Agenda 09/11/2018 Item #16B 309/11/2018 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners, acting as the Community Redevelopment Agency Board (CRAB), approve the relocation of the Bayshore Gateway Triangle CRA office to 2348 Pineland Avenue, approve a new office lease agreement with Chrishelle III, LLC, and authorize the Chairman to sign. OBJECTIVE: To provide long-term office space for the Bayshore Gateway Triangle CRA that will accommodate staffing and provide sufficient space for community meetings. CONSIDERATIONS: The Bayshore Gateway Triangle CRA office has been located at 3570 Bayshore Drive since June 2013. The lease expired on July 31, 2018 and the CRA is now a month -to-month tenant until the lease is terminated, or until the Landlord otherwise determines. At the April 2018 Annual Workshop on office space options, staff was directed to identify options for new office space that would keep the office space within the CRA boundaries and near Bayshore Drive for continued easy access to the community members. Over the course of several months, staff reviewed options and negotiated terms with several landlords. The table below lists options that were presented and discussed with the Advisory Board: The larger unit at 2348 Pineland Ave. was supported by the Advisory Board because it could accommodate the community meetings and provided easy access to the public due to its ground floor location. Though originally the CRA Advisory Board voted to approve a three -year lease, the terms were amended to five years following the landlord agreeing to pay for $63,000 in improvements necessary to accommodate CRA operations. At the July 10, 2018 meeting, the CRA Advisory Board voted 5 -0 to recommend approval of the five-year lease. The Bayshore Beautification MSTU, Haldeman Creek MSTU Advisory Board Members and the community residents also support operations at the location. The proposed lease includes a provision (Article V) that requires the CRA to reimburse the landlord for a 16.B.3 Packet Pg. 833 09/11/2018 pro-rata portion of the cost of interior improvements if the CRA terminates the lease prior to the expiration of the 5-year term. (Example: If Landlord’s improvement costs are $65,000 and if CRA terminates the First Year the costs equal $40,000, the Second Year = $32,000, Third Year = $24,000, Fourth Year = $16,0000 and Fifth Year = $8,000). Annual Rent will be increased by three percent, compounded each year, throughout the life of the lease. Since the build-out of the new office space is not expected to be completed until the first quarter of 2019 and the CRA is now a month-to-month tenant at 3570 Bayshore Drive, and the Landlord has the right to terminate the CRA tenancy by giving 15 days advance notice to the CRA, the CRA is in the process of negotiating an extension to the Lease for its present office space. At a future meeting the CRA staff will present the extension to the Board that provides for a termination for convenience without penalty to the CRA. In the meantime, the CRA office will continue to be occupied on a month to month basis. LEGAL CONSIDERATIONS: This item is approved for legality and requires a majority vote for Board action. - JAB FISCAL IMPACT: First year lease expense, including Common Area Maintenance (CAM), under the proposed Lease Agreement is $66,594.00. The FY19 Bayshore Gateway Triangle CRA Fund (187) budget provides sufficient funding to support the proposed lease expense. GROWTH MANAGEMENT IMPACT: The move will allow the CRA staff to continue its’ programs and projects within the budgetary and policy guidance and directives of the CRA Board. RECOMMENDATION: That the Board of County Commissioners, acting as the Community Redevelopment Agency Board (CRAB), approve the relocation of the Bayshore Gateway Triangle CRA office to 2348 Pineland Avenue, approve a new office lease agreement with Chrishelle III, LLC, and authorize the Chairman to sign.
