EXECUTIVE SUMMARY
Recommendation to approve the annual rate resolution to establish the fees, rates, and
charges for the use of Collier County Solid Waste Facilities, including landfill tipping fees,
recycling center fees, and residential multi-family and commercial solid waste collection
fees for FYll. This resolution adopts the rates that fund the FYll budget for solid waste
collection and disposal.
OBJECTIVE: Approve the annual rate resolution setting landfill tipping fees, recycling center
fees, and residential multi-family and commercial solid waste collection fees for FYI!. This
resolution adopts the rates that fund the FYII budget for solid waste collection and disposal.
CONSIDERATIONS: The Public Utilities Division's Solid Waste Management Department's
budget is based on user fees for the Collier County Landfill, the Immokalee Transfer Station, and
its three recycling centers (Marco Island, Naples, and Carnestown). These fees are critical to
sustaining the Board of County Commissioners (Board)-approved Integrated Solid Waste
Management Strategy, which provides directives towards obtaining best value solutions to
preserving valuable landfill (disposal) airspace, and the proper disposal of solid waste generated
in Collier County.
The fees outlined in the rate resolution support the Solid Waste Management Department's FYI 1
Budget approved by the Board at the September 23, 2010, budget meeting. These rates reflect
budget guidance and provide the appropriate fees necessary to collect, process, recycle, and/or
dispose of the wide range of waste generated in the county. Waste collected throughout Collier
County includes municipal solid waste taken to the landfill and recycling centers, biomass,
construction and demolition materials. tires, electronics, household hazardous waste, cardboard,
white goods, and furniture. The rate resolution provides the correct funding to retire costs
associated with the demands for solid waste disposal, while planning for the future recycling and
solid waste needs of our community. The FYI] Solid Waste Management Department disposal
tipping fees remain consistent with the FY 10 fees; there are no disposal tipping fee increases for
FYI I.
Included in the resolution for FYl I are rates for residential and commercial bulk containers
(dumpsters) and compactors. These services have two cost components. The first is a collection
component. Pursuant to the tenns of the franchise agreement, Section 27.1, calls for 70% of the
change in the United States All Urban Consumer Price Index (CPI) and is applied to the prior
year's collection rate to derive the new collection rate. The CPI change between May I, 2009,
and April 30, 2010, was 2.24"10. Thcrefore. FYIO's collection rate was increased by 1.57% (70%
of 2.24%) to arrive at the FYI I collection rate. The second cost component is for disposal.
which is impacted by any change in landfill tipping fees. There is no change to this component
of cost for FYI I because there is no disposal tipping fee increase for FY 11.

FISCAL IMPACT: The proposed landfill tipping fees and recycling center fees will provide an
estimated FYII revenue of $14,401,200 for the Solid Waste Disposal Fund (470). The
mandatory trash collection and disposal assessments will provide an estimated FYII revenue of
$18,319,000 for the Mandatory Trash Collection Fund (473).
LEGAL CONSlDERA TIONS: This item has been reviewed and approved by the County
Attorney's Office and is legally sufficient for Board Action. JBW
GROWTH MANAGEMENT IMPACT: This rate resolution is in compliance with the
Growth Management Plan that provides for increased recycling and reuse of the solid waste
stream, Additionally, the Board-approved Integrated Solid Waste Management Strategy
provides 32 options, which include increased recycling county-wide to save valuable landfill
airspace and further promotes environmental stewardship. Approval of the FYII fees will ensure
compliance with the Solid Waste Management Department's 20] 0 AUIR requirements.
RECOMMENDATIONS: Approve the annual rate resolution to establish the fees, rates, and
charges for the use of Collier County Solid Waste Facilities, including landfill tipping fees,
recycling center fees, and residential multi-family and commercial solid waste collection fees for
FY] I, and authorize the Chairman to execute the Resolution.

