EXECUTIVE SUMMARY
Recommendation to approve Petition VAC- PL2010 -2039, Lowe's South Naples, to
disclaim, renounce and vacate the County and the Public interest in that portion of a 15-
foot wide utility easement as originally recorded in Official Record Book 1872, page 1444
of the Public Records Collier County, Florida and in that portion of a 15 foot C.U.E.
(County Utility Easement) as created by the plat of Capri Commercial Center No. 2,
recorded in Plat Book 49, pages 5 through 8, all located in Section 3, Township 51 South,
Range 26 East, Collier County Florida being more specifically shown and described in
Exhibit A.
OBJECTIVE:
To adopt a Resolution to vacate the County and the Public interest in that portion of a 15 -foot
wide utility easement as originally recorded in Official Record Book 1872, page 1444 of the
Public Records Collier County, Florida and in that portion of a 15 foot C.U.E. (County Utility
Easement) as created by the plat of Capri Commercial Center No. 2, recorded in Plat Book 49,
pages 5 through 8, all located in Section 3, Township 51 South, Range 26 East, Collier County
Florida being more specifically shown and described in Exhibit A.
CONSIDERATIONS:
Petition VAC- PL2010 -2039 has been received by the Engineering Services, Growth
Management Division, Planning and Regulation from Robert Vance of Southern Civil Engineers,
Inc., as agent for the Petitioner, Lowe's Home Center, Inc. This vacation request is intended to
eliminate portions of existing easements where the facilities in those easements were rerouted
through alternate easements or never used for their intended purposes.
Letters of no objection from abutting property owners have been received from all who
responded, those who elected to not respond have been verified of delivery with certified mail
receipts from the US postal service. All agencies with rights of use of these easements have
approved with no objection the proposed vacation. All required documentation as required by
Collier County Resolution 2006 -160, Attachment "C ", Policy for the extinguishment of public
easements conveyed by separate instrument recorded in the Public Record (conveyances other
than a subdivision plat) on platted or unplatted land, except for Public Roads, and Attachment
"B ", Policy and Procedure for the vacation and annulment of plats or portions of plats of
subdivided land, has been submitted, therefore county staff recommends approval.
FISCAL IMPACT:
Growth Management Division, Planning and Regulation staff has collected a $2,000 "Petition to
Vacate" fee from the petitioner which covers the County's cost of recording and processing the
Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.

There are no outstanding environmental issues.
HISTORICAL/ARCHAEOLOGICAL IMPACT:
There are no historical or archaeological impacts.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved this item for legal sufficiency. This
item is ready for Board consideration and approval. STW
RECOMMENDATIONS:
Adopt the Resolution for Petition VAC- PL2010 -2039 to vacate the County and the Public
interest in that portion of a 15 -foot wide utility easement as originally recorded in Official Record
Book 1872, page 1444 of the Public Records Collier County, Florida and in that portion of a 15
foot C.U.E. (County Utility Easement) as created by the plat of Capri Commercial Center No. 2,
recorded in Plat Book 49, pages 5 through 8, all located in Section 3, Township 51 South,

Authorize the Chairman to execute the Resolution and direct the Clerk to the Board to record a

Petitioner, Lowe's Home centers, Inc, has requested the vacation of the County
and the Public interest in that portion of a 15 -foot wide utility easement as
originally recorded in Official Record Book 1872, page 1444 of the Public
Records Collier County, Florida and that portion of a 15 foot C.U.E. (County
Utility Easement) as created by the plat of Capri Commercial Center No. 2,

WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in the portions of easements as specifically depicted in Exhibit 'A' is hereby

Petitioner, Lowe's Home centers, Inc, has requested the vacation of the County
and the Public interest in that portion of a 15 -foot wide utility easement as
originally recorded in Official Record Book 1872, page 1444 of the Public
Records Collier County, Florida and that portion of a 15 foot C.U.E. (County
Utility Easement) as created by the plat of Capri Commercial Center No. 2,
recorded in Plat Book 49, pages 5 through 8, all located in Section 3, Township
51 South, Range 26 East, Collier County Florida being more specifically shown
in Exhibit A.
WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in the portions of easements as specifically depicted in Exhibit 'A' is hereby

vacated, extinguished, renounced and disclaimed, and this action is declared to
be in the Public interest and for the Public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of the Resolution in the Public
Records.
This Resolution adopted after motion, second and majority vote favoring

WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest
in the portions of easements as specifically depicted in Exhibit 'A' is hereby
