MINUTES OF THE COLLIER COUNTY
WATER AND WASTEWATER AUTHORITY MEETING
Naples, Florida, September 17, 2018
LET IT BE REMEMBERED, the Collier County Water and Wastewater
Authority in and for the County of Collier, having conducted business herein, met on
this date at 2:00 P.M. in REGULAR SESSION at the Collier County Growth
Management Department Building Conference Room 609/610, 2800 N. Horseshoe
Drive, Naples, Florida, with the following members present:

I. Call to Order(Determination of Quorum) and Roll Call
Chairman Lam called the meeting to order at 2:00 P.M.
Roll call was taken and a quorum established.
II. Approval of Agenda—Meeting of September 17,2018
Ms. Sherry moved to approve the Agenda. Second by Dr. Ritter. Carried unanimously 3-0.
III. Approval of Minutes—Meeting of February 12,2018
Dr. Ritter moved to approve the minutes of the February 12, 2018 meeting. Second by Ms.
Sherry. Carried unanimously 3-0.
IV. Items Requiring Action by Authority
A. North Marco Utility Company Price Index and Pass-Through Application —Craig
Woodward of North Marco Utility was present.
Mr. Kovensky presented a Memo. Subject: "Authority Agenda Item—September 17, 2018
North Marco Utility Company Price Index and Pass-Through Application"dated September
1 I, 2018 for consideration. He noted:
• That the request is for the Authority to adopt the attached Final Order No. 2018-02
(attachment "A"), adjusting the wastewater rates of North Marco Utility Co., Inc.
(NMU) by applying the 2017 Price Index Factor to the allowable 2016 operation and
maintenance expenses,and its amortized pass-through costs for wastewater.
• The Utility applied for a 1 percent increase to its wastewater rates based on the 2017
price index and increases in the purchased wastewater(2.30%) treatment charged by
the City of Marco Island and a 1 percent decrease in the surcharge the City charges.
• Staff reviewed the application and found it sufficient and recommends approval.
Ms. Sherry moved to approve the Request(Final Order No. 2018-02) as presented. Second
by Dr. Ritter. Carried unanimously 3- 0.
V. Staff Discussion
A. Ave Maria Utility Company—Notice of Tariff Updates
Mr. Kovensky reported:
• That the Utility processed a rate case last year which was approved by the Authority.
• A 5%annual increase was approved for 5 years with 2018 being year 2 of the cycle.
• They are not required to return on an annual bases to ratify the increase,however are
responsible to notify the Authority of their intent to impose it on the users.
• The Utility did file the appropriate documents to imitate the new rate in 2018 and the
item is for information purposes only.
Under Authority discussion, the following was noted:
• That the Utility could have requested a higher increase in rates given their financial
status however opted for a lesser amount to ease the financial burden on the users.
• Additionally.they could have sought this year's increase in April, however deferred the
increase until this point in time.
• The Utility continues to lose money and currently is only at approximately 60 percent
capacity.

B. Ave Maria Utility Company-Developer Agreements
Mr. Kovensky reported that the Utility has executed a new Developer Agreement with Maple
Ridge Phase 5B. With this development,there is a remaining capacity at the plants of 1.25
million gallons(MGD) for water and 1.05 MGD for wastewater per day.

