OBJECTIVE: To approve and exccutc a Shoreline Stabilization Grant Agreement between the
Community Redevelopment Agency (CRA) and a Grant Applicant within the Bayshore Gateway Triangle
Community Redevelopment area. (2736 Riverview Drive and 2772 Rivervicw Drive, total 01'$9,725.00)
CONSIDERATIONS: The purpose of thc grant program is to residents and homeowners with property
located on Haldeman Creek to maintain a stabilized shoreline, slowing tlie rate of sedimentation on the
canals by providing matching grant funds, The CRA provides a project cost-match of 50% from Tax
Increment Funds capped at $5,()()() per parcel I.D. l()r shoreline improvements. Remaining project dol}ars
are provided by the applicant The CRA's Shoreline Stabilization Grant Program is funded annually at a
level that satisfies exisling grant obligations Ii-om prior liscal years and funds fulure grant opportunities.
For FYII, a total of $151 ,O()(I is budgeted !(lr all grant programs, From this allocation, 105,213 dollars are
committed to date.
The Shoreline Stabilization Grant application (Exhibit A) submitted by Williain D. Marsh, Trustee of the
William D. Marsh and Karcn E, Marsh Living Trust, owncrs of thc residential properties at 2736
Riverview Drive and 2772 Rivervicw Drivc, Naples l'lurida, 34112, was rccommended for approval by the
Bayshore/Gateway Trianglc CRA Local Advisory Board. The Marsh f'lI11ily purchased the two adjacent
waterfront parcels with pre-existing single fitmily homes, This Gnlllt Program allows up to $5,000 per
parcell.D. and this dnal property application qualifies,
LEGAL CONSIDERATIONS: This item lias been reviewed by 1he County Attorney Office and is
sufficient for Board consideration and <lpprL'>v<d, STW
FISCAL IMPACT: SulIicient budge1 exists within Fund (I ~7) FYII budget to satisfy this application.
This project totals $1 Y,450,OO. and the request is f;,>1' up to $Y,725,()() to be split between the two

WITNESSETH:
WHEREAS, in Collier County Ordinance No. 2002-38, the Board of County
Commissioners delegated authority to the CRA to award and administer CRA grants including
contracts with Grantees for CRA grants; and
WHEREAS, CRA Ordinance No, 08-61 reestablished the Shoreline Stabilization
Improvement Grant; and
WHEREAS, Grantee has applied for two Shoreline Stabilization Grants in the amount of

NOW, TIlEREFORE, in consideration of the mutual covenants cotltained herein and
other valuable consideration, the parties agree as follows:
1. Grantee acknowledges to the eRA thai Grantee has received a copy of the Collier
COWlty Community Shoreline Stabilization !mprovement Grant Program (hereinafter referred to
as "Grant Program"j, that Grantee has read the Grant Program, and that Grantee has had ample
opportunity to discuss the Grant Program with Grantee's counselor advisor. Grantee further
acknowledges to the CRA that Grantee understands and agrees to IIbide by all of the terms and
conditions of the Grant Program. Grantee agrees to the tenus and conditions of the Grant
Program.

3. Grantee has agreed to make shoreline improvements to the property pursuant to

hereto as Exhibit A and incorporated herein by reference.

4. Grantee agrees to complete the construction of the shoreline stabilization
improvements within one (1) year of CRA Approval. Grantee also agrees to fund at least 50% of
the costs of the shore1iD.e improvements, Grantee is prohibited from paying fur any
Shoreline Stabilization Grant Agreement FY 2011

improvements funded Wider this program with cash. All payments for approved projects must be
in the form of II check or credit can! drawing on funds from Grantee's accounts.
5. CRA has approved two grants to Grantee or a total amount of {; "'1,72. S'. C>C>
t'l be administered pursuant to the terms of this Agreement based on an estimated cost of
'i# ,q. <-Hi o. If the IICtual costs are less than $10,000 to construct the shoreline
improvements. the grant amount shall be reduced dollar for dollar in matching CRA funds as
determined by ratio of matching private funds required.
6. Unless prior disclosure is included in the grant application, no Grantee, or any
immediate relative of Grantee, shall serve as a contraetor or subcontractor for the construction of
the shoreline improvements and no Grantee, or any immediate relative of Grantee, sha11 receive
compensation for labor for the construction of the shoreline improvements. An immediate
relative of Grantee shall include mother, father, brother, sister, son, daughter, aunt, lUIcle and
cousin or family member by marriage to iuclude mother-in-law, father-in-law, brother-in-law
and sister-in-law,
7. Grantee agrees to obtain all necessary permits from the US Army Corps of
Engineers, Department of Environmental Protection and Collier County Growth Management.
Upon completion of the work, Grantee shall submit to the eRA staff a project summary report,
two (2) 8 inch by 10 inch photos of the completed improvements, II list of materials and
construction techniques used, a list of architects and/or contractors, and any other information
specific to the project or requested by the CRA staff. The CRA, through its staff, shall confirm
that the shoreline improvements were constructed pursuant to the terms of the application
approved by the CRA.
8. Within forty-five (45) days after confirmation that the shoreline improvements
were constructed pmsuant to the terms of the approved IIpplication, Grantee shall be issued a
check in the amount ofthe grant. However, if Grantee fails to make the improvements pursuant
to the terms of the approved IIpplication, or if the project is not completed within one (1) year of
CRA approval, or if Grantee fails to fund at least 50% of the cost of the shoreline improvements,
the grant sha11 be deemed automatically revoked and Grantee sha11 be entitled to no funding.

This Agreement shall be governed and construed pursuant to the laws of the State

No change, modification or amendment, or any representation, promise or condition, or any
waiver, to this Agreement shall be binding unless in writing and signed by a duly authorized

II. This Agreement is personal to Grantee, and may not be assigned or transferred by
Grantee or to Grantee's respective heirs, personal representatives, successors or assigns without
the prior written consent of the CRA.
