I:Forms/County Forms/BCC Forms/Original Documents Routing Slip WWS Original 9.03.04,Revised 1.26.05,Revised 2.24.05 1601 EXECUTIVE SUMMARY Recommendation to approve modification #6 to Subgrant Agreement between the Florida Departmen of Economic Opportunity (DEO) and Collier County, Disaster Recovery Initiative Grant Agreement #10DB-D4-09-21-01-K09, to add one new project to provide hurricane hardening to County owned Gilchrist Apartments, extend the Subgrant Agreement and amend the associated subrecipient agreements to extend project completion deadlines and modify Project Work Plans. OBJECTIVE: Allow for an additional Disaster Recovery Initiative(DRI)project,extend the grant term and allow for grant extensions and project work plan modifications for subrecipients. CONSIDERATIONS: On May 25, 2010, Item 16D10, the BCC accepted a federally-funded disaster recovery agreement with the Department of Economic Opportunity(DEO). The purpose of the DRI grant is to fund projects that provide disaster relief and long term recovery. The contractors for approved projects with this grant have been procured at a cost less than anticipated. To meet the needs of the community and help expend all awarded grant funds, the grant is proposed to be modified to include an additional project and a time extension. The additional project will serve the low income residents of the Gilchrist Apartments. This property was purchased with Neighborhood Stabilization Funds (NSP) funds and is currently owned by the County. Both HUD(NSP grantor) and DEO have provided guidance that the use of these funds for this purpose is allowable. At a future Board meeting, staff will propose that an affordable housing provider be awarded the Gilchrist apartments based on competitive procurement through a published Request for Proposal. Hurricane hardening activities will be performed at the site. These activities will include addressing the inferior condition of the windows and doors. A portion of the grant funds currently allocated to Flood and Drainage activities will be reallocated to Multifamily Housing to fund the new project. The estimated cost of the project is $50,000. The reallocation will not require any additional funds beyond those that have already been awarded to the County. The States action plan for the DRI funds requires a minimum of 14% of the total funds statewide be allocated towards affordable rental housing. Any additional housing projects will help the state meet this 14% goal. In addition to adding to the states affordable rental housing efforts the Gilchrist project will accomplish the following program objectives: • Preserve affordable rental housing stock • Benefits Very Low income residents(meets a required National Objective) • Long-term recovery and mitigation • Improve the safety of the residents The Gilchrist affordable rental housing project adds value to the modification request. The extension element of the modification will allow additional time for the completion of approved projects that are nearly finished or recently awarded. These projects are critical and benefit the community at large. Modification #6 to the Subgrant Agreement will adjust the end date to June 21, 2013 to allow for the performance of the new project. The project completion dates and the work plans in the existing subrecipient agreements are also proposed to be modified. The Chart below displays each project with the grant along with new completion dates. Once the DEO has provided approval for the modification to the grant agreement, the associated subrecipient agreements may be executed by the Board chair. FISCAL IMPACT: Due to cost savings in the Immokalee Stormwater and Resurfacing project, funding for the Gilchrist project is available. The budget for the Flood and Drainage Activity is being reduced by $50,000 and this$50,000 is being transferred to the Multifamily Housing Activity for the grant. Disaster Recovery Initiative grant funds are available within the Housing Grants Fund (705), Project 33104. GROWTH MANAGEMENT IMPACT: Implementation of DRI will help facilitate efforts to meet the goals,objectives and policies set forth in the Housing Element of the Growth Management Plan. LEGAL CONSIDERATIONS: A subrecipient agreement is not necessary for the new project because it is Collier County owned. If the property is transferred before the project is completed,the County and the new owner will have incorporate terms related to the hurricane hardening project into the Purchase Sale Agreement and possibly enter into a subrecipient agreement with the new owner for hurricane hardening project. This item is legally sufficient and requires a majority vote for BCC action. -JBW RECOMMENDATION: To approve and authorize the Chairman to sign the grant modification number six between Collier County and the Department of Economic Opportunity and approve amendments of the associated subrecipient agreements. This modification creates one new service area called the Gilchrist Apartments. The apartments are occupied by 32 Very Low Income residents. The project's activities will include the installation of impact resistant windows and doors at the apartments. The New Service area is Service Area#8 and the activity Code is 14B. The amount of$50,000 for the new project will be reallocated from Service area #3 from the activity code 031, flood and drain. In addition this modification request includes a six month extension. The extension will allow for the performance of the new project and the close out of those projects already underway or near completion. Service area #1, the Goodlette Arms Apartments would benefit greatly from the extension as the generator supplier just announced a six week delay for the delivery of the generator for the project. Presented to you are the modification documents in triplicate with the Chairman's original signature. WHEREAS, the Department and the Recipient entered into the Agreement, pursuant to which the Department provided a subgrant of $9,963,208.00 to Recipient under the Small Cities Community Development Block Grant ("CDBG") Program as set forth in the Agreement; WHEREAS,the Department and the Recipient desire to modify the Agreement; WHEREAS, pursuant to the provisions of Chapter 2011-142, Laws of Florida, the DCA Division of Housing and Community Development was transferred to the Department of Economic Opportunity effective October 1, 2011; and the parties wish to reflect the new name. NOW, THEREFORE, in consideration of the mutual promises of the parties contained herein, the parties agree as follows: O Reinstate Agreement 1.
