
the beach, and, in violation of the county's own beach ordinance, are not
paying the county anything. Of course they don't want competition! That
might actually resemble a free market!
The citizens of Collier County have a great interest in the beach. There are
324,000 people in the county and the county issued 84,000 beach parking
permits for its 1,800 parking spaces last year. That's a huge number of parking

permits and not many spaces. The demand at this beach is great, but because
of the unfair influence of a few, you're actually considering having the
county's busiest beach be the only public beach without a food concession.
There is overwhelming support for this project all over the county. In addition
to Naples Park, residents in Palm River, Golden Gate Estates, Longshore Lake,
Bay Forest, Eden on the Bay, Bonita Shores, Willoughby Acres, Pelican Marsh,
Autumn Woods, Village Walk, Island Walk, the City of Naples, Marco Island

and more have written to their commissioners in support. Th~ Pelican Bay

The beaches are a tourism draw and our destination is in competition with
destinations throughout the state. A food concession is a real convenience
factor for tourists who do not have as easy access to coolers and supplies as
local residents. The tourists that pay the tax should get a benefit. If you refuse
to accommodate them when they visit your greatest tourism draw - the beach
- quit advertising to get them here.
What's good for the residents of Collier County is also good for tourism. Build
it. Thank you.

from Naples Park, across Vanderbilt Beach Road from Pelican Bay, are saying the
improvements would be welcome,
We tend to agree with them, This new and improved beach-services pod would not
attract more beachgoers; it would better serve the ones already there, We also befieve
there would be plenty of business left for private concessionaires now selling food and
drinks a block or so from the beach. Families who come with children who get hungry
do not consider a trek to those shops to be convenient.
