EXECUTIVE SUMMARY
Recommendation to approve an agreement for the purchase of a fee simple property (Parcel
197POND) required for the Vanderbilt Beach Road Extension (Project 60168). Estimated Fiscal
Impact: $176,500.
OBJECTIVE: To purchase a property needed for a pond site for the future Vanderbilt Beach Road
Extension (the Project).
CONSIDERATIONS: Collier County is seeking to purchase Parcel 197POND, a fee simple parcel
consisting of 5 unimproved acres. Located on the south side of 12th Avenue NW and west of Wilson
Boulevard N, this property has been identified as a necessary component of a larger pond site required for
construction of the Project regardless of final refinements to the Project alignment. Please refer in this
regard to the memorandum dated July 29, 2018 prepared by Bill Gramer, P.E. of CH2M, the County’s
design consultant. Collier County Public Utilities has also identified a portion of this pond site as being
an ideal well site location and has requested an easement once this parcel is purchased.
The attached purchase agreement for $175,000 is the result of amicable negotiations with the owner. The
County’s review appraiser, Harry Henderson, has checked the comparable listings and recent sales and
has determined that this is a fair price for both parties. Please refer in this regard to Mr. Henderson’s
memorandum dated July 27, 2018.
FISCAL IMPACT: Funds in the amount of $176,500, being the aggregate purchase price of $175,000,
title insurance policy, and miscellaneous closing and recording fees not to exceed $1,500, will be
required. The primary funding source for the acquisition of right -of-way is impact fees. Should impact
fees not be sufficient within a particular project, the secondary funding source will be gas taxes.
No maintenance costs are anticipated until such time as the pond is constructed.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval. - JAB
GROWTH MANAGEMENT IMPACT: This Project is in accordance with the goals, objectives, and
policies of all applicable sections of the Stormwater Management Sub-element and the Conservation and
Coastal Management Element of the Growth Management Plan.
RECOMMENDATION:
. To approve the attached purchase agreement and authorize the Chairman to execute same on behalf of
the Board;
. To accept the conveyance of Parcel 197POND and authorize the County Manager, or his designee, to
record the conveyance instrument in the public records of Collier County, Florida;
. To authorize the payment of all costs and expenses that Collier County is required to pay under the
terms of the purchase agreement to close the transaction;
. To authorize the County Manager or his designee to take the necessary measures to ensure the
County’s performance in accordance with the terms and conditions of the purchase agreement; and
. To authorize any, and all, budget amendments that may be required to carry out the collective will of
the Board.

SUBJECT: ROW Request: Parcel 197 (Proposed Pond Site)
Overview:
The Vanderbilt Beach Road Extension Project, previously approved by the Board of County
Commissioners, will require the acquisition of Right-of-Way for the roadway corridor and
related stormwater ponds for the required treatment and attenuation of stormwater run-off.
The Vanderbilt Beach Road Extension Corridor was divided into Drainage Basins based
upon natural topography and manmade divides such as roads and canals.
Drainage Basin 3 is comprised of the area bordered by the Curry Canal (Western Limit) and
the Corkscrew Canal (Eastern Limit).
Drainage Basin 3 was sub-divided into the following three Sub-Basins:
Sub-Basin 3A
Sub-Basin 3B
Sub-Basin 3C
The divide between Sub-Basin 3A and 3B is located approximately midway between the
Curry Canal (Western limit) and Wilson Boulevard (Eastern limit). The limits of Sub-Basin C
are from Wilson Boulevard (Western limit) to the Corkscrew Canal (Eastern Limit).
Sub-Basin 3A is comprised of approximately 15.0 Acres from Station 640+81.90 to
Station 675+50* (3,500 LF +/-) Note: Limits subject to change during Final Design.
Within Sub-Basin 3A, there is a need to acquire Right-of-Way for a stormwater treatment
and attenuation pond.
Stormwater from Sub-Basin 3A will be discharged west to the Curry Canal which then flows
south and connects to the Cypress Canal. This area has been designated the Cypress
Canal Basin by the South Florida Water Management District.
Collier County Ordinance No. 2017-19 recently revised the maximum allowable discharge
from 0.15 cfs/acre to 0.06 cfs/acre in the Cypress Canal Basin. The more restrictive
requirement will result in the need to design and construct larger stormwater treatment and
attenuation ponds and/or additional ponds. This requirement will be used as a guideline
when evaluating and designing the required stormwater facilities along the corridor.

Pond Site(s) Evaluation:
Note: The horizontal alignment of the Vanderbilt Beach Road Extension within
this segment of roadway (from Curry Canal to 16th Street N.E.) is NOT Subject to
Change and therefore any acquisition of Rights-of-Way can proceed unrestricted.
Within Sub-Basin 3A, various parcels were evaluated to determine which parcels were:
Correctly Sized (Available Acreage)
Hydraulically Feasible
Environmentally Permissible
Cost Effective
Additional considerations included:
Improved or Unimproved status of parcel
Proximity to other feasible Improved/Unimproved parcels
The initial pond siting analysis of Basin 3A resulted in identifying four (4) potential pond sites
for further consideration. After additional evaluation, it was determined that Parcel 197 was
the preferred pond site for Basin 3A.
Parcel 197 is located adjacent to Parcel 199 (Parcel ID 37543210003), a 2.50 acre
County owned parcel located at 590 12th Ave NW. (shown designated white w/red
stripes). Note: The Collier County Public Utility Department will be utilizing a portion
of Parcel 199 for a proposed Well Site. Coordination will be required.
The proximity of Parcel 197 to County owned Parcel 199, increases the cost effectiveness
of constructing a large pond upon the two adjacent lots. This proposed pond location will
help the Collier County Growth Management Department meet the guidelines defined in
Collier County Ordinance No. 2017-19.
