Agenda 09/25/2018 Item #11B09/25/2018 EXECUTIVE SUMMARY Recommendation to approve the First Amendment to Agreement No. 17-7198 with Manhattan Construction, Inc. in the amount of $3,199,984.81 for Construction Management at Risk (CMAR) first phase construction services for the Collier County Sports Complex and make a finding that this expenditure promotes tourism; and to receive a project update and approve the staff recommended layout plan and approximate final acreage takedown; and approve all necessary FY 2019 budget amendments. OBJECTIVE: An Amendment to the existing CMAR contract is required to approve the Guaranteed Maximum Price (GMP) to incorporate the first construction phase of the Collier County Sports Complex project. CONSIDERATIONS: On February 13, 2018, Item 16.D.21, the County entered into an Agreement with Manhattan Construction, Inc. for CMAR services for all preconstruction phases for the Collier County Sports Complex. The process contemplated using individual contract amendments for each subsequent GMP construction phase. Each phase will clearly identify the terms and conditions specific to that phase including the fees charged by the construction manager. This allows the County to carefully manage the project within the budget parameters adopted by the Board. It also maintains strict controls over the relationship between the owner, construction manager, and design team. Manhattan Construction began soliciting subcontractor bids through June and July of 2018. The lowest and responsive bids from the subcontractors were submitted to the engineer of record and validated. Davidson Engineering provided a letter recommending award noting the final construction pricing was approximately $52,000 below the engineer’s estimate (recommendation of award and bid analysis attached). This early work phase known as “Phase 0” includes the preparatory work required in anticipation of “Phase 1” where the infrastructure and fields will be installed on the City Gate parcel owned by the County. “Phase 0” includes the preponderance of land clearing, full lake excavation, a construction access road, and preliminary drainage work. At the completion of “Phase 0,” staff and the adjacent property owner (City Gate) will complete an audit of all construction costs and reconcile the value of the fill d irt and ancillary facilities with the market value of fill dirt as identified in the purchase and sale agreement. Staff will also bring forward the final land adjustment as also contemplated in the purchase and sale agreement. On June 12, 2018, the Board reviewed the status of the complex design and directed staff to include four baseball fields as a component of the facility by exploring dual purpose fields allowing for both multi-use sports and baseball on the four fields. On August 29, 2018, the second design charrette was held to review these options and complete the master layout plan. Recognizing the Board’s desire to include baseball, the complete design team reviewed several options and determined that four standalone baseball fields could be included and would function more efficiently. The team also evaluated several options on the placement of the stadium and field house as well as the final acreage displacement and “Phase 1” layout. This agenda item also seeks to finalize the “Layout Plan” so that the design and construction team can begin developing the detailed construction level documents. The plan proposed does not recommend exercising the option for an additional 2.5 discretionary acres but does recommend exercising the option to acquire approximately 4.8 acres of the 5.6 acre option tract. The impact to the complex, design rework, and throw away construction costs associated with leasing the land was found to be impractical. The attached final layout and acreage plan is being submitted for Board approval. FISCAL IMPACT: Construction of facilities at the Amateur Sports Complex site will be paid from 11.B Packet Pg. 322 09/25/2018 Tourist Development Tax (TDT) bond proceeds which will be received and deposited into Fund (758) after closing on October 24, 2018. Language within the TDT bond documents approved by the Board on September 11, 2018 contains a reimbursement clause in the event certain construction expenses are paid prior to receipt of bond proceeds. In order to proceed with Phase "0" work as contained withi n this contract amendment, funds from General Fund reserves will be transferred via an FY 2019 budget amendment providing a short term advance with said advance to be repaid once bond proceeds are received. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan. ADVISORY BOARD RECOMMENDATION: The BCC and TDC approved this project and the 5th cent at the Joint Meeting between the BCC and TDC on June 13, 2017 (Item 10A and 11A). LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. -SRT RECOMMENDATION: To approve the First Amendment to Agreement No. 17-7198 with Manhattan Construction, Inc. in the amount of $3,199,984.81 for Construction Management at Risk (CMAR) first phase construction services for the Collier County Sports Complex, authorize the Chairman to execute the contract, and make a finding that this expenditure promotes tourism; and to receive a project update and approve the staff recommended “Layout Plan” and approximate final acreage takedown; and approve all FY 2019 budget amendments. Manhattan was required to solicit a minimum of three (3) bids and the solicitation took place in June / July of 2018. Manhattan received one formal completed unit price bid and one lump sum price bid. Other parties solicited, formally did not bid. Davidson Engineering reviewed both bids received and found consistency with the monetary values, but inconsistencies with the material take-offs. After further coordination with the CMAR – Manhattan, the material values were updated and found consistent with the original engineering take-offs. The schedule of values with unit price breakdowns were also found to be consistent with recent Collier County bid solicitations. This includes the unit price inflation caused by the recent spike in the economy and due to the hurricane. The overall total bid price is consistent with the DE engineer’s estimate. Based on our review of the overall project scope as outlined in the construction documents, DE supports an award of the Phase Zero Sports Complex and Events Center to Manhattan Construction.
