EXECUTIVE SUMMARY
Recommendation to ratify items 6, 9 and 10 from the November Administrative Change Order
Report.
OBJECTIVE: To provide the Board with additional information and background concerning three
previously approved changes to contracts,
CONSIDERATIONS: On November 9, 2010, the Board of County Commissioners ratified the
changes to contracts report for the period from September 21 to October 18, 2010, Pursuant to the
motion to approve, the Board directed that three of the items be removed from the report and
additional information provided at the next Board meeting,
Item # 6 was a change order totaling $161,553,30 pertaining to the construction of a new public boat
park near Goodland, Items 9 and 10 relate to a "zero dollar" change to a fixed term contract for
handyman and minor carpentry services, The following is a summary of the circumstances pertaining
to each,
ITEM # 6, GOODLAND BOAT PARK
The Goodland Project consists of the development of a 5,22 acres grass rools site for a new Collier
County Boat Park on Coon Key Pass opening up to the 10,000 Island National Marine Sanctuary,

The park includes 75 boat trailer parking spaces; 16 regular vehicle spaces: a two lane boat loading
ramp; boat docks with viewing and fishing decks; handicap access boat ramp; finger pier with 12 wet
boat slips; 11 wet slip dock; a Dock Master Building with bail tanks, small store, restroom facilities and
a meeting room; a covered picnic pavilion, bike racks, paver sidewalks, landscaping and a storm
water management system,
The design consultant on the project was Johnson Engineering, The contract with Johnson
Engineering was solicited in June 2005 and the contract awarded by the BCC in April 2006, Boran,
Craig, Barber, Engel, Construction Company Inc, (BCBE) was the general contractor on this project
Prior to this time, BCBE had performed very little work for Collier County and concentrated their
efforts to commercial condominium construction on the east coast of Florida,
A detailed summary of this change order is attached, These changes are a result of value added
items, code complaint items, unforeseen site conditions and errors, The largest unforeseen site
condition was the quality of sub-surface soils, Collier County purchased this site from a private
developer who had obtained permits to build the Dolphin Cove condominium complex, Soil borings
from Dolphin Cove as well as additional borings taken at the site entrance by Johnson Engineering
were used to develop the structural design of the site, However, the borings did not adequately reflect
the extent of unsuitable soil conditions on site, The site is located directly on a non uniform peat
formation and although the building design was piled; the roads, stormwater piping, drop inlets and
boat ramp required much more unsuitable soil removal and structural back fill, In addition, the
existing pile design required longer lengths to obtain sufficient friction resistance, To illustrate the
extent to which the soil was a problem, the flag pole had to be piled to prevent unwanted or differential
settlement
Code compliant items in this change order were very small and mainly resulted in code changes that
occurred between the time the design was completed and when the project was bid, Value added
items included items that were identified prior to bidding the contract, but purposely excluded from the

bid package until they were ready for subsequent inclusion and items that were identified during
construction at the request of the community, The bait tanks, flag pole and county sign were all
provided by the county to save costs, The installations were provided by the contractor as a value
added item, Additional landscaping, sod and drainage were provided at the community's request to
enhance the project. The fish cleaning station could not be added to the construction plans until
direction from the FDEP was obtained, which came after construction had commenced,
It is staff's position that the engineer of record committed several errors and omissions in the
execution of the design of this project. Staff is presently in discussion with the firm regarding the
recovery of damages. It is staff's expectation that a recommendation to the BCC will be forthcoming
in the first quarter of 2011.
Collier County Project Management and the Purchasing Department did an outstanding job keeping
this project on track and overcoming these and other obstacles, In spite of these issues, this project
was completed well below the project budget. It is an outstanding facility with exceptional community
acceptaQce,
ITEMS 9 AND 10, HANDYMAN AND MINOR CARPENTRY SERVICES
The purpose of the contract was to engage small/medium size vendors to perform small repair and
maintenance jobs on an as needed basis, The contract was formulated under a highly competitive
formal sealed bid process undertaken in October 2008,
Each bidder was required to provide various hourly rates for maintenance services and mark up
percentages for the cost of equipment, supplies and subcontracted services' The bid invitation (ITB)
included an award formula that took into account each line item solicited in the hid invitation 15 bids
were received and award was made to the five lowest, qualified and responsive bidders in February,
2009,
The ITB stated that the County reserved the right to obtain quotes from multiple firms under the
contract. but did not require it. Each awardee was asked to sign a services agreement and
unfortunately, the agreement stated that the County would obtain price quotes from each firm under
contract for each job (which was contrary to the original intent),
Several months after award, Purchasing staff received comments from the departments using the
contract that the requirement to quote everv iob regardless of dollar value was creating undue
inefficiency, Further, that requirement was counter to the purchasing policy as most of the jobs fall
below the $3,000 price competition threshold set forth in the policy, Accordingly, Purchasing staff
processed an amendment to the contract removing the absolute requirement to obtain multiple quotes
for every job regardless of cost and also added language re-stating that no job under the contract
could exceed $50,000,
The amendment was distributed to all five contractors, Two of the five vendors (Homescape
Construction. Inc, and OneSource Construction) returned the signed amendments and the Board
ratified the amendment to their contracts on October 13, 2009, Items 9 and 10 on the November
change report were those same amendments signed by two more (BO Concrete and Spectrum
Contracting) of the five vendors under contract. The fifth contractor (Cali & Associates) has never
returned the amendment and chose not to renew their contract.
It is staff's position that multiple price quotes from all of the vendors under contract are not needed for
every job given that the original contracts were awarded through a robust formal competitive process,

that the jobs under the contract are generally small in dollar value, and that an amendment to the
contract to eliminate the requirement to obtain multiple quotes for every job was previously ratified by
the Board on October 13, 2009,
FISCAL IMPACT: Funds for item # 6 are available within the project budget There is no fiscal
impact associated with items 9 and 10,
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
Executive Summary,
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's
Office and is legally sufficient for Board action,-SRT
