The undersigned, in consideration of the payment of $1.00 and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to
Florida Power & Light Company, its licensees, agents, successors, and assigns ("FPL"), a non-
exclusive easement forever for the construction, operation and maintenance of underground
electric utility facilities(including cables, conduits, appurtenant equipment, and appurtenant above
ground equipment)to be installed from time to time: with the right to reconstruct, improve, add to.
enlarge. change the voltage, as well as,the size of and remove such facilities or any of them within
an easement described as follows:

Together with the right to permit FPL to attach wires to any facilities hereunder and lay cable and
conduit within the easement and to operate the same for FPL's communications purposes; the
right of ingress and egress to the Easement Area at all times;the right to clear the land and keep it
cleared of all trees, undergrowth and other obstructions within the Easement Area: to trim and cut
and keep trimmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the
easement area which might interfere with or fall upon the lines or systems of communications or
power transmission or distribution; and further grants,to the fullest extent the undersigned has the
power to grant, if at all, the rights hereinabove granted on the Easement Area heretofore
described, over, along, under and across the roads, streets or highways adjoining or through said
Easement Area.

a return federal express mailer to Minutes & Records' attention. Once the original Easement
is fully signed on behalf of Collier County, please forward it to Denise Rach in this mailer
dating the federal express airbill.
Denise Rach will process this through FCT for signature and return of the fully signed original
to your office. Once you receive the fully signed original, please process for recording with
the Recording Form provided. The recorded original should be returned to your office.
We would appreciate you letting us know (by email) when you send out the federal express
mailer to Denise Rach so that we can monitor its return.

electrical infrastructure relating to the above - referenced County facility. As you can see, the
Easement includes the previously provided FCT required language. Please be kind enough to
process this for review and acceptance by FCT.
Once Mr. Mercer or other appropriate representative has signed the original where indicated on
page 2, please return the fully signed original to Collier County Minutes & Records in the
enclosed return federal express mailer. That original will then be processed for recording in the
Collier County Public Records. We will furnish you with a copy of the recorded document.

WHEREAS, Grantor has acquired the property with partial funding from the Florida Communities
Trust (FCT), and the Property is subject to certain limitations provided In the FCT Grant Award
Agreement a/k/o the Declaration of Restrictive Covenants, as amended (as recorded In OR
Book 4273, Page 713 in the Public Records of Collier County, Florida; and Amendment recorded
in OR Book 4817, Page 2217 In the Public Records of Collier County, Florida), hereinafter referred
to as the "Agreement," and
WHEREAS, as part and condition of the FCT funding, the County provided and FCT approved a
Management Plan for the project site, and together with the Agreement, the terms of which are
hereby incorporated herein by reference; and
WHEREAS, Grantor intends that the conservation and recreation values of the Property be
preserved and enhanced In accordance with the Management Plan, as it may be amended
from time to time only after review and approval by FCT, and
WHEREAS, All activities by the Grantor and Grantee shall be consistent With the Agreement and
Management Plan.
