EXECUTIVE SUMMARY
Recommendation for the County Manager or designee to permit removal of existing
seawall and dune restoration without J'equiring applicant to amendment Coastal
Construction Control Line Variance Resolution 82-179.
OBJECTIVE: To obtain Board of County Commissioners (BCe) approval to allow Casa
Grande Homeowners' Association to pursue dune restoration without requiring replacement of
seawall or amending Coastal Construction Control Line Variance (CCCL V) Resolution 82- I 79.
CONSIDERATIONS: A representative of Casa Grande Homeowners' Association
(Association) appeared bef()re the BCC for a public petition on July 27, 2010, and at the
Association's request the BCC authorized staff to issue the building pernlits for the pool work in
advance of the resolution of the variance noncompliance issues, on the condition that the
Association post a bond for the dune restoration and seawall work, amend the 1982 CCCL V if
necessary and that the certif1cate of completion for the pool work would not be finalized until the
seawall and dune work was complete,
The Association has decided not to pursue the pool work in advance of the dune and seawall
work. They have requcsted authorization to proceed with the removal of the seawall and the dune
restoration work, without replacement of the seawall, based on the provisions of the variance and
.- in particular the flexibility granted to the county under Paragraph 6 of the Agreement. Staff is of
the opinion that the agreement allows for alternatives to relocating the seawall.
Additionally, the Collier County Growth Management Plan Conservation and Coastal
Management Element (CCME) Policy lOA prohibits shoreline hardening unless necessary to
protect existing structures, Staff has confirmed that the Florida Department of Environmental
Protection does not issue pernlits for arnloring the shoreline unless structures are vulnerable as
defined by Florida Statutes, No other developments in this area have seawalls or armoring and
there are no known threats that would support considering the Casa Grande Condominium as
requiring seawall protection. Therefore it is highly unlikely the Asso~iation could obtain the
State permits required to allow construction of a new seawall.
FISCAL IMP ACT: None for the County. The Association would not bb required to amend the
approved variance to remove the replacement seawall and save money on preparation, review
and advertising fees.
GROWTH MANAGEMENT IMPACT: This request is consistent with the intent of the
Growth Management Plan CCME Policies and Objectives for developed coastal baniers.
LEGAL CONSIDERATIONS: This item is legally sufficient for BCC approval. -JAK

RECOMMENDATION: That the BCC approves the removal of the existing seawall and
dune restoration without replacing the seawall is consistent with the intent of Coastal
Construction Control Line Variance Resolution 82- 179.

RELATING TO PETITION CCCT-82-21C FOR A VARIANCE FROM
THE COASTAL CONSTRUCTION CONTROL LiNE AS REQUIRED BY
ORDINANCE 75-19.
WHEREAS, Union Properties of Southwest Flor~da, Inc., ,has requested
a variance from the Coastal Construction Control Line as required ,in
Ordinance 75-19 for the. purpose of constructing a $wimniin~ pool, wood
deck and a restroom/storage building, and for relocating _an existing
seawall to a landward position, regrading the subsequently exposed up-
land to a natural dune' profile and planting the area,~ith native coastal
veget~tion.
WP~REAS, the County Env~ronmentalist has reviewed said petition and
has prepared an Executive Summary regarding the petition, and
WHEREAS, the Board of County Commissioners has examined the Execu-
tive Summary with its recommendations:
NOlv; THEREFORE, BE IT RESOLVED, by the Board of County Commis-
sioners of Collier COllnty~ Florida that Petition CCCl-82-21C be granted
subject to the conditions listed below:

1. The granting of this petition.is to permit the construction of
a swimming pool, wood deck, and restroom/storage building, the
..~ landward relocation of the existing seawall, the regrading of
the subsequently exposed upland to a natural dune profile, and
the revegetation of the area with native coastal plants. All

building shall be mitigated by the relocation of the seawall
to a landward position and the restoration of the area seaward
of the pool to a natural dune community. The relocation and
restoration. shall be according' to the attached description

tion with the County Environmentalist. All activities shall
conform to the standards of the Department of Natural Re-

REQUESTING A VARIANCE FROM THE COASTAL CONSTRUCTION CONTROL LINE
FOR PROPERTY LOCATED ON LOTS 19 AND 20, BLOCK A, UNIT 1, CONNERS
VANDERBILT BEACH (CASA GRANDE CONDOMINIUM).
OBJECTIVE: The objective of this variance request is to permit the
construction of a swimming pool, a wood deCk, and a restroom/storage
bUilding, the relocation of an existing seawall to a position approx-
imately fifty (50) feet landward of its present location, and the
restoration of the dune zone seaward from and above the relocated
seawall.
CONSIDERATIONS:
1. In July 1982 Bruce Green, on behalf of Union Properties of
Southwest Florida, Inc., requested a CCCL variance to construct
a swimming pool, wood deck, restroom/storage bUilding, and
elevated boardwalk seaward of the Coastal Construction Control
Line at Casa Grande condominium on Vanderbilt Beach (Petition
CCCL-82-lC) .
2. Following the review of this petition, the County Environmentalist
recommended that the Board grant a variance for only the con-
r struction of the elevated boardwalk. The EnVironmentalist
recommended denial of a variance for the construction of the
other structures. The Board of County Commissioners followed
staff recommendations and a variance to build the boardwalk
was granted by Resolution 82-113.
3. In early October the petitioner requested reconsideration of the
request for the variance to permit the construction of the pool
and its accessory structures. The grounds for this request was
that previously (Resolution 80-254) a CCCL variance had been
granted to the property's former owner to COnstruct a condominium
up to 47 feet seaward of the Coastal Construction Control Line.
Prior to the review of Petition CCCL-82-lC and again following
the request for reconsideration, the County Environmentalist
sought the opinion of the County Attorney and the Community
Development Administrator on the applicability of Resolution
80-254. Both Mr. Saunders and Hr. Virta stated that Petition
CCCL-82-lC and the current request should be considered inde-
pendently of the 1980 CCCL Resolution.

