EXECUTIVE SUMMARY
Recommendation to approve a Temporary Construction Easement Agreement (Parcel 127TCE)
necessary for the construction of the stormwater improvements in the Northwest Quadrant of
Golden Gate City, Project No. 51029 (Fiscal Impact: Approximately $3,000)
OBJECTIVE: To acquire a Temporary Construction Easement (TCE) needed for the stormwater
improvements in the northwest quadrant of Golden Gate City (Project No. 51029) (the ”Project”).
CONSIDERATIONS: Collier County wants to repair and replace existing underground drainage pipes
and related drainage facilities in the northwest quadrant of Golden Gate City. The property owners, Mr.
Jose A. Elizondo and Martha Elizondo, have executed a five-foot wide temporary construction easement
which will provide the County’s contractor additional space to replace the existing drainage pipe located
in a platted drainage and utility easement. The property owners are not seeking compensation for the
conveyance of the easement; however, they do wish to be compensated for the loss of a mature
Bismarckia Palm tree located within the area of the temporary construction easement. The property
owners requested a guarantee from the County that the tree could be successfully relocated. Staff has
been advised that no such guarantee can be given and that it would be preferable to compensate the
property owners for the cost of transplanting the tree with the understanding that they will hire their own
contractor to do so.
The accompanying memo dated July 30, 2018 by Harry Henderson, Review Appraiser, estimates the cost
of removing and replanting the tree elsewhere on the property to be $3,000. Accordingly, staff is
recommending that the Board of County Commissioners (the “Board”) approve the accompanying
Temporary Construction Easement Agreement that provides for compensation of $3,000 to the property
owners and stipulates that the TCE will not be recorded in the public records.
FISCAL IMPACT: Funds in the amount of $3,000 are available in the Golden Gate City Stormwater
Improvement Project No. 51029, within the stormwater capital improvement fund 325. Source of funds is
transfers from the General Fund (001) and Unincorporated Area General Fund (111). The stormwater
system has previously been on the Road Maintenance Division’s maintenance schedule. Therefore,
maintenance costs are unchanged.
GROWTH MANAGEMENT IMPACT: The proposed construction projects are in accordance with
the goals, objectives, and policies of all applicable sections of the Stormwater Management and the
Conservation and Coastal Management elements of the Growth Management Plan.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval . - ERP
RECOMMENDATION: That the Board of County Commissioners performs the following:
. Approves the Temporary Construction Easement Agreement and authorize the Chairman to execute
same on behalf of the Board;
. Accepts the conveyance of Parcel 127TCE;
. Authorizes the payment of all costs and expenses that Collier County is required to pay under the
terms of the Temporary Construction Easement Agreement at the time of closing;
. Authorizes the County Manager, or his designee, to take the necessary measures to ensure the
County’s performance in accordance with the terms and conditions of the Temporary Construction
Easement Agreement; and
. Authorizes any, and all, budget amendments that may be required to carry out the collective will of
the Board.

Subject: Compensation Estimate; Parcel 127TCE Golden Gate City Stormwater Proj.
A Temporary Construction Easement is being acquired across a section of the residential lot
located at 2200 54th Street SW, Naples, FL 34116 (tax folio #36372640007). This is an
improved lot (single-family home with residential site improvements/landscaping) owned by
Jose and Martha Elizondo. The parent tract lot has an area of approximately 13,500sf; Parcel
127TCE is a 5ft wide strip located along the parent tract’s northerly boundary platted drainage
easement. The TCE is for a period of 1 year. The TCE area will be graded and sodded after its
use by our contractor and will be left in a state similar/equivalent to its current condition. The
compensatory value for use of this TCE area is nominal.
However, a large specimen Bismarckia Palm Tree (mature) is located within the TCE area
which would be destroyed by our construction work within the TCE if not moved. Independent
landscape specialists have estimated the value of this type specimen tree from $1,000-$5000
depending on size and age. The median cost estimate to remove and replant this tree
elsewhere on this lot comes in at $3,000+-. As such, compensation in the amount of $3,000 has
been offered to and accepted by the property owner for the transplant of this tree (to be
undertaken by the property owner at his own risk, without warranty from Collier County that this
transplant may fail). This compensation is judged to be justified and fair given the special
circumstance outlined above.
