PURPOSE/DESCRIPTION OF PROJECT:
The subject property is located within a Mobile Home (MH) zoning district for which Section
4.02.01 A., Table 2.1 of the Land Development Code (LDC) requires a 25-foot front yard for
principal structures; LDC Section 4.02.01 D.7 allows unroofed and unenclosed stairways to
encroach up to 3 feet into the front yard of a single-family residence. The purpose of this petition
is to reduce the required 25-foot front yard setback to 21.1 feet for a mobile home and to 20 feet
for an unenclosed staircase;said staircase is required for ingress and egress.The mobile home and
staircase were placed by means of Building Permit No. PRBD20170102233, issued to Stanton
Mobile Home Sales, Inc. on the behalf of Segundo A. Benitez, on February 2, 2018. The listed
encroachments were identified by means of a required spot survey prior to the issuance of a
Certificate of Occupancy(CO). The rear of the mobile home abuts a septic tank and drainfield for
which the State of Florida — Department of Health issued Permit No. AP1255518, to Segundo
Benitez c/o Monty's Sanitation, on September 12, 2016, for which a site plan was reviewed and
approved. The applicant states that the site plan for the septic tank and field were used to create
the site plan for the mobile home and staircase; however,the former was not entirely correct with
respect to the placement of structures.Any movement of the mobile home to the south is inhibited
by the septic tank and drainfield as the surface elevation was increased to support same. The
subject variance is required to allow the mobile home and unenclosed staircase to remain,thereby
allowing for the issuance of the required CO to satisfy building permit requirements.

GROWTH MANAGEMENT PLAN (GMP) CONSISTENCY:
The subject property is located in the Urban Designation, Urban Coastal Fringe Subdistrict, land
use classification on the County's Future Land Use Map (FLUM). This land use category is
designed to accommodate a variety of residential uses including single-family, multi-family,
duplex, mobile home and mixed-use projects. As previously noted, the subject petition seeks a
variance for a mobile home that is located within an existing mobile home development, which
was an authorized use within this land use designation at the time of development, therefore, the
mobile home use is consistent with the FLUM. The GMP does not address individual variance
requests; the Plan deals with the larger issue of the actual use.
ZONING DIVISION ANALYSIS:
The decision to grant a variance is based on the criteria in LDC Section 9.04.03. Staff has analyzed
this petition relative to these provisions and offers the following responses:
a. Are there special conditions and circumstances existing, which are peculiar to the

location,size and characteristics of the land,structure or building involved?
Yes. The ground elevation to the rear of the subject property was increased to allow for the
placement of a required septic tank and drainfield,as such the lot is uneven,and the existing
mobile home cannot be relocated any further to the south.
b. Are there special conditions and circumstances,which do not result from the action of
the applicant such as pre-existing conditions relative to the property, which are the
subject of the Variance request?
Yes. As evidenced by the survey appearing above, structures on adjoining properties are
located closer than 25 feet to their front property lines. The reason for this is that the
neighboring properties are deemed to be legal non-conforming as they have insufficient lot
area and/or width,whereas the subject property is unique in that it is legally conforming with
respect to lot area and width. In the case of non-conforming properties within the MH zoning
district the front yard setback is reduced to 10-feet.
c. Will a literal interpretation of the provisions of this zoning code work unnecessary and
undue hardship on the applicant or create practical difficulties for the applicant?
Yes. It is not financially feasible to move the septic tank and drainfield closer to the rear
property line, as such,the existing mobile home cannot be moved any further away from the
front property line. A literal interpretation of the zoning code would create practical
difficulties for the applicant as enforcement of the full 25-foot front yard setback would
require the existing mobile home to be replaced with a smaller unit,if available;terms of the
subject building permit cannot be satisfied and as such a CO cannot be obtained.
d. Will the Variance, if granted, be the minimum Variance that will make possible the
reasonable use of the land, building or structure and which promote standards of
health,safety and welfare?
Yes, the variance, if granted, will make possible the most reasonable use of the land and
results in no changes to the existing property conditions while promoting standards of health,
safety, and welfare.
e. Will granting the Variance confer on the applicant any special privilege that is denied
by these zoning regulations to other lands, buildings, or structures in the same zoning
district?
Yes, by definition, a Variance bestows some dimensional relief from the zoning regulations
specific to a site. However, LDC Section 9.04.02 provides relief through the Variance
process for any dimensional development standard, such as the requested reduced rear yard
setback. As such, other properties facing a similar hardship would be entitled to make a
similar request and would be conferred equal consideration on a case by case basis.
f. Will granting the Variance be in harmony with the general intent and purpose of this

