Executive Summary
Authorize the County Attorney's Office to make an Offer of Judgment to Respondent, DDRM
Countryside, LLC, in the amount of $155,001 for the acquisition of Parcels 105 and 705 in the
lawsuit styled Collier County 1'. llig/zlaml Properties (!f Lee and Collier Limited, et aL, Case No.
06-0563-CA (Santa Barbara Boulevard Project #62(81). (Fiscal Impact: $35,101, if accepted).
OBJECTIVE: Approve and authorize the making of an Offer of Judgment pursuant to Section
73.032, Fla. Stat., to property owner, DDRM Countryside LLC. in the amount of $155,001, as full
compensation, excepting attorney's fees and costs, for the taking of Parcel Nos. 105 and 705 in the
lawsuit styled Collier COllnty v. High/and Properties of Lee and Collier Limited. et al.. Case No.
06-0563-CA, Santa Barbara Boulevard Project No. 62081.
CONSIDERATIONS: Collier County condemned a 3,723 square foot right-ot:way parcel in fee
simple (Parcel No. 105), together with a 70S square foot temporary construction casement (Parcel
No. 705), as pmi of the Santa Barbara Boulevard improvement project ti'01TI the property owner,
DDRM Countryside, LLC. The County's initial afTer for Parccls 105 and 70S was $109,500 (the
appraiser's estimate of full compensation as of January 11, 2(06). The otfer was not accepted. The
appraisal was updated on June 27, l006, and pursuant to the Order of Taking hearing held on July
18, 2006, the County deposited the slim of $119,900 in the Court Registry. The owner's attorney is
saying that the shopping center has been damaged by the taking and that full compensation is more
like $1,314,000.

After several negotiations and a i'ailed medi3tion, this Case has been set for trial in April, 201 1. The
County, in an effort to avoid the time and expense of a trial, would like to make an afTer of
Judgment in the amount of SI55,c)O! as full compensation for Parcels 105 and 705, excluding
attorney's fees, expert fees and costs, wbich will expire in 30 days unless extended by the County or
accepted. If tbe property owner accepts the oller, tbe County will be required to pay an additional
$35,101, which will be paid fo the property owner by Stipulated Final Judgment of the court. Ifthe
property owner rejects tbe offer and 1~lils to recovcr more tban $ I 55,00 If(ll' Parcels 105 and 705,
either through settlement or jury verdict. the County will not be required to pay any costs incurred
by the property owner aller the date of the ofler's rejection. This would include any expert witness
fees and appraisal fees. Although the olkr docs not include attorney's Ices. if tbe property owner
accepts the otfer, the County would be responsible le)r attorney's fees pursuant to Section 73.092,
Fla. Stat., and the owner's expcrt ICes and costs. Additionally, the County would tendcr a zoning
letter to the Respondent cstablishing that in the event of future devclopmenf or redcvelopmcnt, e.g.,
a redevelopment to a boutique strip mall, the County will not require replacemcnt of thc landscape
buffer nor to any non-conll>rlning landscaping. This commitment lI'om County Zoning shall run
with the land and benctit fllture owners of Ihe property.
The County Attorncy's Otticc has reviewed all considcrations in making this OfTer of Judgment and
has calculated in good f~lith this offcr of full compensation I(lr the property interests taken. This
oftlee considers the tcrms of the OI'ICr of Judgment to he rcasonable.
