EXECUTIVE SUMMARY
Recommendation to approve a Florida Power & Light Company Right-of-Way Consent Agreement
and accompanying memorandum required for the replacement of the Pine Ridge Canal Weir
(Project No. 60119.) Estimated Fiscal Impact: $217.
OBJECTIVE: To obtain Florida Power & Light Company’s (FPL’s) consent to the temporary use of a
portion of its easement area for the Pine Ridge Weir Replacement Project at Creekside Boulevard (the
Project).
CONSIDERATIONS: Collier County is seeking to acquire a temporary construction easement from
Creekside Commerce Park Property Owners’ Association, Inc. This temporary easement will be donated
to the County and is needed for the replacement of the Pine Ridge Weir at Creekside Boulevard,
southwest of the intersection of Immokalee Road and Goodlette-Frank Road North. The existing weir is
located just south of Immokalee Road on the Pine Ridge Canal. The new weir will be constructed
approximately 1,100 feet south of the existing weir and will be located just south of Creekside Boulevard.
The proposed easement area is burdened by an existing FPL easement that accommodates high voltage
overhead transmission lines. The County is required to obtain FPL’s consent for the temporary use of this
area for construction of the Project. The attached Right -of-Way Consent Agreement accomplishes this
purpose. Also attached is a Memorandum of Right-of-Way Consent Agreement, which is an abbreviated
version of the full agreement. The abbreviated version will be recorded in the public records of Collier
County. Staff recommends that the Board of County Commissioners (the Board) approve both
agreements.
FISCAL IMPACT: Funds in the amount of $217, being fees to record the Memorandum of Right -of-
Way Consent Agreement, are available in Project 60119 within the Stormwater Capital Improvement
Fund (325). Source of funds is a transfer from the General Fund (001) and Unincorporated Area General
Fund (111). This weir has previously been on the Road Maintenance Division’s maintenance schedule.
Therefore maintenance costs are unchanged.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. JAB
GROWTH MANAGEMENT IMPACT: This Project is in accordance with the goals, objectives, and
policies of all applicable sections of the Stormwater Management and the Conservation and Coastal
Management elements of the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners performs the following:
. Approves the attached Right-of-Way Consent Agreement and Memorandum of Right-of-Way
Consent Agreement and authorize the Board’s Chairman to execute both agreements on behalf of the
Board;
. Authorizes the County Manager, or his designee, to record the Memorandum of Right-of-Way
Consent Agreement in the public records of Collier County, Florida;
. Authorizes the payment of all costs and expenses that Collier County is required to pay under the
terms of both agreements; and
. Authorizes the County Manager, or his designee, to take the necessary measures to ensure the
County’s performance in accordance with the terms and conditions of both agreements.
