TRANSCRIPT OF THE MEETING OF THE COLLIER COUNTY
PUBLIC VEHICLE ADVISORY COMMITTEE
Naples, Florida, July 11, 2005
LET IT BE REMEMBERED, that the Collier County Public Vehicle
Advisory Committee in and for the County of Collier, having conducted
business herein, met on this date at 9:30 a.m., in REGULAR SESSION at
the Collier County Development Services Building, 2800 North Horseshoe
Drive, Conference Room #609, Naples, Florida, with the following members
present:

I. Meeting was called to order by Chairman Allen Walburn at 9:30 a.m.
II. Roll call was taken with a quorum established.
III. Approval of Agenda
Tony Marino moved to approve the Agenda with the addition of a
request for appeal from Lucinda Nelson. Second by Russ Berghuis.
Carried unanimously 4-0.
IV. Approval of Minutes: June 6, 2005
Russ Berghuis moved to approve the minutes of June 6, 2005. Second by
Tony Marino. Carried unanimously 4-0.
V. Notices: None
VI. New Business:
New Application: SUNSHINE CAB, INC., Representing Sunshine Cab
was Luckner Etienne. Application is complete.
Allen Walburn moved to approve the application. Second by Randy
Smith. Carried unanimously 4-0.
New Application: SUNRISE V.I.P. SERVICES, INC.
Representing Sunrise was Elson DaSilva. Petitioner seeks approval for
cab service. Application is complete.
Russ Berghuis moved to approve the application. Second by Allen
Walburn. Carried unanimously 4-0.
New Application: PASS RIDES, LLC. Representing Pass Rides was
Dan Jeffers. Petitioner stated two vehicles to be operated now with four
more in the future. Each vehicle must be inspected. Collier County
vehicles must be certified in Collier County.
Randy Smith moved to approved the application. Second by Russ
Berghius. Carried unanimously 4-0.
VII. Hearing: Appeal of Lucinda Nelson
Lucinda Nelson appeared on her own behalf to request a reversal of the Public
Vehicle Advisory Committee's decision regarding her driver's license.
Driver's license was denied because Petitioner had a criminal record.
Petitioner indicated she has been in no trouble for the past six years and would
like her driver's license. Records indicate there have been numerous arrests in
the past six years. It was decided to consult with County Attorney before
rendering a decision.

IX. Complaint Report - John Marsh
Complaint Report was distributed and discussed.
X. Discussion: Proposed Ordinance Revisions - Rate increase for cabs
Rate Increase: Proposed letter for chair signature
Public Speakers:
Dale Schultheis, OwnerYellow Cab. Stated people on fixed income going short
distances would be hurt by proposed change. Could be put on as extra on meter.
Does not think it is sufficient, but sticker shock is going to decrease business;
however, will make drivers happier. Drivers pay cost of fuel. Would like to use
30% oftotal square footage including glass for sale of advertising.
Susan Payne, Alligator Alley Express. Discussed space allowed for signs on
cabs and vans. Stated her service needs customers to be able to identify the
vehicles; her service picks up customers three lanes from the curb. She would
like more identification on top of vans to make it easier for passengers to find
them.
Michelle Arnold suggested taxi and charter companies should have same
standards for both, 30% for all. Stated that space is not intended for sale of
advertising.
(Tom Palmer, Esq., arrived at 10:10 a.m.)
Doug Wilcox, AARON, asked why sedans are excluded from putting name on
vehicles. He is not interested in advertising on sedans.
Public Speaker Session Closed
· Do not make all the same
· Lettering of cabs is approved on a case-by-case basis
· The intent was not to have gaudy vehicles
· Only name of company and company phone number is necessary
· Advertising could be limited on each vehicle
· Address of web sites should be permitted to be displayed
· Logos are fine, need standardized practice.
· Printing should be only on sides
· Side is one geographic area. Back and front would be separate
calculation
· Cannot violate state law
· Limit to sides. Limit size of lettering

Motion discussed
2nd motion Allen Walburn made motion, second by Russ Berghuis (four inch letters
across front...) Motion carried unanimously.
Tom Palmer will redraft ordinance.
Matter regarding Lucinda Nelson was revisited.
County Attorney indicated neither BCC nor PV AC has authority to give
administrative exception. Law requires clean criminal record for past ten
years. Request for appeal was denied.
Discussion of PV AC recommendation that driver identification be renewed each
year.
· It is a dual responsibility
· County should charge what it costs the County
· An initial fee of $50 plus another $50 for each year was suggested
· Lack of knowledge of ordinance is no defense
· Questioned whether County wishes to add an extra charge
· An affidavit is required from driver, not background check
· Falsely swearing on an affidavit is a felony, violator can be turned
over to sheriff and cannot apply for three years so no need for
background check should be necessary
· Affidavit will be yearly plus initial application
