percent of COJliCrCounty impact fees for owner occupied affordable housing dwelling units.
CONSml86>>P~S: Article N of Chapter 74 of the Code of Laws and Ordinances established a
program to~,;~ fees for qualified affordable housing. Pursuant to this program, a developer
submitted appH~onsfor deferment of impact fees and 'the Board of County Commissioners approved
the developer's teqUeStS.
On November 13,2007, the Board of County Commissioners approved three (3) impact fee deferral
agreements for Leonar Homes, 'LLC,for the construction of affordable housing units in Heritage Bay
Planned Unit Development (PUD). However, the developer paid the impact fees ~. full ~ never
requested a refund The developer's purpose for paying the associated impact fees ~ to ~ving a
deferral is to avoid any potential delays in construction. Since all impact fees associatId with these three
(3) buildings have been paid, the developer is entitled to releases of lien for the buildings identified
below. Evidence of paytnent is attached as backup.

On May 13, 2008, the Board of County Commi~oners approved an impact fee deferral for a single
family detached residential dv.relliila unit. The applicant has repaid all funds deferred, plus accrued
interest. As such, ,the repaymeatObligation has been fulfilled and a release of lien is needed. Evidence of
payment is attached as backup. .

LIEN AGREEMENT WITH DEVELOPER FOR DEFERRAL OF 100% OF
COLLIER COUNTY IMPACT FEES FOR OWNER OCCUPIED AFFORDABLE
HOUSING DWELLING UNITS
This Agreement is entered into this ,,......day of October, 2007, between Collier County, a
political subdivision of the State of Florida (COUNTY) and "US Homes/Lennar Homes LLC"
(DEVELOPER), collectively stated as the "Parties."
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which is mutually acknowledged, the Parties agree as follows:
1. This Lien Agreement is made pursuant to Chapter 74 of the Code of Laws and Ordinances of
Collier County, Florida, known as "The Collier County Consolidated Impact Fee Ordinance"
(Ordinance). In the event of any conflict with this Agreement, the terms of the Ordinance shall
apply.
2. The legal description of the dwe1Ht~bit "A."

COUNTY shall be entitled to recover all fees and costs, including attorney's fee and costs,

sell the unit to persons whose legal status will be verified, documented and kept on file at the
office of Housing and Human Services. If the developer fails to comply with the terms of the
agreement, or the unit ceases to be utilized for affordable housing, or is not sold to legal
residents, the full amount of deferred impact fees shall be immediately repaid to the County,
including all applicable interest and penalties.
8. This Agreement is the sole agreement between the parties with respect to the subject matter
herein, and shall be binding upon the DEVELOPER'S successors and assigns in interest,

Here is the breakdown of water and sewer impact fees for the 8-Unit building:
Each unit over 1,500 sf = $3,415 for water and $3,515 for sewer (4 units at this rate)
Each unit over 750 but under 1500 = $2,290 for water and $ 2,355 for sewer (4 units at this rate)
Please note that 55 ERCs for water and sewer impact fees were applied to permit # 2006 121 829 (permit 2007041638
and 2007041635 had no water or sewer impact fees applied to these permits).
