EXECUTIVE SUMMARY
Recommendation to accept the deed and approve transfer of title to Habitat for
Humanity upon payment of all County taxes, assessments, and Code
Enforcement hard costs relating to property located at 5408 Carlton Street, Collier
County, Florida.
OBJECTIVE: That the Board of County Commissioners (Board) accept a Quit Claim
Deed from Bank of America, NA. and approve transfer of title to Habitat for Humanity
upon payment of all County taxes, assessments, and Code Enforcement hard costs
relating to property located at 5408 Carlton Street.
CONSIDERATIONS:
Between June 28, 2001 and March 6, 2008, the Code Enforcement Board (CEB) found
Marion Smith and James A. Seals (Respondents) in violation of the Collier County Code
of Laws and Ordinances for various violations including litter in the rear yard on the
property, accumulation of litter, unlicensed/inoperable vehicles on residential property,
failure to register rental property, and multiple minimum housing code violations.
Written orders were recorded on July 17, 2001 at OR. Book 2885, Pages 1541-1543;
and on August 23,2001 at OR. Book 2888, Page 1510; and on August 2,2006 at
O.R. Book 4081, Page 2827; and on February 28,2007 at O.R. Book 4190, Page 0574,
and on September 6, 2006 at OR. Book 4101, Page 0165, and on February 28. 2007 at
OR. Book 4190, Page 0568, and on September 6, 2006 at OR Book 4101, Page
0149; and on February 28, 2007 at OR. Book 4190, Page 0572, all of the Public
Records of Collier, County, Florida. The property was brought into compliance by the
Respondents for the above noted violations.
On August 22, 2006, OSM Case No. 2006050608, the Special Magistrate found
Respondents in violation of the Code of Laws and Ordinances for multiple minimum
housing code violations. A written order was recorded on September 6, 2006, at OR.
4101, Page 0153.
Based on the above order, the Special Magistrate entered a lien order, which was
recorded on February 28, 2007 at O.R. 4190, Page 0570, of the Official Public Records.
Respondents were ordered to correct the violations on or before October 23, 2006, or a
fine of $100 per day would be imposed until compliance had been met. Respondents
were also assessed operational costs in the amount of $187.64. Based on accrued
fines for the noncompliance period of 1,320 days at $100 per day, the accrued lien
amount is $132,187.64 which includes $187.64 for operational costs.

On June 1, 2006, Bank of America, NA, mortgagee, initiated foreclosure proceedings
against the Respondents, and obtained title via foreclosure on July 27, 2009. The
County had liens on the property that were not foreclosed, including several code
violations that occurred while the foreclosure was in progress. On May 26,2010, Bank
of America filed a Quit Claim Deed to transfer title to the Collier County Board of County

Commissioners. In order to complete this conveyance, formal acceptance by the BCC
is necessary.
Habitat for Humanity of Collier County would like to purchase this property from the
County with the understanding that the County will be demolishing Ihe existing
improvements. and leaving the lot empty. Habitat for Humanity has agreed to pay
Collier County for all taxes and hard costs, including demolition costs, which are not
expected to exceed $20,000.
FISCAL IMPACT: None. If the Board approves this item, the County will be reimbursed
for all past due taxes and the hard costs. including the cost of demolition.
GROWTH MANAGEMENT IMPACT: There is no growth management impact
associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. - JW
RECOMMENDATION: That the Board accept the Quit Claim Deed from Bank of
America, NA, and authorize staff to Quit Claim Deed the Property to Habitat for
Humanity once the payment for taxes and assessments in the amount of $6,897.13,
and payment in the amount of $1,830.61 for Code Enforcement hard costs, and
payment for demolition estimated at $8,500.00 has been made relating to property
located at 5408 Carlton Street, Naples, Florida 34113.

