HEARING SUMMARY
A. CALL TO ORDER:
The hearing was called to order by Special Master Brenda Garretson at 8:45
AM.
All those testifying at today's proceedings did so under oath.
B. COLLIER COUNTY CITATIONS:
BCC ys. Robert Dietz - Case CE 0903
This hearing was requested by Robert Dietz who was not present.
Sheriffs Officer, John Marsh, was present.
On February 1, 2005 a Dodge Durango was parked in a handicap marked parking space
at Progress Ave. After visual inspection no placard was observed.
The Defendant was officially noticed, requested the hearing and found guilty of
Ordinance Sec. 130-67. The Defendant was ordered to pay thefine of$250 and
operation costs of $30 for a total of $280.
BCC ys. Catherine Wilson - Case SO 133210
This hearing was requested by Catherine Wilson who was present.
Sheriffs Officer Painter was also present.
A photograph was shown as evidence. On December 16, 2004 in Park Shore Plaza
noticed cars in the fire lane. The Defendant was advised she was not allowed to park in
the fire lane.
The Defendant stated she was waiting for her husband while parked in the area in which
the citation was received. The Defendant's case was not audible on the tape.
The Defendant was found guilty of Ordinance Sec. 130-66(1) h. The Defendant was
ordered to pay the fine of $30 and Operational Costs of $30 for a total of $60.
BCC ys. Olympia Skohut - Case SO 142463
The Defendant claimed she was in possession of a valid handicap-parking permit at the
time this citation was issued. She was instructed to go to the citation processing office
for a reduction of fines to $5.00.
BCC ys. Adrian Domin2uez-Duran & Randal Kelp - Case SO 134195 & Case SO
134196
Both hearings were requested by Mr. Dominguez-Duran, Brandy Bartolone and Randal
Kelp and all present.
The Sheriffs Officer Bill Hems was also present addressing both cases.

Officer Hems stated on December 8,2004 two vehicles were parked in the right-of way
on Weber Blvd. No one was in the vicinity of the vehicles and citations were written for
both vehicles. Photographs were offered into evidence for both vehicles being addressed.
Mr. Bartolone stated they were under contract with the Collier County Public Utilities
Department for construction ofa water main project on Golden Gate Blvd. A copy of the
right-of-way permit was in his possession. The site plans were offered into evidence in
regards to the construction plan and location.
All parties addressed the Special Master which was not audible.
Both cases concerning Ordinance Sec. 130-66 ROW were dismissed.
BCC ys. Alan West - Case SO 140593
This hearing was continued from February 25th. Mr. West had provided an address in
which the notice had been returned.
Sheriffs Officer, Lawrence Keller was present.
Officer Keller issued a citation because the vehicle was parked at an expired meter
without a beach-parking permit from the County or City.
The Defendant was found guilty of Ordinance 80-47 see 130-67 and ordered to pay
fines of$30 and Operational Costs of$30 totaling $60.
BCC ys. Stewart Jacobson - Case SO 145656
This hearing was requested by the Defendant, Stewart Jacobson who was present.
Sheriffs Officer Lawrence Keller was also present.
Officer Keller stated he observed a Toyota parked in a handicap-parking zone clearly
marked in the Strand parking lot. After careful visual inspection, no valid permit was
seen and a citation issued.
The Defendant stated the area was not clearly marked. It had a white line with faded blue
lines. Photographs were offered into evidence. He did not see the handicap sign.
The Defendant remarked there was a similar case in the past in which the case was
dismissed After much discussion between the Defendant and Special Master, Mr.
Bonanno stated the Special Master has the option to delay a decision if she so chooses.
Case SO 145656 was con tin uedfor further research by the Special Master.
BCC ys. Cindy Zyosec - Case SO 141741
The Defendant claimed she was in possession of a valid handicap-parking permit at the
time this citation was issued. She was instructed to go to the citation processing office
for a reduction offines to $5.00.
BCC ys. John Dalton - Case CE 0155

This hearing is requested by Investigating Officer Christopher Ambach, who is present.
The Defendant, John Dalton is also present.
On January 23,2005 he observed a Jaguar parked in the right-of-way at III th Ave. and
6th Street. A citation was issued. Photographs were offered into evidence.
The Defendant stated there were no signs showing it to be a County right-of-way. He
had no idea it was a right-of-way and admitted it was wrong. Discussion followed on
Community Service volunteers being more community minded with the residents.
The Defendant was found guilty of Ordinance Sec. 130-66 RO Wand ordered to pay
fines of$30 and Operational Costs of $30 for a total of$60.
BCC ys. Kenneth Woods - Case SO 141739
Sheriffs Officer Lawrence Keller was present. The Defendant was not present.
Officer Keller was in the Vanderbilt Beach Parking lot and observed a vehicle parked on
the grass and issued a citation. It was clearly marked with "No Parking" signs.
The Defendant received proper notice and requested the hearing. The Defendant was
found Guilty of the violation and ordered to pay thefine of$30 and Operational Costs
of $3 o for a total of$60.
BCC ys. Mario Bosone - Case SO 140522
Neither party was present with the officer requesting a continuance.
A continuance was granted until April 1, 2005. Both parties will be notified.
BCC ys. William Waitlev - Case SO 141653
The Defendant claimed he was in possession of a valid handicap permit at the time this
citation was issued. He was instructed to go to the citation processing office for a
reduction of fines to $5.00.
The next hearing is scheduled for April 1, 2005.

Yes, Sue will be reporting for us tomorrow. Honestly, this is the first workshop I've
been a part of, so I'm learning as I go. I don't think there is anything for you to do.
I have a room reserved here, and I assume Sue will send you guys the minutes when they are
finished, so I guess that's it.
Side Note: Has Sue submitted the March Special Master Minutes yet? I noticed they are
not on the website. Also, the links for the CEB 2-24-05 minutes and the Special Master 2-
25-05 minutes have typos. Can someone get that fixed? Thank you!!!

Happy Monday! Say, I just wanted to make sure you had a court reporter set up for your CEB
Workshop meeting tomorrow @ Horseshoe. I noticed it wasn't on our calendar, and since
Trish is out of the office today, I just want to confirm that you do indeed have a court
reporter. I noticed Sue Chapin was sent an Agenda, so I assume she'll be covering the
workshop for you tomorrow?
Sue is here covering the TDC Meeting this morning, I will make sure she gets a copy of
that CEB Workshop Agenda.
