EXECUTIVE SUMMARY
Report on the status of compliance efforts by Queens Park Community Services
Association, Inc. pursuant to Board direction on January 12, 2010.
OBJECTIVE: On January 12, 2010, under Item 6.B., the Board of County
Commissioners (Board) directed staff to come back with a full report with possible
recommendations for the Board's consideration.
CONSIDERATIONS: On January 12, 2010, under a public petition (Item 6.B), Mr. Nick
Lichter, on behalf of Queens Park Community Services Association, Inc., discussed a
code violation which required removal of exotic plants from Hawaii Lake located in
Queens Park subdivision. Ownership to the lake has been the subject of a private
dispute between Landmark Communities (Developer) and the Queens Park
homeowners association (Association). A Quit Claim Deed had been conveyed by
Landmark Communities to Queens Park Community Services Association, Inc., and the
dispute centered around whether the Association had accepted the Deed (and
responsibility for the code violation). After appearing before the Board in January, the
homeowners association started the process of negotiation with contractors to obtain
compliance.
The Association diligently pursued abatement of all violations. On October 12, 2010, a
Compliance Notification Letter was mailed to Mr. Lichter. A copy of the letter has been
included in the backup to this item.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
GROWTH MANAGEMENT IMPACT: There is no growth management impact
associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. -JW
RECOMMENDATION: That the Board accept this report as final resolution of this
matter.
