CONSIDERATIONS: On October 19, 2005, Collier County deposited $285,900 into ... Registry of
the Court for Parcels 701R, 901R, 801N, 902AN, 902RA, 902RB, 703, 803RA, 803RB,903, 704, 904,
705,905,830,930,831,931, 832R, 932R and acquired title to said parcels in accordance with the Order
of Taking entered on Ocloba' 5, 2005. October 19, 2005 is the date of value. The subject ~1s consist
of Perpetual Non-Exclusive Access Easements, Utility Easements and Temporal)' ':CoDstruction
Easements for water lines and well sites.

These parcels were required as part of the South County Regional Water Treatment PI8nt, Reverse
Osmosis expansion, and more particuJarIy, the 20-MGD wellfield expansion to support ,,1reatment
facility.
On October 18, 2010, the parties mediated the case and agreed to a settlement of S1lS,SOO~OO for all

Settlement Analysis; Wilton Parcels
This settlement involves three separate parent tracts, two along Rattlesnake Hammock Road and
one along CR 951 near Lord's Way. The properties along Rattlesnake Hammock are part of the
proposed Hacienda Lakes DR!, formerly the proposed Toll Rattlesnake DRJ.
The date of value is October 19> 2005. The County>s appraiser valued the easements at $285>900.
The owner>s appraiser valued the easements at $2,413,100 including damage claims and costs to
cure. The differences primarily relate to the land value of residential property> the valuation of
property encumbered by FPL easements, and damage claims. The County's appraiser valued
residential property at $75,000/Acre and $85>000/Acre. The owner's appraiser valued the
residential property at $185,000/Acre. The proposed settlement assumes a value of $164,000
which was the selling price of the subject property one month before the Order of Taking. The
County's appraiser valued the easement takings at 5% of full market value where the subject was
encumbered by an FPL easement compared to owner's valuation at 40% of full market value.
The proposed settlement assumes a valuation of 10%.
The owner claims a cost to cure of $16,000 for 2 deflection boxes in 3 locations. The County
agrees that this cost is compensable for a total of $48,000.
Owner's fIrst damage claim related to an area that owner claimed had a reduced development
potential due to proximity to wells and location of an internal road as shown on the ERP permit.
This settlement assumes no payment for this claim.
Owner's second damage claim relates to increased development costs to construct the 4-laning of
Rattlesnake Hammock Road, which will be a requirement in the proposed PUD. Well No. 22 is
located in the path of the future road which requires a road design around the well. It is my
opinion that this cost is compensable and would be awarded by a jury if this case were to proceed
to trial.
This settlement assumes payment of no interest. If this case proceeds to trial, the County would
be required to pay statutory interest from October 19, 2005 on the difference between the deposit

amount and the verdict amount. Statutory interest through December equals an aggregate of
45%. A favorable verdict using $164,000IAcre and a 10% valuation of the FPL easement would
be $568,479 and $127,160 in interest for a total of $695,563. Expert fees for trial for both
County and owner will likely exceed $200,000, which is a cost the County would bear.
I am recommending settlement because the County's trial exposure well exceeds the settlement
amount.

MEDIATED SETfLEMENT AGREEMENT
At the Mediation Conference held on October 18, 20 10, the parties reached the
following Settlement Agreement:
1. Petitioner will pay to Respondent, Wilton Land Company, LLC, the sum
of $ 115) 5 D 0 in full settlement of all claims for compensation
from Petitioner whatsoever, including statutory interest and all claims related to real
estate, but excluding attorney's fees, experts' fees, and costs. Said sum will be subject to
claims of apportionment, if any. Petitioner is entitled to a credit in the amount of
$ /)95, 'lDD , said amount having been previously deposited in the
Registry of the Court in this case by Petitioner. Upon the satisfaction of the terms and
conditions ofthis Settlement Agreement and the entry of the Stipulated Final Judgment in
this matter, Petitioner will deposit in the Registry of the Court the sum of
$ 4 J9 I ~ 00 , representing the difference between the total
settlement sum referenced above and Petitioner's previous deposit referenced above.
2. In addition to the above-referenced settlement sum, Petitioner will pay to
Respondent's attorney $ J d -=I, '700 in full settlement and satisfaction of
all attorney's fees, including fees related to monetary and non-monetary benefits and
supplemental proceedings, if any, and attorney's litigation costs incurred by Respondent
in this case.
3. In addition to the above-referenced settlement sum and the above~

this Settlement Agreement within ten days following the final approval of this Settlement
Agreement by the Collier County Board of County Commissioners.
6. Attached hereto is an addendum to this Settlement Agreement.

ADDENDUM TO MEDIATED SETTLEMENT AGREEMENT
1. 701R, 703R, 704, and 705 are temporary construction easements. Said Easements are
hereby canceled and of no further force and effect, and the County will deliver a
statutory deed for said parcels to Respondent's counsel, duly approved by the County
C9mmission and executed by the appropriate County official.
2. The parties agree that Respondents, and their successors and assigns, may use Parcels
801N, 803RA, 830, 831 and 832R for any purpose not inconsistent with the County's
use, and specifically including retention ponds, detention ponds, drainage, parking,
open space, and road crossings, and Respondents agree that they will provide the
County with access to maintain their fiber, electric and raw water lines located in Parcels
902AN, 902RA, 902RB, 904, 905, 930, 931 and 932R, with said access being, at ._.
minimum, via the access which Respondents provide to FP&l for FP&l's maintenance of
FP&l's equipment located on the FP&l easements (OR Book 870, Page 343; OR Book
668, Page 1751; OR Book 673, Page 1843; OR Book 687, Page 317; and OR Book 692,
Page 774, all of Collier County Public Records); the County may use any or all of Parcels
801N, 803RA, 830, 831, and 832R to access said fiber, electric and raw water lines until
development of Respondents' property, and thereafter, the specific route available to
the County for said maintenance shall be by mutual agreement of the County and
Respondent and said route shall support the weight and size and turning movements of
vehicles typically used for such maintenance and repairs.
3. Upon completion of future maintenance activities, the County shall restore the surface
a rea of the easements to the condition which existed prior to the County's use of the
easement. ~
