Settlement Analysis; Sembler Parcels 806, 906, 807 and 907
This settlement involves one parent tract at the comer of Rattlesnake Hammock Road and CR
951. It is known as the Hammock Park Commerce Centre PUD.
The date of value is October 19, 2005. The County's appraiser valued the easements at $57,000.
The owner's appraiser valued the easements at $431,600 including a cost to cure. The difference
primarily relates to the land value of commercial property and the valuation of property
encumbered by FPL easements. The County's appraiser valued the commercial property at
$10/SF. The owner's appraiser valued the commercial property at $15/SF. The proposed
settlement assumes a value of $13/SF. This increase in value is due to the subject property being
located in an approved pun and activity center. The County's appraiser valued the easement
takings at 5% of full market value where the subject was encumbered by an FPL easement
compared to the owner's valuation at 25% of full market value. The proposed settlement
assumes a valuation of 1 0%.
The o'wner claims a cost to cure of $21,000 for 3 deflection pipes. The County agrees that this
cost is compensable.
This settlement assumes payment of no interest If this case proceeds to trial, the County would
be required to pay statutory interest from October 19,2005 on the difference between the deposit
amount and the verdict amount. Statutory interest through December equals an aggregate of
45%. A favorable verdict using $12/SF and a 10% valuation of the FPL easements would be
$152,726 and $43,076 in interest for a total of $195,802. Expert fees for trial for both County
and owner will likely exceed $200,000, which is a cost the County would bear.
I am recommending settlement because the County's trial exposure well exceeds the settlement
amoWlt.

MEDIATED SETTLEMENT AGREEMENT
At the Mediation Conference held on October 27, 2010, the parties reached the
following Settlement Agreement:
I. Petitioner will pay to Respondent, Sembler Family Partnership #42, Ltd.,
the sum of $170,000.00 in full settlement of all claims for compensation from Petitioner
whatsoever, including statutory interest and all claims related to real estate, but excluding
attorney's fees, experts' fees, and costs. Said sum will be subject to claims of
apportionment, if any. Petitioner is entitled to a credit in the amount of $57,000.00, said
amount having been previously deposited in the Registry of the Court in this case by
Petitioner. Upon the satisfaction of the terms and conditions of this Settlement
Agreement and the entry of the Stipulated Final Judgment in this matter, Petitioner will
deposit in the Registry of the Court the swn of $113,000.00, representing the difference
between the total settlement sum referenced above and Petitioner's previous deposit
referenced above.

2. In addition to the above-referenced settlement sum, Petitioner will pay to
Respondent's attorney $37,290.00 in full settlement and satisfaction of all attorney's fees
and attorney's litigation costs incurred by Respondent in this case.
3. In addition to the above-referenced settlement swn and the above-
referenced attorney's fees and attorney's litigation costs, Petitioner will pay to
Respondent's expert witnesses an amount to be determined in full satisfaction of all
expert witness costs incurred by Respondent in this case.
4. 1bis Settlement Agreement is subject to and conditioned upon final
approval by the Board of County Commissioners of Collier County.

5. Counsel for Petitioner and Respondent will jointly submit to the Court
a mutually approved Stipulated Final Judgment containing the tenus and conditions of
this Settlement Agreement within ten days following the final approval of this Settlement
Agreement by the Collier County Board of County Commissioners.
6. Attached hereto is an addendum to this Settlement Agreement

ADDENDUM TO MEDIA TED SETTLEMENT AGREEMENT
This settlement is made subject to the following additional conditions:
1.' The parties agree that Respondent, its successors and assigns, may use Parcels 806 and 807
for any purpose not inconsistent with the County's use, and specifically including retention
ponds, detention ponds, drainage, parking, open space, road crossings and utility crossings, and
may use Parcels 906 and 907 for utility crossings and one road crossing to connect to the parcel
to the east also owned by Respondent. Respondents agree that they will provide the County
with access to maintain their fiber, electric and raw water Jines located in Parcels 906 and 907,
with said access being, at a minimum, via the access which Respondent provides to FP &L for
FP&L's maintenance of FP&L's equipment located on the FP&L easements. The County may
use any or all of Parcels 806 and 807 to access said fiber, electric and raw water lines until
development of Respondent's property, and, thereafter, the specific route available to the County
for said maintenance shall be by mutual agreement of the County and Respondent. Said route
shall support the weight, size and turning movements of vehicles typically used for such
maintenance and repairs. Upon completion of any future maintenance or repair activities, the
County shall promptly restore the surface area of the easements to the condition which existed
prior to the County's use of the easement.

2. Parcels 806 and 807 are access easements to provide access to government facilities:
These parcels are not public road easements or private road easements for purposes of
determining setbacks. Parcels 906 and 907 are utility easements for raw water pipelines and
related infrastructure: The pipeline and infrastructure do not create additional setbacks for
development, and the County's utility easements do not limit Respondent's ability to construct
buildings, parking lots, driveways or landscaping immediately adjacent to Parcels 906 and 907,
provided access to Parcels 906 and 907, as provided in Paragraph 1 of this Addendum, is
maintained. Parcels 806, 807, 906 and 907 may be used for calculation of open space.