A G R E E MEN T
~
THIS AGREEMENT made and entered into this
day of October,
1982 by and between UNION PROPERTIES OF SOUTHWEST FLORIDA, INC., a
Fl.orida corporation, (hereinafter I'Companyll), and COLLIER COUNTY, a
political sub-division of the State of Florida, (hereinafter "County").
RECITALS
The Company owns certain properties in Collier County, Florida,
more particularly described as Lots 19 and 20, Block A, Unit Number
One, Conner's Vanderbilt .Beach Estates, as recorded in Plat Book 3,

Pages 8 and 9 of the Public Records of Collier County. On November
18, 1980, while the property was under the ownership of the Company's
predecessor in title, the County granted a variance fro~ the Coastal
Construction Control Line (hereinafter "the Control Line") pursuant
to Ordinance No. 75-19. This variance permitted only the construction
of a condominium, part of which would extend 47 feet seaward of the
established coastal construction Control Line. This variance was
granted by County Resolution No. 80-254.
Subsequent to the granting of the variance the Company acquired
the title to the sUbject property. Although the variance allowed the
construction of a condominium building seaward of the Control Line,
the Company did not desire to build a building seaward of such line
and instead has constructed a building known as Casa Grande landward
of the Control Line. Although the Company had not utilized the right
granted by the variance to construct a building seaward of the Line,
the Company does desire to construct certain accessory uses to the
building, particularly a swimming pool and related decking and toilet
facilities (hereinafter lithe Amenities"), seaward of the Control Line.
In r~viewing t~i~ m~~~~_ with the County Environmentalist CO~
sul~ant, concern has been expressed by said Environmentalist over the

existing seawall located on this property. It is the opinion of the
Environmentalist that the location of this sea~all which is currently
124 feet seaward of the existing Control Line, constitutes a structure
which exacerbates the already existing erosion problems at Vanderbilt
Beach. It is the opinion of the Environmentalist that the relocation
of this seawall along with the construction of the other works (the
"WorksU), as further described in this agreement, will have a bene-
ficial effect on the beach and will lessen the danger of erosion to
adjoining properties. Following the review of Petition CCCL-82-1C
requesting County variance for the construction of the Amenities, the
County Environmentalist made a recommendation to the Board for denial.
This recommendation was upheld and a variance to build only the board-

walk was granted. The Environmentalist still maintains this view.
Nevertheless the 'Environmentalist is of the opinion that upon agreement
by the Company to construct the Works as described herein a recomrnen-
dation of approval to construct the Amenities could be made.
NOW THEREFORE in consideration of the mutual promises and cov-
en ants contained herein, the parties agree as follows:
1) The County has, contemporaneously with the approval of
this agreement, adopted a resolution granting unto the Company a
variance to construct the Amenities and the Works in accordance with
the drawings attached hereto as Exhibit A, and the Works as described
in Exhibit B.
2) This resolution shall not affect Resolution 82-113, granting
the Company a variance to construct a broadwalk as described therein.

3) The county agrees to issue such building permits and other
approvals, upon proper submission therefore, as are necessary to enable
Company to begin construction of the Amenities. Said permits shall be
issued expeditiously following proper submission therefore.
4) The County__r.ecognizes that the. Casa Grande condominium is
now nearly complete, and recognizes that non-completion of certain
structures at the north end of the building, to wit landscaping and

asphalt parking in order to enable the Company to aCCess the beach in
order to construct the Works, will not be a detriment to the issuance
of a certificate of occupancy for Casa Grande so long as all other
lawful requirements for the issuance of a certificate of occupanc~ are
~ met.
5) The Company agrees to construct the Works in accordance
with the description thereof contained on Exhibit B hereto.
6) The County and Company recognize that the construction of
the Works can be done only after the issuance of the necessary County,
State and Federal permits. The Company shall apply to appropriate
State and Federal agencies for permits to construct the Works, and shall
use its best efforts in obtaining said permits. Should said permits be
~
denied by State or Federal agencies the Company agrees to reasonably
modify the Works to the satisfaction of the permitting agency and the
County agrees to accept such modifications provided that they do not
substantially alter the purpose o~ the Works.
7) The County recognizes the immediate need of the Company to
obtain a CCCL variance in order to complete the constr~ction of the
condominium and the Amenities. Accordingly, upon the adoption of the
Resolution, and the execution of the agreement by both parties~ the
Company shall be entitled to begin construction of the Amenities imme-
diately upon the issuance of proper permits therefore as long as all
other governmental approvals are obtained.
8) The Company and County recognize that the construction of
the Works is being undertaken on the basis of the opinion of the County
I~ Environmentalist that such construction will not exacerbate ~xisting
erosion problems at Vanderbilt Beach, ~,d will in fact lessen the
adverse effect of storms upon the beach and adjoining properties to
the Company's property. The County agrees to hold harmless the Company
from any and all liabilitY-~0-adjoining property owners at Vanderbilt
Beach wherein the basis of said liability is solely that the movement

of the seawall landward from its present location 50 feet causes
erosion of the beach beyond that which would have occurred had the
existing wall not been moved. The County does not agree to hold the
Company harmless unless and until a court of competent jurisdiction
renders a judgment against the Company, which jUdgment is based on
the fact that the actual movement of the seawall 50 feet from its
present location caused damage to adjoining property owners and the
County shall only be liable for that amount of damages solely attri-
butable to the movement of the seawall as requested by the County.
