ORDER
Based upon the foregoing,and pursuant to the authority granted in Chapter 162,Florida Statutes,and
Collier County Ordinance No. 07-44,as amended, it is hereby ORDERED:

B. The Board granted a Continuance of this case until February 23,2019.

ORDER

FINDINGS OF FACT
1. Respondent, Araceli Cisneros, is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. At the hearing,the Respondent entered into a Stipulation,which is attached hereto as Exhibit"A". The
Stipulation is adopted as an Order of the Code Enforcement Board and the Respondent is ordered to

Permits.
5. The violation has not been abated as of the date of the public hearing.

Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted in
Chapter 162, Florida Statutes, and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended,
Section 10.02.06(B)(1)(a).
B. Respondent must abate all violations by obtaining all required Collier County Building Permits or
Demolition Permit, Inspections, and Certificate of Completion for the alterations on or before November
21,2018 or a fine of$100.00 per day will be imposed for each day the violation(s)remains thereafter.
C. If Respondent(s)fails to comply with this Order,Collier County may abate the violation using any
method(s)to bring the violation(s) into compliance and may use the assistance of the Collier County
Sheriff's Office to enforce the provisions of this order and all costs of abatement shall be assessed to the
property owner.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$59.84 on
or before September 23,2018.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

Before me, the undersigned, Araceli Cisneros, on behalf of f '. l P1e I , enters into this
Stipulation and Agreement with Collier County as to the resolution of Notices of Violation in reference (case)
number CESD20150014688 dated the 22nd day of July, 2018.
This agreement is subject to the approval of the Code Enforcement Board. If it is not approved, the case may
be heard on the scheduled Hearing date, therefore it is strongly recommended that the respondent or
representative attend the Hearing.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which
a hearing is currently scheduled for c./.5-t-c3{ , CC ; to promote efficiency in the administration of
the code enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein
the parties hereto agree as follows:
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence,

THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of $59.84 incurred in the prosecution of this case within 30

2) Abate all violations by:
Obtaining all required Collier County building permts or demolition permit, inspections and certificate of

fine of$100.00 per day will be imposed until the violation has been abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday, Sunday or legal
holiday,then the notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office
to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property

the violation is abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday, Sunday or legal
holiday,then the notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)

ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162, Florida Statutes, and Collier County Ordinance No.2007-44, as amended,it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41, as amended,
Sections 10.02.06(B)(I)(a), 10.02.06(B)(I)(e),and 10.02.06(B)(I)(e)(i).
B. Respondent must abate all violations by obtaining all required Collier County Building Permits or
Demolition Permit, Inspections,and Certificate of Completion and Occupancy on or before November 21,
2018 or a fine of$250.00 per day will be imposed for each day the violation(s)remains thereafter.
C. If Respondent(s)fails to comply with this Order,Collier County may abate the violation using any
method(s)to bring the violation(s)into compliance and may use the assistance of the Collier County
Sheriff's Office to enforce the provisions of this order and all costs of abatement shall be assessed to the
property owner.

—THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of$561-70 incurred in the prosecution of this case within 30

2) Abate all violations by: Obtaining all required Collier County Building Permit(s) or Demolition
Permit, inspections, and Certificate of Completion/Occupancy for repair of the roof within -
days of this hearing or a fine of$200 per day will be imposed until the violation is abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday, Sunday or legal
holiday,then the notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office
to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property
owner.

Prohibited accessory use without first having a permitted principal/primary use/structure.Unauthorized
outside storage of items including,but not limited to,various pieces of furniture,two recreational

5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended,
Section 2.02.03 and Collier County Code of Laws and Ordinances,Chapter 54,Article VI, Section 54-181
and Chapter 130,Article III, Section 130-96(a).
B. Respondent must abate all violations by removing all unauthorized items currently being stored on the
property to a conforming location and remove all litter from the property to a site intended for final
disposal and restore property to its original permitted natural state on or before August 25,2018 or a fine
of$150.00 per day will be imposed for each day the violation(s)remains thereafter.
C. If the Respondent(s)fails to comply with this Order,Collier County may abate the violation using any

Sheriff's Office to enforce the provisions of this order and all costs of abatement shall be assessed to the