VII. Authority Member Discussion
Mr. Kovensky reported that he received an email from Bill Sundstrom of Sundstrom& Mindlin, LLP
dated September 17,2018 updating Staff on the Utility's position on their desire to expand their
service area to serve the Hogan Island development which the County objected to. The County
proposes expansion of the Public Utilities service area in eastern portion of the County to serve this
and other developments. Specifically he stated in the email "II is appropriate that I periodically
communicate to you relative to the above. Basically there is nothing "new"to report. AMUC agreed
to allow Collier County to expand its Water And Sewer District subject to several stipulations which
have the effect of allowing Barron Collier Companies to "opt out"and receive service from AMUC
relative to the Hogan Island parcels, should the parties not be able to reach an amicable settlement of
the issue of water and wastewater service to Hogan Island. Barron Collier has met with the county
staff at least twice since the time of that stipulation with no meaningful movement from the staff to date
on an acceptable arrangement to Barron Collier. The county staff has floated a new proposal, in
concept, but that "concept" has yet to be in any way solidified. Bottom line: we are awaiting the
county's next proposal. If nothing substantive is forthcoming in the next two of three months, I suspect
that we will then demand that the certificate case proceed in earnest. "
He noted the item is for information only so the Authority is aware of the status of Ave Maria Utility
Company's request.
There being no further business for the good of the County,the meeting was adjourned by the
order of the Chair at 2:20 P.M.

COLLIER COUNTY WATER AND WASTEWATER AUTHORITY
A FINAL ORDER OF THE COLLIER COUNTY WATER AND WASTEWATER
AUTHORITY,PURSUANT TO SECTION 1-6,COLLIER COUNTY ORDINANCE
NO. 96-6, AS AMENDED, PROVIDING FOR THE ADOPTION OF THE 2019
PRICE INDEX FACTOR SET ANNUALLY BY THE FLORIDA PUBLIC
SERVICE COMMISSION, FOR UTILIZATION IN PRICE INDEX RATE
APPLICATIONS FOR NONEXEMPT WATER AND/OR WASTEWATER
UTILITIES PROVIDING SERVICE IN UNINCORPORATED COLLIER
COUNTY AND THE CITY OF MARCO ISLAND,FLORIDA.
WHEREAS, Collier County Ordinance No. 96-6, as amended, provides for the
Collier County Water and Wastewater Authority (AUTHORITY) to adopt a price index
factor for water and/or wastewater utilities on or before May 15`h of each calendar year for
the utilization in price index rate application;and
WHEREAS, Collier County Ordinance No. 96-6, as amended, provides that the
price index factor shall be equivalent to the price index factor set annually by the Florida
Public Service Commission(COMMISSION);and
WHEREAS,the COMMISSION issued Order No. PSC-2018-0612-PAA-WS on
December 27, 2018, establishing the 2019 Price Index of 2.36 percent for water and/or
wastewater utilities; to be effective January 15, 2019.
NOW,THEREFORE,IT IS HEREBY ORDERED by the Collier County Water
and Wastewater Authority, in public meeting assembled,that:
1. The 2019 Price Index is 2.36 percent.
2. Any water and/or wastewater utility that intends to increase its rates by
implementation of this price index must notify the AUTHORITY on or after
the effective date of this Final Order of such intent and shall apply the 2019
Price Index to applicable 2018 calendar year operation and maintenance
expenses.
3. Utilities using the 2019 Price Index shall use the foams attached as Appendices
"A", "B", "C" and "D", and shall follow all price index application
requirements specified in Collier County Ordinance No. 96-06, as amended,
before implementing any index.
4. This Order shall become effective upon adoption by the AUTHORITY and
shall remain in effect until the AUTHORITY authorizes a change.
This Final Order adopted this 19th day of February 2019,after motion,second,and majority
vote favoring the same.

APPENDIX "D"
NOTICE TO CUSTOMERS
On February 19th, 2019, the Collier County Water and Wastewater Authority
adopted provisions permitting water and sewer utilities to adjust the rates it charges to its
customers without those customers bearing the additional expense of a public hearing. The
adjustments in rates would depend on increases or decreases in non-controllable expenses
subject to inflationary pressures such as chemicals,and other operational and maintenance
costs.
On , filed notice of intent
with the Growth Management Department (GMD) Operations& Regulatory Management
Division,to increase water and wastewater rates as a result of this action. If acknowledged
and approved by the Collier County Water and Wastewater Authority, water rates will
increase by approximately %and wastewater rates by %. The adjusted
rates should be reflected on your bill.
