EXECUTIVE SUMMARY
IN LIGHT OF THE RECENT LETTER FROM THE STATE OF FLORIDA DIRECTOR
OF OFFICE OF TOURISM AND ECONOMIC DEVELOPMENT POINTING OUT
JACKSON LABS HAD FAILED TO APPLY FOR FUNDING, I WILL CALL FOR A
MOTION ON DECEMBER 14,2010 TO STOP WASTING COUNTY STAFF'S TIME
AND TAXPAYER'S MONEY ON JACKSON LABS. THE JACKSON LABS LOCAL
FUNDING HAS DIVIDED TilE COMMUNITY AND IT'S TIME TO PUT THIS ISSUE
BEIIIND US AND MOVE FORWARD BY CONTINlJING DOING WHAT LOCAL
GOVERNMENT DOES BEST, PROVIDE SERVICE TO ITS RESIDENTS.
OBJECTIVE: To discuss the possibility of discontinuing the process of consideration to bring
Jackson Labs to Collicr County. It is a waste of taxpaycrs moncy and staff's time and needs to
be brought to an end. Jackson Labs has bccn an embarrassmcnt and it's timc for us to move on.

In light of the recent letter from the State of Florida Director of Office ofTourism and
Economic Development pointing out Jackson Labs has failed to apply for funding, I will call
for a motion on December 14, 2010 to stop wasting County staffs time and taxpayer's money
on Jackson Labs. The Jackson Labs local funding has divided Ihe community and it's time to
put this issue behind us and move forward by continuing doing what local government does
best, provide service to its residents. (Commissioner Henning)

Appropriation 2649 of Chapter 2008-152 for improvements to Launch
Complex 36 on the 45th Space Wing property. shall revert immediately and
is reappropriated for Fiscal Year 2010-2011 from the Economic
Development Transportation Trust Fund for improvements to other launch
complexes and space transportation facilities in order to attract new
space vehicle testi~g and launch business to the state; to address
intermodal requirements and impacts of the launch ranges, spaceports,
and other space transportation facilities; to advance aerospace
technology to meet the current and future needs of the United States
commercial space transportation industry; and to assist in the
development of joint-use facilities and technology that support aviation
and aerospace operations, including high altitude and suborbital flights
and range technology development. This section shall take effect upon
becoming law.
.SECTION 73. The nonrecurring sum of $75,000,000 is appropriated from
the General Revenue Fund to tte Executive Office of the Governor, Office
of Tourism, Trade and Economic Development, for the Innovation Incentive
Program 8S defined in Section 289.1089, Florida Statutes.
The funding provided in this section is contingent upon the enactment of
federal law which extends the enhanced Federal Medicaid Assistance
Percentage rate, as provided under the American Reinves~ment and
Recovery Act. (P.L. 111-5), from December 31, 2010, through June 3D,
2011.
of the funds provided in this section, $50,000,000 from nonrecurring
general revenue are part of a maximum three year commitment of
$130,000,000, subject to annual appropriation, to fund the development
of a research institute focused on genetics and personalized medicine.
Any applicant, to be eligible to apply, must have a demonstrated history
of genetic research, of earning national research grants, and of
establishing global partnerships and commercializing ita research, and
must meet the requirements provided below. Before receiving state funds,
the approved entity must enter into an agreement with the Office of
Trade, Tourism and Economic Development (OTTED) that, in addition to the
criteria and contract requirements established in Section 288.1089,
Florida Statutes, will meet the following requirements:
1) The mechanism to provide local matching funds will be adopted by the
local government within 120 days of the grant award from OTTED, and such
local commitment must include at least $130,000,000 of cash, committed
futu=e revenues which OTTED determines to have a value of $130,000,000,
land or infrastructure, or some combination thereof equaling
$130,000,000;
2) As part of the local match requirements tn Section 288.1089, Florida
Statutes, the project must have ~ecured a site of sufficient size, and
construction shall commence within 60 days of adoption of the local
matching funds mechanism;
3) Within 180 days of the award being granted, t~e entity, in
coordination with public and private partnerships, shall commence a
philanthropic campaign of up to $120,000,000. Revenues derived from
Buch a campaign may include but are not limited to cash or credit worthy
personal guarantees of philanthropic support. This effort must document
with OTTED the expected fundraising benchmarks for the first, fifth ar.d
tenth year of the project;
4) The entity may not have received prior funding from the Florida
Innovation Incentive fund or any other state funds;
S) The site of the facility should be within 25 miles of a state
designated rural area of critical economic concern;
6) Specific deadlines for construction and employment; and
7) The project will attract substantial additional economic activity to
the region.
The g~ant may be awarded, but no funds may be released if these
requirements are not met. If these requirements are not met by March 1,
2011, the funds provided above shall revert to the General Revenue Fund.
SECTION 74. The sum of $19,000,000 in nonrecurring funds is
appropriated from the General Revenu~ Fund for Fiscal Year 2009-2010 to
the Highway safety Operating Trust Fund in the Department of Highway
Safety and Motor Vehicles for the purpose of funding the general
operations of the department. This section shall take effect upon
becoming law.

Please be advised that the Office of Tourism, Trade, and Economic Development (OTTED) will
not he in a position to provide an award to theJ.ckson Laborarory before the end of the 2010
calendar yeat.
Prior to making an Innovation Incentive Program Awa.rd, o"rrED must receive an application
&om the organization for participation in the progtllrn. To date, 01TED has.uot received an
application Erom the Jackson Laboratory. To the best of our knowledge, the Jackson Laborntory is
still engaged in internal di5cussions .regarding the state funding.
After OTTED's receipt of the information,dlere are several steps that must take place before the
agency is c~p9.bIe of making a final awud, including, but not limited to, a ptoject anaIrsis,
Governor's r.evicw and app.roval, Legislative Budget Commission approval, and contract
negotiations. None of these events have occurted, and it is impossible for allof these events to
occur prior to January 4, 20t 1.

Thank you for your letter dated December 3, 2010 regarding the Office of Tourism,
Trade and Economic Development (OITED) and the Governor's agreement that there will not
be an award to The Jackson Laboratory before the new administJ'ation takes office on January 4,
201 I, if ever. Based on this agreement, our clients will not take further immediate legal action to
prevent OTTED and the Governor's review, approval and award to The JackSon Laboratory.
