AN ORDINANCE OF THE BOARD OF
COIJNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AMENDING
ORDINANCE NUMBER 05-11, THE TRIAD
RPUD, WHICH AMENDED THE COLLIER
LAND DEVELOPMENT CODE ADOPTED BY
ORDINANCE 04-41, AS AMENDED, TO
CORRECT A SCRIVENER'S ERROR IN
SECTION 6.6.8. OF THE ATTACHED &
INCORPORATED PUD DOCUMENT TO
CLARIFY A RENTAL RESTRICTION; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Collier County Board of County Commissioners adopted
Ordinance No. 05-11, on February 22, 2005, pertaining to Petition No. PUDZ-2004-AR-

WHEREAS, following said action adopting Ordinance No.05-II, G¢¡tmty staff'~....

determined that the PUD document incorporated therein by reference ailikattaiiiied ;:'J

thereto was transmitted to the Department of State without clarifying text for~provísi'on
that was otherwise intended to be included and which was otherwise made a part of the
record at the public hearing; and
WHEREAS, the absence of the intended clarifying text in the POO document
now constitutes a scrivener's error.
NOW, THEREFORE, BE IT ORDAINED by the Board of County
Commissioners of Collier County, Florida:
SECTION ONE:
SCRIVENER'S ERROR CORRECTION BY AMENDMENT TO
SECTION 6.6.B., DEVELOPMENT STANDARDS, OF THE
PUD DOCUMENT.
Section 6.6.B. of the PUD Document included as part of Ordinance Number 05~
11, is hereby amended to correct a scrivener's error by amending said section to read as
follows, where underlined text is added and Gtm&!~ettgk text is deleted:
B. The developer. consistent with the reclUirement set forth in Section 6.2. above. shall
place a restrictive covenant or other form of deed restriction on the property to prohibit ª
rental apartment complex rentals on the property in perpetuity, which will be enforceable
by the lot owners residents of Palm Springs Village Unit One and Palm Springs Estates
Unit One subdivisions.
SECTION TWO:
EFFECTIVE DATE.
This Ordinance shall become effective upon filing with the Department of State.