FINDINGS OF FACT
1. Respondent was found guilty of violation of Collier County Land Development Code 04-41, as amended,
Sections 3.05.08(C), 1.04.01(A),2.02.03 and Collier County Code of Laws and Ordinances,Chapter 54,
Article VI, Sections 54-185(D)and 54-179 in the following particulars:
Presence of prohibited exotic vegetation,including but not limited to Brazilian Pepper,Java Plum,Air
Potato,Carrot Wood,Earleaf Acacia and Australian Pine on an unimproved property not zoned Estates or
Agricultural located within a 200 radius of an abutting,improved property.Also observed the illegal outside
storage consisting of but not limited to: man made vegetative debris,televisions,cardboard boxes,chairs,a
Jet Ski,tires,bottles other debris/trash.
ORDER
Based upon the foregoing, and pursuant to the authority granted in Chapter 162,Florida Statutes,and
Collier County Ordinance No. 07-44,as amended,it is hereby ORDERED:
A. The Respondent Motion for Continuance of this case is GRANTED until October 24,2018.
B. All parties shall be re-noticed for the subsequent hearing date.
C. Daily fines shall continue to accrue during the continuance period.

ORDER OF THE CODE ENFORCEMENT BOARD
IMPOSING FINES/LIENS
THIS CAUSE came before the Code Enforcement Board upon the Petitioner's Motion for Imposition
Fines/Liens on July 26,2018,and the Code Enforcement Board,having heard argument respective to all appropriate
matters,hereupon issues its Findings of Fact and Order of Code Enforcement Board,as follows:
FINDINGS OF FACT
1. On February 23, 2017, Respondents were found guilty of violation of Collier County Land Development
Code 04-41, as amended, Section 1.04.01(A) due to an unapproved fold trailer operating/parked on
improved occupied commercial property, which violation(s) occurred on the property located at 102 S
4TH ST, Immokalee, FL, 34142, Folio No. 25581000009 (Legal Description: CARSONS BLK 3 LOTS 6-
9).
2. An Order was entered by the Code Enforcement Board Ordering the Respondents to abate the violation on
or before June 23,2017,or a fine of$100.00 per day would be assessed for each day the violations
continue thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5368,PG 3583).
3. Operational costs of$65.01 incurred by the County in the prosecution of this case were paid.
4. Respondents,having been duly noticed for the public hearing regarding the County's Motion,did appear at
the public hearing,and no legal defense to the Motion was presented.
5. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely filed.
6. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No. 2007-44,as amended,it is hereby ORDERED:
A. Petitioner's Motion for Imposition of Fines/Liens is GRANTED.
B. Daily fines of$100.00 per day for 398 days for the period from June 24,2017 through July 26,2018 are
reduced to$20,000.00
C. Respondents shall pay operational costs for the Imposition of Fines hearing in the amount of$59.42
D. Respondents are ordered to pay fines and costs in the total amount of$20,059.42or be subject to Notice of
Assessment of Lien against all properties owned by Respondent in Collier County,Florida.
E. The daily fines of$100.00 shall continue to accrue until abatement has been confirmed by a Collier County
Code Enforcement Investigator.

UNIT 67 E 75FT OF W 150FT OF TR 45).
2. An Order was entered by the Code Enforcement Board Ordering the Respondent to abate the violation on
or before June 23,2018,or a fine of$200.00 per day would be assessed for each day the violations
continue thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5519,PG 3604).
3. Operational costs of$59.70 incurred by the County in the prosecution of this case were ordered to be paid.
4. Respondent,having been duly noticed for the public hearing regarding the County's Motion,did not appear
at the public hearing,and no legal defense to the Motion was presented.
5. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely filed.
6. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No. 2007-44,as amended,it is hereby ORDERED:
A. Petitioner's Motion for Imposition of Fines/Liens is GRANTED.
B. Daily fines of$200.00 per day are assessed against the Respondent for 33 days for the period from June 24,
2018 through July 26, 2018 for a total amount of fines of$6,600.00
C. Respondent shall pay operational costs for the Imposition of Fines hearing in the amount of$59.28
D. Respondent shall pay previously accessed operational costs in the amount of$59.70
E. Respondent is ordered to pay fines and costs in the total amount of$6,718.98 or be subject to Notice of
Assessment of Lien against all properties owned by Respondent in Collier County,Florida.
F. The daily fines of$200.00 shall continue to accrue until abatement has been confirmed by a Collier County
Code Enforcement Investigator.2
