EXECUTIVE SUMMARY
Recommendation to approve an Easement Use Agreement for Lot 1, Landings at Bear’s Paw,
according to the plat thereof as recorded at Plat Book 56, Pages 5 through 6 of the public records of
Collier County.

OBJECTIVE: To approve an Easement Use Agreement (Agreement) between the County, the current
property owners of Lot 1, Landings at Bear’s Paw, and the Landings at Bear’s Paw Homeowner’s
Association, Inc.
CONSIDERATIONS: The property is located at 1645 Vinland Way. There is an existing pool deck on
the subject property that encroaches 1.5 feet into a 20-foot drainage easement. The subject easement is
dedicated to Collier County with no responsibility for maintenance and to the Landings at Bear’s Paw
Homeowner’s Association, Inc. with responsibility for maintenance, according to the plat. The
Homeowner’s Association has provided a letter of no objection to the encroachment and stated that there
remains sufficient area to maintain the easement. Moreover, they are a party to the Agreement. There are
no drainage facilities within the easement and staff has no objection to the encroachment. Development
Review has reviewed the Agreement and Exhibits and recommends approval of the Easement Use
Agreement. The current owners purchased the property with the encroachment in place.
FISCAL IMPACT: There is no fiscal impact. The property owners will be responsible for the
recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. SAS
RECOMMENDATIONS: To approve the Easement Use Agreement between the County, current
property owners of Lot 1 of Landings at Bear’s Paw, and the Landings at Bear’s Paw Homeowner’s
Association, and authorize the Chairman to execute the Agreement; and to direct the Clerk to record
the Easement Use Agreement in the official public records.
