Recommendation to approve Petition VAC-PL20180001141, to disclaim, renounce and vacate the County and the public interest in the 10-foot drainage easement on the north side of the property and a portion of the 15-foot drainage easement on the south side of the property, on Lot 35, Collier County Production Park Phase 1-B, as recorded in Plat Book 15, Pages 7-8 of the public records of Collier County, Florida, located on the west side of Livingston Road, just south of Exchange Avenue in Section 36, Township 49 South, Range 25 East, Collier County, Florida. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in the 10-foot drainage easement on the north side of the property and a portion of the 15-foot drainage easement on the south side of the property, on Lot 35, Collier County Production Park Phase 1-B, as recorded in Plat Book 15, Pages 7-8 of the public records of Collier County, Florida in Section 36, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A. CONSIDERATIONS: Petition VAC-PL20180001141 has been received by the Development Review Division, Growth Management Department from Chad McKimm, P.E., of BlueWater of South Florida, as agent for the property owner, N.A.M. Rental, LLC, to vacate the 10 -foot drainage easement on the north side of the property and a portion of the 15-foot drainage easement on the south side of the property, on Lot 35, Collier County Production Park Phase 1-B, as recorded in Plat Book 15, Pages 7-8 of the public records of Collier County, Florida,, in Section 36, Township 49 South, Range 25 East, Collier County, Florida. The subject drainage easements were dedicated by plat to the County without maintenance, and to Collier County Production Park Owners Association, Inc., with maintenance responsibility. The Collier County Production Park Owners Association, Inc., has been an inactive in Florida since 1995. According to the County Property Appraiser, N.A.M. Rental, LLC is the fee simple owner of the underlying real property wherein these drainage easements are located. The original purpose of the drainage easements was to direct water runoff from Production Boulevard, east to the 50-foot drainage easement along Livingston Road. The owner wants to vacate the easements in order to accommodate the proposed site plan. To ensure that this vacation will not result in a public detriment or adverse impact to the stormwater drainage system, the owner will install a new drainage pipe within the remaining 7.5-foot drainage easement along the south property line. The attached Resolution to Vacate includes a condition that the County will retain its interest in the proposed vacated drainage easements until such time that the owner installs a minimum 24 -inch drainage pipe and associated supporting infrastructure within the remaining 7.5-foot drainage easement along the south property line, and said pipe and infrastructure is inspected and approved by the County. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: Growth Management Department, Development Review Division staff, has collected a $2,000 “Petition to Vacate” fee from the petitioner which covers the County’s cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. 17.B Packet Pg. 2921 09/11/2018 LEGAL CONSIDERATIONS: Petitioner is requesting the vacation of the 10-foot drainage easement on the north side of the property and a portion of the 15-foot drainage easement on the south side of the property, on Lot 35, Collier County Production Park Phase 1-B, as recorded in Plat Book 15, Pages 7-8 of the public records of Collier County, Florida. Pursuant to Resolution 2013-166 and Florida Statutes Section 177.101, the Board may adopt resolutions vacating plats in whole or in part of subdivisions in Collier County, returning the property covered by such plats either in whole or in part into acreage, when the following criteria are met: 1. The request is in the interest of the general public welfare, or no public detriment is established. 2. The request does not invade or violate individual property rights. 3. The Petitioner owns the fee simple title to the whole or that part of the parcel sought to be vacated. 4. The vacation will not affect the ownership or right of co nvenient access of persons owning other parts of the subdivision.