AGREEMENT
THIS AGREEMENT (hereinafter referred to as the "Agreement") is made and entered into
this day of , 2010, by and between COLLIER COUNTY, a Political
Subdivision of the State of Florida, its successors and assigns, whose mailing address is 3335
Tamiami Trail East, Suite 101, Naples, Florida 34112-5356 (hereinafter referred to as "County"), and
HABITAT FOR HUMANITY of COLLIER COUNTY, INC., a Florida Non Profit Corporation, whose
mailing address is 11145 Tamiami Trail East, Naples, Florida 34113 (hereinafter referred to as
"Habitat");
WHEREAS, County is the owner of that certain parcel of real property (hereinafter referred to as
"Property"), located in Collier County, State of Florida, and being more particularly described as follows:
lots 1 and 2, Bock 12, NAPLES MANOR ADDITION, according to the Plat thereof, as recorded in
Plat Book 3, Pages 67 and 68, of the Public Records of Collier County, Florida.
WHEREAS, County desires to convey the Property "As Is" to Habitat for the stated purposes and
Habitat desires to acquire the Property "As Is", on the terms and conditions set forth herein; and
WHEREAS, Habitat has agreed to compensate County for conveyance of the Property;
NOW THEREFORE, in consideration of these premises, the sum of Ten Dollars ($10.00), and
other good and valuable consideration, the receipt and sufficiency of which is hereby mutually
acknowledged, it is agreed by and between the parties as follows:
1. County shall convey the Property to Habitat via Quit Claim Deed for a sum not to exceed Twenty-
Thousand Dollars ($20,000.00), and other good and valuable consideration, said transaction
hereinafter referred to as the "Closing" Said payment shall be full compensation for the Property
conveyed, including all associated hard costs, unpaid taxes, title commitment, demolition,
landscaping, trees. shrubs, improvements, and fixtures located thereon. This is a cash transaction
with no contingencies for financing.
2. The Closing of the transaction shall be held on or before March 31. 2011. The Closing shall be
held at the Collier County Attorney's Office, Administration Building, 3299 Tamiami Trail East, Suite
800, Naples, Florida, or through County's Title Company. At Closing, Habitat shall deliver the
consideration amount to County and County shall deliver the fully executed Quit Claim Deed to
Habitat Habitat shall be entitled to full possession of the Property at Clo,sing.
3. County shall convey the Property "As Is" to Habitat
4. Each party shall be responsible for the payment of its own attorney's fees. Habitat, at its sole cost
and expense, shall pay at Closing all documentary stamp taxes due relating to the recording of the
Quit Claim Deed, if any, in accordance with Chapter 201.01, Florida Statutes, and the cost of
recording any instruments necessary to clear County's title to the Property.
5. Habitat shall pay for the cost of recording the Quit Claim Deed. Real Property taxes and
assessments shall be paid by Habitat Habitat shall pay for the cost of the title commitment. If
Closing occurs at a date which the current year's millage is not fixed, taxes will be prorated based
upon such prior year's millage.

6. Conveyance of the Property by County is contingent upon no other provisions, conditions, or
premises other than those so stated herein; and the written Agreement shall constitute the
entire Agreement and understanding of the parties, and there are no other prior or written or
oral agreements, undertakings, promises, warranties, or covenants not contained here.
7. This Agreement and the provisions hereof shall be effective as of the date this Agreement is
executed by both parties and shall inure to the benefit of and be binding upon both parties
hereto and their respective heirs, executors, personal representatives, successors, successor
trustees, and/or assignees, whenever the contest so requires or admits.
8. Any amendment to this Agreement shall not bind any of the parties hereof unless such
amendment is in writing and executed and dated by Habitat and County. Any amendment to
this Agreement shall be binding upon Habitat and County as soon as it has been executed by
both parties.
9. No waiver of any provisions of this Agreement shall be effective unless it is in writing signed by
the party against whom it is asserted, and any waiver of any provision of this Agreement shall
be applicable only to the specific instance to which it is related and shall not be deemed to be a
continuing or future waiver as to such provision or a waiver as to any other provision.
10. This Agreement is governed and construed in accordance with the laws of the State of Florida.

It has been brought to our intention that a bank owned home located at 5408
Carlton St. was recently transferred to Collier County to achieve compliance
rather that the bank spending the funds to abate outstanding Code issues. If
the Board of County Commissioners accepts title to the property, Habitat for
Humanity wouid be interested in purchasing the property,

Habitat for Humanity would like to purchase this property from the County
understanding that the County will be demolishing the existing home leaving
the lot empty. Habitat for Humanity also understands that there are certain
costs the County has incurred to demolish the home plus some overhead
costs. These costs as we understand wouid not exceed $20,000,
If Habitat for Humanity could purchase the property at cost not to exceed
$20,000 we are ready and willing to build a new single family home on the
site within 8 months of taking title to the property.

Habitat for Humanity continues to rehab and build homes for those families in
our County that make less than 60% of the median income and are pleased to
be working with the County to put a decent hard working family into a home.
We see this as a great partnership that is truly a win-win for all parties
involved.
