Thank you. 16A16' RESOLUTION NO. 2012 - -10_ A RESOLUTION AMENDING RESOLUTION NO. 2011 -105 AND AUTHORIZING THE CONDEMNATION OF THOSE PERPETUAL AND TEMPORARY EASEMENT INTERESTS NECESSARY FOR THE CONSTRUCTION OF STORMWATER IMPROVEMENTS KNOWN AS THE US -41 DITCH SEGMENT OF THE LELY AREA STORMWATER IMPROVEMENT PROJECT. (PROJECT NO. 51101). WHEREAS, the Board of County Commissioners of Collier County, Florida, desires to improve the treatment and control of stormwater in the East Naples Area in order to alleviate flooding; and WHEREAS, the Lely Area Stormwater Improvement Project consists of improvements to an existing drainage system for an approximately 11,100 acre area located in East Naples, of which the US -41 Ditch (hereinafter referred to as the "Project ") is one phase; and WHEREAS, the Project includes the expansion of existing ditches to improve conveyance and capacity of the flow way; and WHEREAS, the Lely Area Stormwater Improvement Project is in accordance with both the Capital Improvement Element and Drainage Sub - element of the Growth Management Plan; and WHEREAS, on June 15, 2011 and after due consideration on its regular agenda and majority vote, the Board adopted Resolution No. 2011 -105 authorizing the condemnation of easements necessary for construction of the Project; and WHEREAS, certain of the legal descriptions attached to foresaid resolution contained scrivener's errors; and WHEREAS, the Board desires to correct the afore - described scrivener's errors by adopting this amending resolution with corrected legal descriptions attached thereto; and WHEREAS, the location for the construction of the proposed improvements has been fixed by survey and is collectively represented by the legal descriptions comprising Exhibit "A" attached hereto and incorporated herein; and 16A16 WHEREAS, after consideration of the availability of alternate routes and locations, the comparative costs of Project alternatives, various impacts upon the environment, long range planning options, and public safety considerations, the Board desires to exercise its right to condemn the property for public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the Board that it is necessary and in the public's best interest to acquire the property described in Exhibit "A" (the "Property ") for the purpose of constructing the improvements proposed as part of the US -41 Ditch segment of the Lely Area Stormwater Improvement Project located in East Naples, and for providing access to the improvements, in order to protect the health, safety and welfare of the citizens of Collier County. AND IT IS FURTHER RESOLVED that acquisition of the Property and construction upon the Property is part of the County's long range planning effort to alleviate flooding in the East Naples area. AND IT IS FURTHER RESOLVED that the Board has reviewed the staff report and considered the presentation concerning alternative locations for the Project, various impacts to the environment, public safety and welfare considerations associated with the design and construction of the Project, and the costs associated with the design, property rights acquisition, and construction of the Project; and the Board finds that after consideration of these issues, the most feasible location for construction of the proposed improvements is collectively represented by the legal descriptions comprising Exhibit "A" attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that the perpetual, non - exclusive drainage easements include the right to place and/or excavate materials for the purpose of constructing, operating, and maintaining drainage structures and facilities, including but not limited to Amending Condemnation Resolution Page 2 16A16 ditches, swales, earthen berms, rip -rap and retaining wall systems, underground pipes, culverts and various types of water control structures within the easement areas. These easements also include the right to remove and use any and all excavated material and the right to perpetual maintenance of drainage facilities thereon and adjacent thereto. AND IT IS FURTHER RESOLVED that the temporary construction easements include the right to construct drainage facilities within the public right -of -way immediately adjacent thereto and to restore driveways beyond the existing US -41 right -of -way. These easements also include the right to remove and use any and all excavated material. AND IT IS FURTHER RESOLVED that foresaid easement interests, more fully described in Exhibit "A" attached hereto and incorporated herein, are necessary for the construction of the Project. AND IT IS FURTHER RESOLVED that all of the Property shall be put to public purposes. AND IT IS FURTHER RESOLVED that the County staff is hereby authorized to immediately acquire by gift, purchase or condemnation, in accordance with the provisions of Chapters 73, 74 and 127, Florida Statutes, the real property interests more particularly described in Exhibit "A ", attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that no mobile homes are located on the Property and therefore it will not be necessary to remove any mobile homes from the Property to be acquired.
