Agenda 09/28/2010 Item #17F Agenda Item No. 17F September 28, 2010 Page 1 of 20 EXECUTIVE SUMMARY Recommendation to approve the annual rate resolution to establish the fees, rates, and charges for the use of Collier County Solid Waste Facilities, including landfill tipping fees, recycling center fees, and residential multi-family and commercial solid waste collection fees for FYll. This resolution adopts the rates that fund the FYll budget for solid waste collection and disposal. OBJECTIVE: Approve the annual rate resolution setting landfill tipping fees, recycling center fees, and residential multi-family and commercial solid waste collection fees for FYI!. This resolution adopts the rates that fund the FYII budget for solid waste collection and disposal. CONSIDERATIONS: The Public Utilities Division's Solid Waste Management Department's budget is based on user fees for the Collier County Landfill, the Immokalee Transfer Station, and its three recycling centers (Marco Island, Naples, and Carnestown). These fees are critical to sustaining the Board of County Commissioners (Board)-approved Integrated Solid Waste Management Strategy, which provides directives towards obtaining best value solutions to preserving valuable landfill (disposal) airspace, and the proper disposal of solid waste generated in Collier County. The fees outlined in the rate resolution support the Solid Waste Management Department's FYI 1 Budget approved by the Board at the September 23, 2010, budget meeting. These rates reflect budget guidance and provide the appropriate fees necessary to collect, process, recycle, and/or dispose of the wide range of waste generated in the county. Waste collected throughout Collier County includes municipal solid waste taken to the landfill and recycling centers, biomass, construction and demolition materials. tires, electronics, household hazardous waste, cardboard, white goods, and furniture. The rate resolution provides the correct funding to retire costs associated with the demands for solid waste disposal, while planning for the future recycling and solid waste needs of our community. The FYI] Solid Waste Management Department disposal tipping fees remain consistent with the FY 10 fees; there are no disposal tipping fee increases for FYI I. Included in the resolution for FYl I are rates for residential and commercial bulk containers (dumpsters) and compactors. These services have two cost components. The first is a collection component. Pursuant to the tenns of the franchise agreement, Section 27.1, calls for 70% of the change in the United States All Urban Consumer Price Index (CPI) and is applied to the prior year's collection rate to derive the new collection rate. The CPI change between May I, 2009, and April 30, 2010, was 2.24"10. Thcrefore. FYIO's collection rate was increased by 1.57% (70% of 2.24%) to arrive at the FYI I collection rate. The second cost component is for disposal. which is impacted by any change in landfill tipping fees. There is no change to this component of cost for FYI I because there is no disposal tipping fee increase for FY 11. Agenda Item No. 17F September 28, 2010 Page 2 of 20 FISCAL IMPACT: The proposed landfill tipping fees and recycling center fees will provide an estimated FYII revenue of $14,401,200 for the Solid Waste Disposal Fund (470). The mandatory trash collection and disposal assessments will provide an estimated FYII revenue of $18,319,000 for the Mandatory Trash Collection Fund (473). LEGAL CONSlDERA TIONS: This item has been reviewed and approved by the County Attorney's Office and is legally sufficient for Board Action. JBW GROWTH MANAGEMENT IMPACT: This rate resolution is in compliance with the Growth Management Plan that provides for increased recycling and reuse of the solid waste stream, Additionally, the Board-approved Integrated Solid Waste Management Strategy provides 32 options, which include increased recycling county-wide to save valuable landfill airspace and further promotes environmental stewardship. Approval of the FYII fees will ensure compliance with the Solid Waste Management Department's 20] 0 AUIR requirements. WHEREAS, these rates reflect budget guidance and provide the appropriate fees necessary to collect, process, recycle, and/or dispose of the County's wide rate of generated waste. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION 1: Resolution No. 2009-236 is hereby superseded in its entirety. Unserviceable Roll Carts must be presented for exchange. Replacement of Roll Carts, due to loss or negligence of the Residential Unit will be paid by the customer in an amount equal to the franchisee's cost for the Roll Cart, plus a $10.88 delivery fee. Each customer is entitled to one change of Roll Cart size at no additional cost. A delivery charge of $10.88 will be paid by the customer for additional changes in Roll Cart size.