Land Development Code, and not be injurious to the neighborhood, or otherwise
detrimental to the public welfare?
Yes. The granting of the Variance will be in harmony with the general intent and purpose of
the Land Development Code and will not harm public safety,health and welfare.
g. Are there natural conditions or physically induced conditions that ameliorate the goals
and objectives of the regulation such as natural preserves,lakes,golf courses,etc.?
No.The Variance request is to allow an encroachment into he required front yard setback for
a mobile home that has already been placed. Granting of the Variance will not change
existing conditions.
h. Will granting the Variance be consistent with the Growth Management Plan?
Yes.Approval of this Variance will not affect or change the requirements of the GMP.
ENVIRONMENTAL ADVISORY COUNCIL(EAC)RECOMMENDATION:
The EAC does not normally hear variance petitions. Since the subject variance doesn't impact any
preserve area,the EAC did not hear this petition.
COUNTY ATTORNEY OFFICE REVIEW:
The Office of the County Attorney reviewed this staff report on August 28,2018.
RECOMMENDATION:
Staff recommends that the Collier County Hearing Examiner approve variance petition VA-
PL20170001963, to allow for a reduction of the required 25-foot front yard to 21.1 feet for the
existing mobile home and to 20 feet for the unenclosed staircase, at 12 Henderson Drive located
within unincorporated Collier County,Florida.

NATURE OF PETITION
12 HENDERSON DR., NAPLES, FLORIDA 34714
1. We are seeking a variance of the front setback of the property. The location of
the septic tank did not allow us to fit the manufactured home within the allowable
setbacks. The amount of the proposed encroachment that we are seeking is 4 ft.,
which is farther off the road than either side of the subject property (please see
attached survey). This will reduce the front setback from 25 ft. to 21 ft. Mr.
Segundo Benitez purchased the property on July 12th, 2013. The septic tank
permit was pulled on September 12th, 2016 (permit#AP1255518). Stanton Mobile
Homes pulled the mobile home permit on January 17th, 2017 (permit#2017-
0102223). The existing encroachment came in to play because the measurements
on the approved site plan for the septic tank were wrong (please see attached
septic tank site plan). Stanton Mobile Homes prepared the site plan for the
manufactured home based on the approved measurements on the site plan
provided to them with the septic tank permit. Once home was setup and
inspected,
a 6" encroachment was noted on the east property line. Stanton Mobile Homes
then went back and moved the home 6" to the west (at our own expense), to fix
this issue. Re-inspections were then called in and the inspector failed the front
setbacks, which were never mentioned in the first inspection.
2. Please refer to attached survey. The site plan shows the current location of the
manufactured home as well as all measurements to property lines, and adjacent
structures.
3. a. Special circumstances include the manufactured home not being able to be
moved any closer to the septic tank to put us in allowable setbacks.
b. There are no special circumstances or conditions that resulted from the action
of the applicant to require this variance request.
c. A literal interpretation of the provisions of this zoning code will put an undue
hardship on the applicant because it is not possible to move the septic tank any
closer to the rear property line also making it impossible to move the home any
closer to the front property line.
d. The variance that we have requested is the minimum variance allowable that
would be the most reasonable use of the land, building and structures on the
property and would promote the standards of health, safety and welfare.
e. Granting the variance requested would not confer on the petitioner any
special privileges that is denied by these zoning regulations to the neighborhood.
Please see the attached survey showing the surrounding homes. Please pay special
attention to the locations of the surrounding homes/structures in relation to
property lines.(see attached survey). Granting this variance would in no way be
detrimental to public welfare.
f. Granting this variance will not be injurious to the neighborhood or otherwise
detrimental to the public welfare. Granting this variance will be in harmony with
the intent and purpose of this zoning code.
g. There are not natural conditions or physically induced conditions that
ameliorate the goals and objectives of the regulation such as natural preserves,
lakes, golf courses, etc...
h. Granting the variance will be consistent with the Growth Management Plan
as it is an upgrade to the existing surroundings. The manufactured home
accentuates the neighborhood and is comparable to the surrounding homes.
Correction 2:
We learned of the encroachment during inspections that were being done after we
setup the manufactured home. This was not learned of during a staff review of our
mobile home permit. The mobile home permit was approved because our site plan
with measurements, including placement of home was based on the site plan
provided by the company that installed the septic tank. The measurements on the
site plan were approved by the health department and the staff member that
reviewed our permit, but the measurements were not correct.
Correction 3:
The septic tank was inspected and received a final approval (CO) by the health
department on April 24, 2017. We did not receive a CO on the manufactured home
due to the encroachment of the setbacks. All inspections passed regarding the
setup of the manufactured home, but a CO was not issued. The plumbing final
passed on 05/05/2017, the AC final passed on 05/05/2017, and the tie down
inspection passed on 05/05/2017.
Correction 4:
Variance petition number has been added to the top of the affidavit of
authorization.
Correction 5:
Please see bottom right hand corner of survey showing dates that revisions were
made. 12/13/17 was the last revision and nothing has been changed since then.
This "updated" survey was done after the variance was deemed necessary to show
the actual location of adjacent homes and subject property home.

Collier County for a variance from the requirements of the Collier County Land
Development Code(LDC) as they apply to the following described property:
12 Henderson Drive, located on the south side of Henderson Drive approximately

It is our intent to ask the County to allow us to reduce the minimum front yard
