AN ORDINANCE REPEALING SEC. 46-5 OF THE CODE
OF LAWS AND ORDINANCES OF COLLIER COUNTY
(FEE FOR ALIMONY PAYMENTS AND COLLECTION);
PROVIDING FOR INCLUSION IN THE CODE OF LAWS
AND ORDINANCES; PROVIDING FOR CONFLICT AND
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Ch. 67-701, Sec. 1, Laws of Florida, created a local law in Collier County
providing for a $0.50 fee for each payment received by the Clerk of the Circuit Court under a
decree of support or alimony; and
WHEREAS, this Act, codified as Sec. 46-5 in the Code of Laws and Ordinances of
Collier County by the Municipal Code Corporation, provides as follows:
"Sec. 46-5. - Fee for alimony payments and collection.
The clerk of the circuit court is authorized to collect a fee of $0.50 for
each payment received by him under F.S. § 88.241, or for any other payments
received by him to be paid out under a decree of support or alimony;" and
WHEREAS, pursuant to Ch. 71-29, Laws of Florida, this provision was repealed as a
State of Florida Act and assumed status as a local ordinance; and
WHEREAS, the Board of County Commissioners desires to repeal this ordinance in its
entirety as serving no present public purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,FLORIDA, that:
SECTION ONE: Repeal of Sec. 46-5, Collier County Code of Laws and Ordinances.
Sec. 46-5 of the Code of Laws and Ordinances of Collier County (Fee for alimony
payments and collection) is hereby repealed in its entirety.
SECTION TWO: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a part of the Code of Laws
and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or

re-lettered to accomplish such, and the word "ordinance" may be changed to "section," "article,"
or any other appropriate word.
SECTION THREE: Conflict and Severability.
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION FOUR: Effective Date.
This Ordinance shall take effect upon filing with the Florida Department of State.

WHEREAS, Ch. 63-581, Sec. 1, Laws of Florida and Ch. 65-1026, Sec. 1, Laws of
Florida, created a local law in Collier County authorizing the Division of Corrections to sell
canned goods to County jails and stockades; and
WHEREAS, this Act, codified as Sec. 78-28 in the Code of Laws and Ordinances of
Collier County by the Municipal Code Corporation, provides as follows:
"Sec. 78-28. - Sale of canned goods.
The division of corrections is authorized to sell canned goods to jails and
stockades in the county;"and
WHEREAS, pursuant to Ch. 71-29, Laws of Florida, this provision was repealed as a
State of Florida Act and assumed status as a local ordinance; and
WHEREAS, the Board of County Commissioners desires to repeal this ordinance in its
entirety as serving no present public purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:

(EXPENDITURES FOR LIGHTING); PROVIDING FOR

ORDINANCES; PROVIDING FOR CONFLICT AND
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Ch. 63-713, Sec. 1, Laws of Florida, created a local law in Collier County
validating certain expenditures authorized by the Board of County Commissioners for the
lighting of public parks and playgrounds; and
WHEREAS, this Act, codified as Sec. 98-1 in the Code of Laws and Ordinances of
Collier County by the Municipal Code Corporation, provides as follows:
"Sec. 98-1. - Expenditures for lighting.
Expenditures made during the preceding biennium by the board of county
commissioners for the lighting of public parks and playgrounds are validated.
Such expenditures are declared to have been for a valid county purpose;"and
WHEREAS, pursuant to Ch. 71-29, Laws of Florida, this provision was repealed as a
State of Florida Act and assumed status as a local ordinance; and
WHEREAS, the Board of County Commissioners desires to repeal this ordinance in its
entirety as serving no present public purpose.

"Sec. 2-1. - Purchases from state division of corrections.
The sheriff, the board of county commissioners, or any school or public
institution or agency financed by county or municipal funds, is authorized to
purchase and the state division of corrections is authorized to sell any item,
including brick, produced,processed or manufactured by the division not required
for use therein or for use in any institution under the supervision of the board of
commissioners of state institutions;" and

WHEREAS, Ch. 61-557, Sec. 1, Laws of Florida, created a local law in Collier County
dealing with the granting of exclusive and nonexclusive franchises; and
WHEREAS, this Act, codified as Sec. 2-26 in the Code of Laws and Ordinances of
Collier County by the Municipal Code Corporation, provides as follows:
"Sec. 2-26. - Franchises generally.
In addition to all other powers granted by law, the County acting through
its Board of County Commissioners may exercise its power of government for
County purposes by granting exclusive or nonexclusive franchises to persons and
municipal and quasimunicipal bodies for the performance of any proprietary
function, authority or power, or part thereof; and limit, condition, regulate and
otherwise control the use and performance of such franchise. No such franchise
shall extend into nor conflict with any incorporated municipality within such
County. The Board of County Commissioners may not regulate or control the use
of such franchise granted to any utility subject to the jurisdiction of the public
Service Commission, or cooperatives organized and existing under the rural
electrification cooperative law of this State;" and
WHEREAS, pursuant to Ch. 71-29, Laws of Florida, this provision was repealed as a
State of Florida Act and assumed status as a local ordinance; and

ORDINANCE NO. 2012 - 34
AN ORDINANCE REPEALING SEC. 2-1 OF THE CODE OF
LAWS AND ORDINANCES OF COLLIER COUNTY
(PURCHASES FROM STATE DIVISION OF
CORRECTIONS); PROVIDING FOR INCLUSION IN THE
CODE OF LAWS AND ORDINANCES; PROVIDING FOR
CONFLICT AND SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, Ch. 65-845, Sec. 1, Laws of Florida, created a local law in Collier County
dealing with purchases from the State of Florida Division of Corrections; and
WHEREAS, this Act, codified as Sec. 2-1 in the Code of Laws and Ordinances of
Collier County by the Municipal Code Corporation, provides as follows:
"Sec. 2-1. - Purchases from state division of corrections.
The sheriff, the board of county commissioners, or any school or public
institution or agency financed by county or municipal funds, is authorized to
purchase and the state division of corrections is authorized to sell any item,
including brick, produced, processed or manufactured by the division not required
for use therein or for use in any institution under the supervision of the board of
commissioners of state institutions;" and
WHEREAS, pursuant to Ch. 71-29, Laws of Florida, this provision was repealed as a
State of Florida Act and assumed status as a local ordinance; and
WHEREAS, the Board of County Commissioners desires to repeal this ordinance in its
entirety as serving no present public purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: Repeal of Sec. 2-1, Collier County Code of Laws and Ordinances.
Sec. 2-1 of the Code of Laws and Ordinances of Collier County (Purchases from state
division of corrections) is hereby repealed in its entirety.
SECTION TWO: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a part of the Code of Laws
and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or

re-lettered to accomplish such, and the word "ordinance" may be changed to "section," "article,"
or any other appropriate word.
SECTION THREE: Conflict and Severability.
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION FOUR: Effective Date.
This Ordinance shall take effect upon filing with the Florida Department of State.