RESOLUTION SUPERSEDING RESOLUTION 2009-236 AND
ESTABLISHING THE FEES, RATES AND CHARGES FOR USE
OF COLLIER COUNTY SOLID WASTE FACILITIES PURSUANT
TO COLLIER COUNTY ORDINANCE NO. 84 _ 31
WHEREAS, under the authority of Chapter 403.706, Florida Statutes, Collier
County has the responsibility and power to provide for the operation of solid waste
management facilities to meet the needs of all areas of the County; and
WHEREAS, said statutory authority grants the Board of County Commissioners
the power to prescribe, fix, establish and collect fees, rentals or other charges for the use of
the established solid waste disposal system and to pledge such revenues as security for
the payment of bonds issued under said statutory authority for the construction of a solid
waste disposal facility; and
WHEREAS, Florida Statutes, Section 125.01(k)(1) and (2) grants the Board of
County Commissioners the power to provide and regulate waste collection and disposal;
and
WHEREAS, The Board of County Commissioners through its adoption of County
Ordinance No. 84-31 has implemented the user fee system for Solid Waste to all public and
private users.
WHEREAS, these rates reflect budget guidance and provide the appropriate
fees necessary to collect, process, recycle, and/or dispose of the County's wide rate of
generated waste.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION 1: Resolution No. 2009-236 is hereby superseded in its entirety.
SECTION 2: The schedule of rates, charges and fees set forth in Schedule "A",
Residential Collection and Disposal Fees; Schedule "B", Commercial Collection and
Disposal Fees; Schedule "C", Landfill Fees; Schedule "D", Recycling Center Fees;
Schedule "E", Rates for Supplemental Residential and Commercial Collection Service;
Schedule "F", Rate Schedule for Service District No. I, Bulk Container Rates; and,
Schedule "G", Rate Schedule for Service District No. II. Bulk Container Rates are attached
and made an integral component of this Resolution. and are approved for all users of the
Collier County Solid Waste Facilities.

RESIDENTIAL COLLECTION AND DISPOSAL FEES
Solid Waste Collection. DisDosal and Administrative Fees Service District Number I:
(Waste Management, Inc, of Florida Service Area) Assessment for curbside trash
collection twice weekly, collection of Program recyclables once weekly, and bulk items /
white goods once weekly, is $173.49 for Fiscal Year 2011.
Solid Waste Collection. DisDosal and Administrative Fees Service District Number II:
(Immokalee Disposal Company, Inc. of Florida Service Area) Assessment for curbside
trash collection twice weekly, collection of Program recyclables once weekly, collection of
yard trash once weekly collection of yard trash once weekly and bulky items / white goods
once weekly, is $165.28 for Fiscal Year 2011.
Special Reauest Backdoor Service: Service District Number I and Service District Number
II: $587.39 per year in addition to the annual assessment for the unit.
Recvclina Cart Fees: Each Residential Unit is provided an initial Recycling Cart at no
charge to the unit owner. Recycling Carts must remain with the Residential Unit
regardless of change of unit ownership. Unserviceable Recycling Carts must be presented
in exchange for a replacement Recycling Cart. Replacement of Recycling Carts due to
loss or negligence of the Residential Unit is to be paid for by the customer at a cost of
approximately $50.00 per Recycling Cart.
Standard Roll Cart Fees: Each Residential Unit is provided an initial Roll Cart at no charge
to the unit owner. Roll Carts will remain with the Residential Unit regardless of change in
unit ownership, Replacement of Roll Carts, due to normal wear will be provided by the
franchisee. Unserviceable Roll Carts must be presented for exchange. Replacement of
Roll Carts, due to loss or negligence of the Residential Unit will be paid by the customer in
an amount equal to the franchisee's cost for the Roll Cart, plus a $10.88 delivery fee.
Each customer is entitled to one change of Roll Cart size at no additional cost. A delivery
charge of $10.88 will be paid by the customer for additional changes in Roll Cart size.
Customers requesting an additional container will pay an amount equal to the franchisee's
cost, plus a $10.88 delivery fee. The County replaces Roll Carts that are stolen.

Service District Number I: - Mandatory multi-family recycling collection fee is $1.04 per-
unit per-month or $12.48 per year.
Service District Number II: - Mandatory multi-family recycling collection fee is $1.07 per-
unit per-month or $12.84 per year.
Commercial Can Account - District I: - A 96-gallon container collected twice a week is
$14.46 per month or $173.49 per year. If a customer needs more than one container due
to lack of space for a dumpster, each additional container is $14.46 per month or $173.49
per year.
Commercial Can Account - District II: - A 96-gallon container collected twice a week is
$13.77 per month or $165.28 per year. If a customer needs more than one container due

WAIVER OF FEES FOR LITTER AND CLEAN-UP PROJECTS
Pursuant to Board of County Commissioners direction, BCC Agenda 7/31/01, 16C (3),
neighborhood clean-up events will be limited to $4,000.00 per clean-up event, semi-
annually. Public Utilities Administrator may authorize waiver of landfill tipping fees for
these events. If estimated tipping fees exceed $4,000,00 the requesting party must
appear before the Board of County Commissioners for approval.
